Rodney D. Peterson - Denied. (7:38 p.m.)
After consideration and discussion, Michael Harris made a motion to approve construction no closer to the ordinary high water
level than 150’. This motion was withdrawn since the property already has a variance for a 150’ setback. After additional
consideration, Steve Schierer made a motion, second by Michael Harris and unanimously carried, to deny the variance as
requested as no adequate hardship/practical difficulty had been shown that would allow for the granting of the variance as
requested and the applicant can obtain a reasonable use of his property with the existing variance which provides for construction
at 150’ from the ordinary high water level.

Dear Mr. Boyce:
We received your letter of September 14th requesting information on the proposed building
on the southwest end of Horsehead Lake.
According to the shoreland ordinance, it appears that Horsehead Lake is a natural environ
ment lake and as such the requirements call for a 200 foot set back from the shoreline
to the building site.
I have referred your letter to Mr. Malcolm Lee who is the Shoreland Administrator. He
no doubt, will be replying very soon, for he, more than I, does have the answers invol
ving variances, beginning dates of the ordinance, etc..
