Attached is our application for variance for the septic system located on our property on Rush Lake. We are
also enclosing the $175 application fee in good faith but ask that you read this letter before processing the fee.
To begin with we would ask that you read the attached letter that was sent to Inspector Mark Ronning and
David Hauser, County Attorney. This letter details the errors made by County Officials and the cost we’ve
incurred because of these mistakes.
As you can see from the attached letter, we have tried to follow established rules and work with County
Officials to make sure we complete our projects correctly. Our frustration continued when we called to ask
about lengthening the recent addition and were given the “Okay” by Eric Babolian. We will admit that we are
naive about all of the regulations and that is why we called.
Our feeling is that for us to pay an additional $175 for the application or the cost of moving the tank (which
would further decrease the amount of usable land we have - we lost a significant portion of our lot when the
plat was changed to wet land) would be very unfair and would imply that County Officials are not responsible
for their actions.
We feel terrible for the mistake, we feel terrible for the previous mistakes, and we feel terrible about this entire
matter getting to this point. We want to be part of this community and we want to follow the rules established
but it seems that every time we try to, we get knocked for additional costs.
We would ask at this point to consider our request for variance and to wave the application fee. We think this
would be a fair compromise based on the costs we have already incurred.

If you care to submit a variance application to petition the “Board of Adjustment” to allow you to leave
your septic tank at the present 7 feet from your dwelling you may now do so.
I have enclosed the appropriate application forms and schedule.
1 would like to get this situation resolved as soon as possible, so please have your variance application in or
have a septic system professional take out a permit with us to move the tank by 12 June 03.

1 sent you a variance application package on 7 Oct 02. 1 have heard nothing since then from you.
The County Attorney has informed us that “after the fact” variances are no longer appropriate and that
substandard situations are to be referred to his office for charging. Therefore, leaving the tank in place is
no longer an option, it must be moved to a legal distance from the dwelling (at least 10 feet).
Please have a septic system professional take out a permit with us to move the tank by 15 May 03, or 1 will
have to refer this situation to the County attorney.

Dear Mark Ronning,
We are writing in response to your letter dated April 15, 2003. Before we address what
you have in your letter, we would like to provide you with some additional information
that we think comes into play.
In 1996 we sold a 10-acre, riverfront, 2-story vacation property located near the town of
Big Fork in northern Minnesota. We traded this for a 1/2-acre, lakefront, and dilapidated
boathouse outside of New York Mills. The reason for such a change was the people.
Our old cabin was surroimded by neighbors who were dishonest, uneducated, and overall
had a negative influence on our family. When we visited New York Mills and Perham
we met educated, positive, outgoing people; people we would love to have my family
influenced by. Because of this we agreed to “trade down” on properties with the
anticipation of “trading up” on the quality of people around us.
While the majority of the people we have met have lived up to our expectation, we have
to admit that are not totally pleased with how the County has handled their end.
To start, we purchased our property from a developer who sectioned up a larger property
into 12 lots. All of the lots had gone through the plating process and were given legal
descriptions. Not long after we purchased our property we wanted to put through a
driveway so we could access our cabin. As we applied for our application (like all good
residents should) we were then told that a large part of our property should have been
designated wetland and that we could not put a driveway through. This was after the
property was already plated and sold as not being wetland. We were told that the
inspector “missed it”. Because of the “miss” we were forced to miss work, travel 200
miles to Fergus Falls, and pay a $90 application fee to attend a meeting to plead my case.
What made the meeting even more fhistrating was that we had a Minnesota DNR agent
agreeing with that this was not wetland. County representatives would not change their
stand. As a result, the cost of our driveway went up significantly, the value of our
property dropped significantly, and our ability to add a garage has disappeared. We
reluctantly accepted the Board’s decision (trying to be a good neighbor) and paid the
extra costs to finally have access to our cabin. Still, the Board showed no compassion for
their error or the additional cost their error created for our family. This is not exactly
why I chose Otter Tail County.
As time went on, we rehabbed our old boathouse into a small cabin that our family could
enjoy. We did everything we could to be good neighbors. We bought our supplies
locally; we used local contractors, visited local restaurants, hardware stores, etc.
Finally the time came when we could actually put on a small addition and an indoor
bathroom for our four daughters. Again we tried to follow all the necessary steps. We
hired a local contractor, completed and filed our application, and bought our supplies
locally. After visiting with our carpenter we agreed that the original size of the addition
would provide very little additional living space for our family. With this
recommendation, we contacted Eric Babolian at your office and asked about making the
change and if there would be any problems. Eric said that it would be fine and all we had
to do was send him an updated drawing. At this point we contacted our carpenter and
gave him the go ahead.
In October we received a letter fi-om you stating that we were out of compliance by
having our addition 3 feet too close to our septic system. As soon as we received this
letter, we called your office and asked what we needed to do. You informed us of several
items; 1) there is an application for variance that needed to completed, 2) the cost of the
application was $150, and 3) “You probably won’t get a variance”. We really
appreciated the vote of confidence but decided to try anyway. Once we received the
variance kit, we saw that the only remaining scheduled meeting was December 4,2002.
Because of previously scheduled events that day, we would not be able to attend. We
called your office and left you a voice mail stating that we would not be able to make this
last meeting and that we would plan on making one of the spring meetings. We also
asked that you let us know if this would be a problem or if there was someone else we
should contact. Because we did not hear from you, we assumed this would be okay.
This brings us to your letter dated April 15, 2003. First off, we take offense to the
threatening tone of your letter. We have done everything we could to try and make this
entire process work both financially and legally. Your threatening of contacting the
Coimty Attorney brings back the dark days of our time in Big Fork.
Although we have tried to do the right thing up to this point, it appears that the County is
trying to bully us now. Good neighbors are like bank accounts, sometimes you make
deposits, and sometimes you make withdrawals. If all you do is make withdrawals, the
account is closed. The way we see it is Otter Tail Goimty has been making lots of
withdrawals and no deposits. We think it would be a good idea to even the accounts
before we discuss moving the septic. Below is a summary of costs we have incurred
because of your department’s inability to perform (missing/mislabeling wetland and
giving the “go ahead” on the addition change that put us out of compliance) on what they
are required to do.

Up until this point we have tried to be reasonable because we want to be “good
neighbors”, we want to be proud of Otter Tail County and speak well of its residents, its
cities, its businesses, but it becomes difficult when County Agencies and officials don’t
admit and/or correct their mistakes and then threaten its landowners and taxpayers. We
would be happy to contact our septic contractor and have them move the septic tank three
measly feet if Otter Tail County would be willing to either pay for the cost of moving the
tank or reimburse us for the costs of your agency’s prior mistakes.
We are embarrassed to write this letter, to be part of a county system that is so arrogant,
and beginning to have second thoughts of why we chose Otter tail County in the first
place.
