Warren B. Schmitz - Denied
Warren B. Schmitz, Wadena, MN, requested a variance of 15’ from the required ordinary high water
level setback of 75’ for the placement of a trailer house 60’ from (shoreline) the ordinary high water
level. The property is described as Lots 8 and 9, Wildwood Park, Rush Lake in Otto Township. The
audience was polled with no one speaking for or against the request. After consideration, motion was
made by
George Walter, seconded by Cecil Femling and unanimously carried, to deny the variance as
requested as no adequate hardship had been shown and alternatives do exist that would provide the
applicant with a reasonable use of his property.
Mark Lee - Approved
Mark Lee, Fergus Falls, MN, requested a variance to construct a 26’ by 30’ addition to one of two
existing dwellings and to allow both dwellings to remain on the 160 acre parcel. The property is
described as the NEVi of Section 27, Buse Township by Iverson Lake. The audience was polled with no
one speaking for or against the request. After consideration, motion was made by John Everts,
seconded by Cecil Femling and unanimously carried, to approve a variance to construct a 26’ by 30’
addition to one of two existing dwellings and to allow both dwellings to remain on the 160-acre parcel.
It was noted that the applicant has 160 acres, that a road separates the dwelling sites from the lake,
that the dwellings are over 290’ from the lake, that the granting of the variance will assist with the
generation change of the family farmstead and the oldest structure presently occupied by the
applicant’s parents will not be used as a dwelling after the applicant’s parents cease to use the
dwelling. It should be noted that no variances for the sewer system are being granted.
Bruce and Maurine Swanson - Denied
Bruce and Maurine Swanson, Elbow Lake, MN, requested a variance of approximately 4 to 5’ from the
required side lot line setback of 10’ for the construction of an 8’ by 12’ storage building approximately 5
to 6’ from the side lot line. The property is described as part of Government Lot 5, Section 6 and part of
Lot 5, Linden Park, Pelican Lake in Dunn Township. The audience was polled with no one speaking for
or against the request. After consideration, motion was made by Cecil Femling, seconded by Randall
Mann an unanimously carried, to deny the variance as requested as no adequate hardship had been
shown and room is available to place the proposed storage building in a legal setback location.
George and Judith Tabery - Approved
George and Judith Tabery, Perham, MN, requested a variance of 4” from the required lot line setback
of 10’ and a variance of 20’ from the required road right-of-way setback of 20’ for the placement of a
pole shed 9’ 8” from the lot line and 0’ from the road right-of-way or 47’ 6” from the edge of the road’s
traveled surface. The property is described as Lot 5, Block 1, Nelson’s Perfect Beach, Big Pine Lake in
Corliss Township. The audience was polled with no one speaking for or against the request. After
consideration, motion was made by Cecil Femling, seconded by Randall Mann and carried with John
Everts and George Walter voting no, to approve a variance of 4” from the required lot line setback of
10’ and a variance of 20’ from the required road right-of-way setback of 20’ for the placement of an
existing pole shed 9’ 8” from the lot line and 0’ from the road right-of-way or 47’ 6” from the edge of the
road’s traveled surface noting a non-centered road and three other non-complying permitted structures.
The Board of Adjustment directed the Land and Resource Department to send a written statement to
the contractor reminding the contractor of the requirements of the County’s ordinances.
