Dated: June 20th, 2005 Wayne Stein, Secretary Otter Tail County Board of Adjustment \/j1 By: Vi Manderud ■ July 7, 2(105 Page U 3 ' John ancJ Geraldine Hotz - Approved the variance application as requested. (7:40 p.m.) John and Geraldine Hotz, Lot 17 R.O. Master's Boys Shore, Rush Lake in Otto Township, requested the following: 1) 35’ variance of structure setback from ordinary high water level, 2) 2' increase in height of front porch, so that a standard size door can be installed in replacement porch, and 3) we would like to replace our existing porch with maintenance free materials. Other than a possible increase of 1 to 2 feet in roof height of porch, the porch measurements will not change. Existing porch is 5'4” by 18’ 2". Randall Mann, Chair, polled the audience with no one speaking for or against the variance as requested. After consideration and discussion, Paul Larson made a motion, second by Cecil Femling and unanimously carried, to approve the variance as described in the variance application dated June 8, 2005. Hardship is a substandard lot of record. The Board noted that the applicants' proposed project is maintenance to the existing structure. Tammy Hofer - Denied. (7:45 p.m.) Tammy Hofer, part of Lot 8 and all of Lot 9, Jerry-Marg Beach Third Addition, Lake Seven/Scalp in Hobart Township, requested a variance of 66’ from the required ordinary high water level setback of 100' for the placement of a 754 square foot deck 34' from the ordinary high water level. Randall Mann, Chair, polled the audience with no one speaking for or against the variance as requested. After consideration and discussion, Randall Mann made a motion, second by Steve Schierer and carried with Paul Larson and Robert Schwartz voting no, to deny the variance as requested noting that the deck is within the shore impact zone, ahead of the string line and a reasonable use of the property can be obtained without the granting of the variance as requested. Paul and Martha Pfeifle - Approved the variance application as modified. (8:05 p.m.) Paul and Martha Pfeifle, part of Lot 4, all of Lot 5 and part of Lot 6, Block 2, and Lot 6 Block 3, Crystal Lida Beaches, Lake Lida and Lake Crystal in Lida Township, requested the following: We are going to discontinue Log Haven Resort which currently has 4 camper lots, 2 cabins and existing variances for 2 additional cabins. We would like to separate the existing resort into 2 single family residential lots. At this time we are requesting a variance to split all of Lot 5 and West 50’ of Lot 4, Block 2 from the existing resort property on Lake Lida. Lot 6 Block 2 Except Tracts on the Lake Lida side would be retained and permanently attached to the West 50’ and East 50' of Lot 6, Block 3 on the Crystal Lake side. On Lot 6, Block 3 of the Crystal Lake side we are asking for a variance of 65’ from the ordinary high water level setback of 100’ and a variance of 15' from the shore impact zone in order to build a replacement dwelling at 35’ from the ordinary high water level. The proposed residential dwelling would be no closer to the lake than the existing cabin. Also on Lot 6, Block 3 we are asking for a variance to exceed the 25% impervious cover, The property at this time is at 66% impervious cover and the proposed replacement dwelling would reduce the impervious cover to approximately 45%. Lot 6 Block 2 on the Lake Lida side is our proposed drain field site and would not have any additional building on the lot. Wes Tweeton, Contractor, appeared with the applicants at the public hearing. Randall Mann, Chair, polled the audience with Keith Johnson, Conley Ruud and Mike McNally speaking for the variance as requested. A letter from Donald McCracken opposing the variance as requested was read for the record. A petition signed by 16 individuals and a letter signed by Kirsten and Tom Anderson in support of the variance application were read for the record. After consideration and discussion, Randall Mann made a motion, second by Steve Schierer and unanimously carried, to approve the following:
