(7:08 p.m.) After discussion and consideration, Steve Schierer made a motion, second by Paul Larson and unanimously carried, to approve a variance of 10’ from the required 20’ road right-of-way setback for the placement of the northeast corner of a 16’ by 22’ garage 10’ from the road right-of-way. The Board noted that the only individual impacted by the variance approval is the applicant as the easement road serves only her property. (7:02 p.m.) Robert and Shanna Hendrickson, part of Government Lot 1, Section 15 of Edna Township by Paul Lake, requested a variance to extend the proposed building beyond the approved string test line by approximately 20’ on the southeast corner of the proposed building. The proposed building would be approximately 75’ from the ordinary high water level. The deck would be approximately 7T from the ordinary high water level. The required ordinary high water level setback is 100’. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Steve Schierer made a motion, second by Michael Conlon and unanimously carried, to approve the proposed development being no closer to the ordinary high water level then what would be permitted by the general building line. The general building line is a line running from the lakeside corner of the home on the north to the lakeside corner of the home on the south and as been depicted in red by the Board’s Secretary on the applicants’ drawing dated November 3, 2005. Please note that the general building line is from the front corner of the dwellings and not from the front corner of the decks. Hardship is the angle of the south property lot line. Barbara J Parries - Approved the variance as requested. (7:08 p.m.) Barbara J Parries, Lot 3 Boys Shore, Rush Lake in Otto Township, requested a variance of 10’ from the ordinary 20’ easement road right-of-way setback for the placement of the northeast corner of a 16’ by 22’ garage 10’ from the easement road right-of-way. The audience was polled with no one speaking for or against the variance as requested. Rick Miller represented the applicant at the public hearing. A letter from Mel Johnson in support of the variance as requested was read for the record. After discussion and consideration, Steve Schierer made a motion, second by Paul Larson and unanimously carried, to approve a variance of 10’ from the required 20’ road right-of-way setback for the placement of the northeast corner of a 16’ by 22’ garage 10’ from the road right-of-way. Kit and Jacquelyn Nelson - Approved the variance as requested. (7:12 p.m.) Kit and Jacquelyn Nelson, Lots 4 and 5 Block 1 Buehler Addition, requested a variance to place drain field within the road right-of-way of Buehlers Drive. The audience was polled with no one speaking for or against the variance as requested. A letter from the Hobart Town Board accepting the location of the proposed drain field was read for the record. After discussion and consideration, Cecil Femling made a motion, second by Michael Conlon and unanimously carried, to approve the placement of a drain field partly within the road right-of-way as depicted on the drawing prepared by Tom Falk and dated October 24, 2005. The Board noted that this is perhaps the best, if not the only location, for the drain field and the variance as approved is consistent with past Board actions. Randy and Julie Klawitter - Approved the variance as requested with conditions. (7:13 p.m.) Randy and Julie Klawitter, Lot 1 Blocks 1 and 2, West Lost Lake Addition, requested a variance to allow Lot 1 Block 2, West Lost Lake Addition to be permanently attached to an existing adjacent 6 acres parcel. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Michael Conlon made a motion, second by Randall Mann and unanimously carried, to approve the permanent attachment of Lot 1 Block 2, West Lost Lake Addition to parcel number 38-000-29- 0227-002. It should be noted that Lot 1 Block 2 was originally attached to Lot 1 Block 1. The detachment from Lot 1 Block 1 will not negatively impact Lot 1 Block 1.
