Penney, Nev York Mill, MN, requested a variance of 1' 4" from the required side lot line setback of 13' for the construction of a 5' by 25' breezeway, an 8’ by 13' storage room and an 18' by 27' garage. The property is described as Lot 15, Oak Point Park, Rush Lake in Otto Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Cecil Femling, seconded by Craig Anderson and unanimously carried, to approve a variance of 1' 4" from the required side lot line setback of;10' for the construction of a 5' by 25' breezeway, an 8' by 13' storage room and an 18' by 27'; garage being 8' 8" from the side lot line. Hardship being a substandard lot of record.1, I Dan and Lisa Balmstrom - Approved Dan and Lisa Malmstrom, Clitherall, MN, requested a variance to subdivide an ey.isting 11.59 acre parcel into two parcels' by metes and bounds description. One parcel would be approximately 4 acres and the other parcel would be approximately 7.5 acres. Subdivisions by metes and bounds descriptions, within the shoreland area, must be at least 5 acres in size to meet the requirements of the Subdivision Controls Ordinance. The property is described as part of Government Lots 1 and 4, Section 32 of Aurdal Township on the Otter Tail River. The -audience was polled with no one speaking for or against the request. Letters in favor of the variance request from Aurdal Township, Mr. and Mrs. Sverre Stedjan and Mr. and Mrs. Kenneth Peeders were read for the record. After consideration, motion was made by Randall Mann, seconded by Craig Anderson and unanimously carried, to approve a variance to subdivide an existing 11.59 acre tract into two parcels as described in the variance application. One parcel will he approximately 4 acres and the other parcel will be approximately 7.5 acres. It was noted that each parcel will substantially comply with the requirements of the Subdivision Controls Ordinance, each parcel will have a building site, no additional variances will be necessary for the placement of a dwelling on either parcel and the terrain features of the 11.59 acre parcel made it necessary for one parcel to have an area less than the minimum ordinance requirement of 5 acres. Charles Ario - Approved Charles Ario, Dalton, MN, requested a variance to allow eleven structures, all placed without permits, to remain within the 200' setback from the ordinary high water level. The property is described as part of Government Lot 7, Section 22 and part of Government Lot 4, Section 27 of Dane Prairie Township on Indian Lake and Larson Lake. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Craig Anderson, seconded by Randall Mann and unanimously carried, to approve a variance from the required ordinary high water level setback of 200' for all noncomplying structures, with the exception of an 8' by 12' gazebo which must be removed, and with the condition that at the time the-property is sold, subdivided, or conveyed through Mr. Ario's estate all noncomplying structures will either be removed or placed in locations that comply with the requirements of the ordinance in effect at the time of the sale, subdivision or conveyance. The property is described as Lot 1; First Addition to Pelican Lake Park, Pelican Lake in Dunn Township. Jim Anderson, Contractor, appeared along with the applicant at the public hearing. The audience was polled with no one speaking' for or against the request. After consideration, .motion was made by Randall Hann, seconded by John Everts and unanimously carried, to approve a variance of 9' from the required ordinary high water level setback of 75’ for the construction of a 20' by 26' addition to an existing structure 66’ from the ordinary high water level and a variance of 19' from the required ordinary high water level setback of 75' for the construction of a 10’ by. 32' deck, to the front side of an existing structure, 56' from the ordinary high-water level with the condition that no other water - oriented accessory structures can beiplaced in front of the dwelling. No precedent will be established in the immediate area; by the granting of the variance request. It was ' noted,'that the 20’ by 26’ addition will be no: closer to the ordinary high water level than ; . the existing structure. The granting of the variance request will allow the applicant to enjoy the rsarne rights and privileges as others in the immediate area. Charolette Lamb - Approved: Charolette Lamb, Dilworth, KN, requested a variance to subdivide an existing metes and V -bounds parcel into two metes and bounds parcels of less than 5 acres. The Otter Tail ACounty . Subdivision Controls ordinance r equires that metes and bounds parcels, within the .shoreland larea, must be, at least 5 acres in size. One parcel would have approximately .150’ of lake frontage and the other parcel would have approximately 100’ of lake frontage. Both .parcels would have a depth of at least 300’ and would meet the minimum width and area requirements for platted lots on a general development lake. The property is described as part of Government Lot 2, Section 2 of Dead Lake Township on Narion Lake. The audience was polled with no,one speaking for or against the request. After consideration, motion was made by Craig Anderson, seconded by Cecil Femling and unanimously carried, to approve the .variance as .requested with the condition that a registered surveyor’s drawing must be provided at the time of recording and with the condition that no additional variances will be granted in the future. It was noted that the lots meet the minimum requirements for platted lots on a -general .developme.nt lake. :7 ...
