MOTION AS FOLLOWS:
Motion was made by Randall Mann, seconded by Cecil Femling and unanimously carried, to approve a variance to
subdivide a parcel of less than 5 acres from an existing 5.29 acre parcel and a variance to allow the conveyance of
substandard parcels between Thompson and Malloy as illustrated on the registered surveyor’s drawing. It was noted
that the subdivision of the 5.29 acre parcel would result in 2.29 acres being attached to the balance of the Thompson
Farm and the remaining three acres would be a stand alone parcel. It was also noted that the granting of the second
variance request would enable the applicants to file documents that will correctly describe the property as physically
occupied by Jess and Darlene Thompson and Lavonne Malloy.

Land description:
That part of Government Lot 2 in Section 31, Township 135 North, Range 38 West of the Fifth Principal Meridian in Otter Tail County, Minnesota, described as follows:
Commencing at an iron monument which designates the most southerly corner of BELLE ACRES, said plat is on file
and of record in the office of the Recorder of said County; thence North 67 degrees 34 minutes 32 seconds East 248.61 feet on an assumed bearing along the southeasterly line of a Roadway according to said BELLE ACRES to an iron monument, said point is the point of beginning; thence continuing North 67 degrees 34 minutes 32 seconds East 333.29 feet along the southeasterly line of said Roadway to an iron monument; thence South 00 degrees 01 minute 32 seconds East 603.13 feet to an iron monument; thence South 89 degrees 58 minutes 28 seconds west 508.00 feet to an iron monument;
thence North 00 degrees 01 minute 32 seconds West 291.44 feet to an iron monument; thence North 68 degrees 52 minutes 24 seconds East 252.28 feet to an iron monument; thence North 20 degrees 44 minutes 35 seconds West 100.36 feet to the point of beginning. The above described tract contains

Jess and Darlene Thompson and Lavonne Malloy - Approved
Jess and Darlene Thompson, Ottertail, MN, requested a variance to subdivide a parcel of less than 5 acres from an
existing 5.29 acre parcel (the tract would be approximately 3 acres and the remaining 2.29 acres would be attached to
the balance of the Thompson Farm) and Jess and Darlene Thompson, Ottertail, MN, and Lavonne Malloy, Lakeville,
MN, requested a variance to allow the conveyance of substandard parcels between Thompson and Malloy as
illustrated on a registered surveyor's drawing on file with the County Auditor’s office. If approved, the second
variance request will enable the applicants to file documents that will correctly describe the property as physically
occupied by Jess and Darlene Thompson and Lavonne Malloy. The property is described as part of Government Lot
2, Section 31 of Otto Township by Rush Lake. The audience was polled with no one speaking for or against the
request. After consideration motion was made by Randall Mann, seconded by Cecil Femling and unanimously
carried, to approve a variance to subdivide a parcel of less than 5 acres from an existing 5.29 acre parcel and a
variance to allow the conveyance of substandard parcels between Thompson and Malloy as illustrated on the
registered surveyor’s drawing. It was noted that the subdivision of the 5.29 acre parcel would result in 2.29 acres
being attached to the balance of the Thompson Farm and the remaining three acres would be a stand alone parcel. It

Alice Stenstrom Westberg - Approved
Alice Stenstrom Westberg, Hoffman, MN, requested a variance of 28’ from the required ordinary high water level
setback of 100’ for the construction of an 18’ by 28’ addition onto an existing basement 72’ from the ordinary high
water level. The property is described as part of Government Lots 2 and 3, Section 12 of Elizabeth Township by Long
Lake. The audience was polled with no one speaking for or against the request. After consideration, motion was
made by Randall Mann, seconded by Cecil Femling and unanimously carried, to approve a variance of 28’ from the
required ordinary high water level setback of 100’ for the construction of an 18’ by 28’ addition to an existing
basement 72’ from the ordinary high water level. It was noted that the addition will be no closer to the ordinary high
water level than the existing stnjcture, that the addition will not obstruct the view of the adjacent properties and no
precedence will be establish by granting this request.
Walter Gordon Schmidt - Denied
Walter Gordon Schmidt, Underwood, MN, requested a variance to subdivide an existing 3.94 acre parcel into two
tracts. One parcel would have approximately 1 acre of area and 50’ of water frontage and the other parcel would
have approximately 2.94 acres of area and 128’ of water frontage. The minimum water frontage/lot width and area
for platted lots on a recreational development lake is 150’ of frontage and 40,000 square feet of area. The minimum
area requirement for metes and bounds parcels within the shoreland area is 5 acres. The property is described as
part of Government Lot 8, Section 2 of Sverdrup Township by East Lost Lake. The audience was polled with no one
speaking for or against the request. After consideration, motion was made by Craig Anderson, seconded by John
Everts and unanimously carried, to deny the variance as requested as the granting of the variance request would
establish a precedence by creating a lot having water frontage/lot width that does not meet even 75 percent of the
minimum footage/width required.
