Motion was maide by John Everts, seconded by Craig Anderson and unanimously
approve a variance to subdivide an approximately 30' by 310' tract from tan existing j
acre parcel without a registered surveyor's drawing and with the condition that the tract
be permanently attached to the adjacent property owned by the proposed bu^TTr in Government-----
Lot 2. In addition the applicant will be conveying the West 30' of the Southwest 1/4 of
the Northwest 1/4 of Section 31 (approximately .91 acre) to the proposed buyer for
permanent attachment to the proposed buyer's adjacent property. The granting of the
variance request allows the attachment of a 30' wide tract back to the government lot and
quarter section from where it had been previously split off to provide for a private access

Lavonne Malloy - Approved
Lavonne Malloy, West St. Paul, MN, requested a variance to subdivide from an existing .94
acre fiarcel, without a registered surveyor ’s drawing, a tract in Government Lot 2
approximately 30’ by 310*. This tract would he permanently attached to adjacent property
owned by the proposed buyer. The applicant also owns the West 30’ of the Southwest 1/4 of
the Northwest 1/4 of Section 31 and if the variance is approved will be conveying this
parcel (approximately .91 acre) to the proposed buyer for permanent attachment to the
proposed buyer’s adjacent property. The property is described as part of Government Lot 2
and the West 30' of the SWl/4 NWl/4, Section 31 of Otto Township on Rush Lake. Jess
Thompson, the purchaser, represented the property owner at the hearing. The audience was
polled with no one speaking for or against the request. After consideration, motion was
made by John Everts, seconded by Craig Anderson and unanimously carried, to approve a
variance to subdivide an approximately 30’ by 310’ tract from an existing .94 acre parcel
without a registered surveyor’s drawing and with the condition that the tract be
permanently attached to the adjacent property owned by the proposed buyer in Government

John E. and Brenda L. Orrell - Approved
John E. and Brenda L. Orrell, West Des Moines, IA, requested a variance to have more than
25>; of the total lot area covered with impervious surfaces and a variance of 6’ from the
required side lot line setback of 10' for the replacement of an existing 14’ by 22’ garage
with a 24’ by 30’ double garage, 4’ from the side lot line. The property is described as
part of Government Lot 3, Section 10 of Dunn Township on Pelican Lake. The audience was
polled with Richard Sturlaugson speaking in favor of the request. After consideration,
motion was made by Cecil Femling, seconded by Randall Mann and carried with George Walter
voting no, to approve a variance of &’ from the required side lot line setback of 10’ for
the replacement of an existing 14’ by 22’ garage with a 24’ by 30’ double garage being 4’
from the north side lot line.It was noted that the terrain and topography of the
adjacent lot will restrict the placement of a structure parallel to the applicant’s
structure.It was noted at the meeting that the applicant’s lot, with the addition of the
new garage, has impervious surfaces covering no more than 23X of the total lot area.
Hardship being a substandard lot of record.

MOTION AS FOLLOWS:
Motion was made by Randall Mann, seconded by Cecil Femling and unanimously carried, to approve a variance to
subdivide a parcel of less than 5 acres from an existing 5.29 acre parcel and a variance to allow the conveyance of
substandard parcels between Thompson and Malloy as illustrated on the registered surveyor's drawing. It was noted
that the subdivision of the 5.29 acre parcel would result in 2.29 acres being attached to the balance of the Thompson
Farm and the remaining three acres would be a stand alone parcel. It was also noted that the granting of the second
variance request would enable the applicants to file documents that will correctly describe the property as physically
occupied by Jess and Darlene Thompson and Lavonne Malloy.
