We are requesting an exception to build at 68 - 69 feet from the ordinary high water mark as opposed to the
75 feet normally required. This will allow us at make an addition to our current 768 square foot cabia The
proposed addition would be 20 feet wide by 44 feet in length. This would provide for a 14 foot setback
from the property line to our West. It would leave a 12 foot setback to our holding tanks and a 52 foot
setback to the road easement at the southern property line. The front wall and roofline of this addition
would be even with the existing cabia, thus making it no closer to the lake than the current structure.
We ask the committee to please consider three relevant factors in making their decision:

We have a substandard/non-conforming lot (less than the minimum 20,000 square feet
required).
Building at the required setback would cause us to be too close to the existing septic holding
tanks and thus cause us to be in violation of this setback requirement.
The current shoreline management ordinance indicates that all property owners shall enjoy the
same rights and privileges as others in the immediate area Please reference the Otter Tail
County Board of adjustment minutes from 5/6/99 in which a nearby property owner was
granted a similar variance with attention given to the fact that the addition would be no closer
to the lake than the existing structure.

Michael J. and Molly B. Haglin, requested a variance of 7’ from the required ordinary high water level
setback of 75’ for a 20.’ by 44’ addition 68’ frorn the ordinary high water level. It should be noted that the
placement of the-addition at this location would .\allow.the front wall and the roofline of the addition to be
even with the existing cabin, thereby making,it ho closer to the lake than the current structure. The
property is described as Lot 6, G. Anderson Survey Lots of Government Lot 1, Section 30 of Otto Township
by Rush Lake. The audience was polled with Warren Larson speaking in favor of the request. After
consideration, motion was made by Mark Steuart, second by Randall Mann and unanimously carried, to,
deny the variance as requested and to support the action taken by the Board of Adjustment on July 8,
1999.
Leaf Lake Township and Mark Rortvedt - Approved
Leaf Lake Township and Mark.Rortvedt, Henning, MN, requested a .variance to install a drain field T from
the property line and under:a.4’ township footpath. A utility easement will be filed with the township. The
property is described as Lot 7, Block 7, Lot 2, Block 6 and 50’ adjacent to Lot 2, Block 6 of Reserve Block :
D, Leaf Lake Pleasure Grounds, West Leaf Lake in Leaf Lake Township. The audience was polled with
William Goepferd, the adjacent neighbor, speaking in favor of the request. After consideration, motion was
made by Cecil Femling, second by David Holmgren.and unanimously carried, to approve a variance to
install a drain field T from the property line and under a 4’ township foot path noting that it is the .best
location for the installation of the proposed drain field as determined by a licensed installer. Hardship is a
substandard lot of record.
Steven M. Hammer-Approved with condition.
Motion was made by Randall Mann, second by David Holmgren and unanimously, carried, to reconsider the
variance application which was heard and denied at the-June 3, 1999 Board of Adjustment meeting and to
allow the applicant an opportunity to present new information for consideration by the board. Brain
Brogard appeared along with Mrs. Steven Hammer at this hearing. A letter from Terrence R. l_ejcher. Area
Hydrologist, addressing soil compaction and the percolation test, which was run before and after the
parking of a vehicle bn the site, was read for the record. Based upon this letter and other comments
shared by Mr. Brogard, motion.vvas made by Randall Mann, second by David Holmgren and carried with
Frank Lachowitzer abstaining, to approve the installation of a drain field T from the applicant’s garage, T
from the lot line with the condition that the adjacent neighbor provide a letter stating his/her agreement with
the location of the drain filed.. It was noted that adequate space does exist for the maintenance of the drain
field and that the new system would be an improvement over the existing system. It was also noted that •
the variance is from a detached garage and not an occupied dwelling. Hardship is a very small lot and no .'
other sites available to the applicant.
Jeannie Madson - Tabled
Jeannie Madson, Pelican Rapids, MN, requested a variance of 25’ from the required ordinary high water
level setback of 75’ for a 12’ by 12’ addition to an existing dwelling 50’ from the ordinary high water level.
The property is described as Lot 15, Broadwater Beach Second Addition, Pelican Lake in Dunn Township.
The applicant was hot in attendance at the public hearing. After discussion, motion was made by Cecil
Femling, second by Mark Steuart and unanimously carried, to table the applicant’s, request until the
September 9, 1999 meeting.
With no further business Chairman Everts'declared the meeting adjourned at 9:37 p.m.
