On the altered image I showed a roof extending over what I called a patio (I have since learned that I used the wrong terminology and should have called it a porch). I then said we would be using part of the original slab and drew an arrow to it and labeled it as the patio I made the mistake of then simply calling this a patio based off that altered image and thought that that was what we had a permit for. Eric, has educated me on the differences of a patio/porch and deck, lol. So I am asking what we need to do to keep the cover over our "porch". The Board of Adjustment considered the following applications for variance: Richard Taggart - Denied. (6:31 p.m.) Richard Taggart, part of Government Lot 2, Section 30 of Otto Township by Rush Lake, requested the following: We covered our “patio” areaijjl 6’ by 28’) thinking it was allowed in the permit. After discussion and consideration, Paul Larson made a motion, seconded by Loren Bailey and unanimously canied, to approve a variance of 22’ from the required ordinary high-water level setback of 75’ for the purpose of raising the existing roof 2’as stated in the variance application dated July 13, 2017. It was noted that the variance as approved is consistent with past decisions of the board and the proposed development will be no closer to the ordinai-y high-water level than the existing stnacture. The variance as approved does not directly or indirectly grant any other variances for the proposed development or for any future development. Marianne Bryan - Denied. (6:48 p.m.) Marianne Bryan, Lot 2 Fleming Patterson Beach, Swan Lake in Dane Prairie Township, requested the following: 1 request that my tiny house on wheels (192 square feet and self-contained) remain in the current position which is closer than the usual lake setback to avoid any removal of trees or lilac bushes. Requesting a variance of 36’ from the required ordinaiy high-water level setback of 100’ for the placement of a tiny house 64’ from the ordinary high-water level. The audience was polled with Brian and Debra Geis speaking for the variance as requested. (6:35 p.m.) Richard Taggart, part of Sub Lot A of Government Lot 2, Section 30 of Otto Township by Rush Lake, requested .the following: Moving the original non-compliant building back from the waterline (current location is “on” the high water line-due changes on shoreline over 30 years) to a location 31 ’ off the high water line. To go 40’ back would require filling in a natural water runoff to. our neighboring wetlands. Would be rotating the existing building reducing its frontage fr om 30’ to 24’ and 6’ further away from the property line doing all we can to make the original building closer to current guidelines. The proposed structiire will be approximately 15’ from the lot line at the closest point; required setback is 40’ from the lot line. Also proposing to keep a 15’ by 30’ portion of the existing concrete slab which the boathouse currently sits on and use for a patio. Requesting a 910 square feet variance in the shore impact zone (SIZ). The total square footage covered in the shore impact zone is 1,170 square feet (Boathouse 720 and Patio 450). The required shore impact zone coverage is 260 square feet. The'audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Thomas Lee made a motion; seconded by Darren Newville and unanimously carried, to approve the variances for the proposed development as described in the variance application dated August 24, 2016 and as depicted on the drawing submitted with the variance application with the condition that the required 3’ vertical separation must be maintained. The proposed project is basically repairs to an existing boathouse that has been damaged many times. The proposed location is further back from the ordinary high water level and side lot line tlian the existing structure. The proposed structure will be the same size as the existing structure and it use and placement is similar to other structures in this immediate area.
