(7:37 p.m.) Mark Kempf, Lots 6 and 7 Engstrom Beach 4*^ Addition, McDonald Lake in Edna Township, requested a variance to construct a mound system with 12” of separation instead of the required 24”. The audience was polled with no one speaking for or against the variance as requested. Mike Lovelace represented the applicant at the public hearing. After discussion and consideration, Randall Mann made a motion, second by Cal Zick and unanimously carried, to approve, based on information regarding the Minnesota Septic Requirement Rule 70/80 as provided by Kyle Westergard, a variance to construct a mound system with 12” of separation instead of the required 24". Minnesota Septic Requirement Rule 70/80 requires 12” of separation and the Otter Tail County Board of Commissioners are considering adopting Minnesota Septic Requirement Rule 70/80 in full. It was noted that the Land and Resource Department recommends mound systems over holding tanks. Paul A. Pinke - Approved the variance as requested with conditions. (7:50 p.m.) Paul A. Pinke, part of Government Lot 6 Section 2 of Dora Township by Loon Lake, requested the following; The lakeshore that I own consists of two projections into Loon Lake each being less than 1 acre. I would like to separate the two projections and sell them to the landowners across County Highway 35 from each. The audience was polled with no one speaking for or against the variance as requested. A letter from Jack Saari in support of the variance as requested was read for the record. After discussion and consideration, Steve Schierer made a motion, second by Michael Harris and unanimously carried, to approve the variance as requested with the following conditions: 1.) Point No. 1 as depicted on the drawing dated June 12, 2007 must be permanently attached to Lot 1, Pinke’s East Loon Lake Estates, 2.) Point No. 2 as depicted on the drawing dated June 12, 2007 must be permanently attached to Parcel 16- 000-02-0011-008, 3.) the area contained in Points 1 and 2 cannot be used when calculating impervious surface coverage for back lot development and 4.) a register surveyor’s drawing must be provided at the time of conveyance. Patrick E. Foley - Approved the variance as requested with a condition. (8:02 p.m.) Patrick E. Foley, Lot 32 Birchwood Shores, Pickerel Lake in Maine Township, requested a variance of 15’ from the required ordinary high water level setback of 100’ for the placement of an 1T by 16’ addition 85’ from the ordinary high water level. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Steve Schierer made a motion, second by Paul Larson and unanimously carried, to approve a variance of 15’ form the required ordinary high water level setback of 100’ for the placement of an IT by 16’ addition 85’ from the ordinary high water level with the condition that no more than 25% of the total lot area can be covered with impervious surfaces. It was noted that the proposed development does not obstruct view from the adjacent property, is on the backside of the existing dwelling away from the lake and does not require a side lot line variance. Marty Hanson - Denied. (8:08 p.m.) Marty Hanson, part of Government Lot 2 Section 33 of Lida Township by South Lake Lida, requested the following: I owned Lot 5 which has a house, well and septic system. Approximately two years ago I purchased the adjacent Lots 3 and 4 which contained a trailer and sewer system. I sold Lot 5; however, prior to the transfer being recorded I removed the trailer from the other lots. This combined the three lots as one. I am requesting a variance to split and sell Lot 5 separate from Lots 3 and 4. The audience was polled with Yvonne Schlichting speaking about the common lot line between Lots 5 and 6. After discussion and consideration, Michael Harris made a motion, second by Steve Schierer and unanimously carried, to deny the variance as requested as no adequate hardship unique to the property had been shown that would allow for the granting of the variance as requested. Granting the variance as requested would establish precedence that the Board of Adjustment does not wish to establish.
