Minnesota MINUTES OF THE MEETING OF THE OTTER TAIL COUNTY BOARD OF ADJUSTMENT June 10,1999 The Otter Tail County Board of Adjustment met Thursday, June 10, 1999, with the following persons-in attendance: John Everts Cecil Femling David Holmgren Randall Mann Mark Steuart Richard Sha George Hausske, Land and Resource Management Michelle Eldin, Assistant County Attorney Call to Order - Chairman John Everts called the meeting to order at 7:00 p.m. Minutes Approved - Hearing no corrections or additions the minutes of the June 3, 1999, meeting was approved as mailed. The following variance requests were heard: Ordean Honrud - Approved Ordean Honrud, Frazee, MN, requested a variance of 32’ from the required ordinary high water level setback of 100' and a variance of 3’ from the required 10’ setback for the construction of a 12’ by 12’ screen porch 68’ from the ordinary high water level and for the replacement of an existing attached garage 68’ from the ordinary high water level and 7’ from the septic tank. The property is described as part of the westerly 500’ of Lot 5 lying between lake and road. Section 19 of Hobart Township by Long Lake. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Randall Mann to approve the screen porch and the motion was seconded by Cecil Femling with the condition that it will be no closer to the lake than the existing structure. The variance for the garage replacement was approved but the septic system was denied because of the location, the motion was made from Randall Mann with the second motion being made by Mark Steuart. All requests were unanimously carried. Terry and Barbara Magnuson - Denied Terry and Barbara Magnuson, Moorhead, MN, requested a variance of 18’ from the required lot line setback of 65’ for the placement of an 8’ by 8’ water oriented accessory structure 47’ from the lot line. The property is described as Lot 3, Block 1, Haven Hills, Loon Lake in Dora Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Mark Steuart to deny the request as there was no hardship shown .there is plenty of land to move or rebuild , the second motion was made by Randall Mann. The Magnuson’s have 45 days to bring their structure to compliance. The motion was unanimously carried by all board members. May 5, 1999 Land and Resource Management Otter Tail County Courthouse Fergus Falls, MN 56537 The Variance Committee; We respectfully request that your committee grant us a variance allowing us to maintain the present location of our Water Oriented Accessory Structure. Our shed is an 8’ X 8’ structure that is currently located 47 feet from our lot line, and is the required greater than 20 feet from the lake. It is currently disguised by a large tree and lots of shrubbery. We found this to be the best location as we didn’t have to remove any landscape or level any ground. It does not obstruct any neighbor's view, or our view of that of our swimmable frontage. It was placed there after our misinterpretation of the Table of Shoreland Ordinance. We interpreted that lot line requirement to be that of general development (40feet), rather than that of recreational development (65 feet) which we interpreted to mean that of a resort, or campground, or such. After being notified of our mistake, we began reconsidering our location. After some careful consideration, we decided to apply for a variance, as both of our other two choices of locations, imposed hardship. Either location in compliance with your regulations would TOTALLY obstruct our view of our children, (ages 9 and 4) whether either swimming or fishing off the dock. Can you imagine any greater hardship than the “LOSS OF A CHILD?" We hope that your committee will give this matter as much careful consideration as we have and come to agree that the best possible location for our Water Oriented Accessory Structure is exactly where it is currently located, allowing us parents peace of mind for the safety of our children. We sincerely thank your committee for your time and consideration.
