a variance of 40’ from the required ordinary high water level setback of 200’ for the placement of a new home with attached
garage and decks 160’ from the ordinary high water level as depicted on the drawing submitted with the variance application. It
was noted that there is no other place on the property for the proposed development. The variance as approved does not directly
or indirectly grant any other variances for the proposed or future development

Thursday, December 8, 2016
The Otter Tail County Board of Adjustment met Thursday, December 8, 2016, with the following persons in
attendance:

Called to Order - Steve Schierer, Chair called the meeting of the Board of Adjustment to order at 6:30
p.m.
Minutes Approved - The Board of Adjustment approved the minutes of the November 10, 2016 meeting as
mailed.
The Board of Adjustment considered the following applications for variance:
James and Joy Boarini - Variance application approved as requested with conditions. (6:32 p.m.)
James and Joy Boarini, Lot 10 Block lJuniper Hills, Marion Lake in Dead Lake Township, requested the
following: Replace wood structured deck (walkway) with concrete, replace wood structured deck with concrete
patio, replace large wood structured deck with smaller wood structured sereen porch and stairway. Impervious
surface ratio is over allowed percentage, cuirent impeiwicus surface at 27.3%. Not increasing for project. The
audience was polled with no one speaking for or against the variance as requested. After discussion and
consideration, Steve Schierer made a motion, second by Thomas Lee and unanimously carried, to approve the
projects as proposed in the variance application dated October 26, 2016 with the condition that no more than 26%
of the total eligible lot area can be covered with impervious surfaces as determined and calculated by the Land
and Resource Management Department and with the condition that all of the proposed projects must be at least
75’ from the ordinary high water level. In part the proposed projects are maintenance to the existing structure,
none of the proposed projects will be closer to the ordinary high water level than the existing development and the
proposed project are similar to other development in this immediate area. The variance as approved does not
directly or indirectly grant any other variances for the proposed or future development.

the following: Request a variance to the 200’ structure setback requirements, setback for proposed attached
garage, new home and decks to be 160’ from ordinaiy high water level. Requesting variance of 40’. New
proposal is no closer to lake than the existing dwelling and decks. The.audience was polled with no one speaking
for or against the variance as requested. After discussion and consideration, Paul Larson made a motion, second
by Darren Newville and unanimously canied, to approve a variance of 40’ from the required ordinaiy high water
level setback of 200’ for the placement of a new home with attached garage and decks 160’ from the ordinary
high water level as depicted on the drawing submitted with the variance application. It was noted that there is no
other place on the property for the proposed development. The variance as approved does not directly or
indirectly grant any other variances for the proposed or future development.
