The variance approval was based on the applicant voluntarily agreeing to remove the existing 10’ by 12’ screen porch. Assessor and the MN DNR bk 072011-001 MINUTES OF THE MEETING OF THE OTTER TAIL COUNTY BOARD OF ADJUSTMENT Thursday, June 7, 2012 The Otter Tail County Board of Adjustment met Thursday, June 7, 2012, with the following persons in attendance; Michael Harris Randall Mann Mark Ronning, Land and Resource Management David Hauser, County Attorney Paul Larson Joe Maske Thomas Lee Steve Schierer Called to Order - Randall Mann, Chair called the meeting of the Board of Adjustment to order at 6;30 p.m. Minutes Approved - The Board of Adjustment approved the minutes of May 3, 2012 meeting as mailed. The Board of Adjustment considered the following applications for variance: Bryce Forsyth - Approved the variance as requested with a condition. (6:32 p.m.) Bryce Forsyth, Lot 4 Block 1 Shenandoah Ridge, Hoffman Lake in Dora Township, requested a variance of 108’ from the required ordinary high water level setback of 200’ for the construction of a two season porch and to replace a portion of an existing deck, on the lake side of house, 92’ from the ordinary high water level. Proposed two season porch will be 20’ wide by 12’ deep. Prior to 2009 the required structure setback was 100’. The audience was polled with no one speaking for or against the variance as requested. After consideration and discussion, Paul Larson made a motion, second by Steve Schierer and unanimously carried, to approve a variance of 108’ from the required ordinary high water level setback of 200’ for the construction of a 20’ wide by 12’ deep two season porch and for the replacement of a portion of an existing deck 92' from the ordinary high water level with the condition that the proposed porch can be no closer to the ordinary high water level than the existing deck. Set on existing foundation. Same footprint. Add upstairs. Height will go from 13.5’ to approximately 22’. Variance original unit granted September 3, 1998. The audience was polled with no one speaking for or against the variance as requested. After consideration and discussion, Steve Schierer made a motion, second by Joe Maske and unanimously carried, to approve the variance as requested in the application dated May 4, 2012 and as depicted on the drawing submitted with the application. The proposed project will occupy the same footprint as the existing structure. The variance as approved will provide the applicant with a reasonable use of his property. Jim and Robin Andrews - Denied. (6:45 p.m.) Jim and Robin Andrews, part of Government Lots 3 and 4, Section 1 and part of Government Lot 3 Section 12 of Dane Prairie Township by an unnamed lake, requested a variance of 2’ from the maximum allowable 20’ height of a non­ dwelling structure for the construction of a 40’ by 80’ structure having a height of 22’ and being located approximately 233’ from the ordinary high water level. The audience was polled with no one speaking for or against the variance as requested. Brad, the applicants’ contractor, appeared with the applicant at the public hearing. Letters from Gordon Fuchs and Neil Lindgren in support of the variance as requested were noted for the record. After consideration and discussion, Paul Larson made a motion, second by Michael Harris and unanimously carried, to deny the variance as requested as no adequate hardship/practical difficulty unique to the property had been shown that would allow for the granting of the variance as requested, the granting of the variance as requested would establish precedence that the Board does not wish to establish, the applicants can obtain a reasonable use of their property without the granting of the variance as requested and the applicants have adequate room and other alternatives available which would allow them to meet the requirements of the ordinance.
