Assessor and the MN DNR L R Official/Date bk 072011-001 MINUTES OF THE MEETING OF THE OTTER TAIL COUNTY BOARD OF ADJUSTMENT Thursday, August 2, 2012 The Otter Tail County Board of Adjustment met Thursday, August 2, 2012, with the following persons in attendance: Michael Harris Randall Mann Denise Gubrud, Land and Resource Management David Hauser, County Attorney Paul Larson Steve Schierer Thomas Lee Rick Wilson Called to Order - Randall Mann, Chair called the meeting of the Board of Adjustment to order at 6:30 p.m. Minutes Approved - The Board of Adjustment approved the minutes of July 5, 2012 meeting as mailed. The Board of Adjustment considered the following applications for variance: Wesley Beilke - Approved the variance application as requested. (6:30 p.m.) Wesley Beilke, LLC part of Government Lot 2, Section 7 of Dunn Township by Pelican Lake, requested the following; Proposing to add a 10’ by 14’ addition to the existing dwelling and raise the roof line 2' on the addition to match the current roof line. The proposed addition will be 4’ from lot line matching existing cabin and 49’ from water’s edge. The roof line extension will be 4T 6” to water’s edge. The required setback is 75’ to ordinary high water level and 10’ to lot line. Monte Prody represented the applicant at the public hearing. The audience was polled with no one speaking for or against the variance as requested. After consideration and discussion, Thomas Lee made a motion, seconded by Rick Wilson and carried with Paul Larson voting no, to approve a variance of 6’ from the required side lot line set back of 10’ and a variance of 33’ 6’ from the required ordinary high water level setback of 75’ for placement of the development as described in the variance application dated June 29, 2012 and as depicted on the drawing submitted with the application 4’ from the side lot line and 4T 6” from the ordinary high water level. The proposed development is to the rear of the existing structure and after completion of the proposed development less area will be covered with impervious surfaces. (6:42 p.m.) Joseph and Carol Jacubetz, Lot 15 Block 1 Silent Haven, West Silent Lake in Dora Township, requested the following: We’re requesting a variance to build a 14’ by 2T deck on the lakeside of our house. We have an arcadia door on that side with a 6’ drop outside it that we would like to utilize. The deck would be built within the 30’ setback area from the top of the bluff, but not into the bluff itself. Requesting a variance of 30’ from the bluff for a 0’ setback. The audience was polled with Gordy Jensen speaking for the variance as requested. Prior to the meeting, the applicants had submitted emails and a letter of support from the following; Gordy Jensen, Board Member - Silent Lakes Association, Craig and Diane Larson, Judy and Larry Olson, Dick Roller, and Rick and Nancy Vyskocil. After consideration and discussion, Steve Schierer made a motion, second by Michael Harris and carried with Thomas Lee and Rick Wilson voting no, to deny the variance as requested as no adequate hardship/practical difficulty had been shown that would allow for the granting of the variance as requested and noting that the variance as granted on October 6, 2005 provides the applicants with a reasonable use of their property. Penelope R. Moos - Approved the variance application as requested with condition. (7:00 p.m.) Penelope R. Moos, Lots 71 and 72 Nedberg- Nye Survey Lots of Government Lots 1,2 and 3, Section 1 of Edna Township by Devils Lake, requested a variance of 47’ from the required ordinary high water level setback of 75’ for the purpose of raising an existing dwelling which is located 28’ from the ordinary high water level. Harvey, the applicant’s husband appeared with the applicant. The audience was polled with no one speaking for or against the variance as requested. After consideration and discussion, Randall Mann made a motion, seconded by Thomas Lee and unanimously carried, to approve a variance of 47’ from the required ordinary high water level setback of 75’ for the purpose of raising an existing dwelling which is located 28’ from the ordinary high water level with the condition that the required 3’ vertical separation (between water level and lowest floor) must be maintained. The variance as approved is consistent with past actions of the board.SCANNED APPLICATION FOR A VARIANCE AT 29350 SILENT HAVEN DR. We're requesting a variance to build a 14' x 21' deck on the lakeside of our house. The deck would be built by a local contractor. We have an arcadia door on that side with a 6' drop outside it that we would like to utilize. Also it is a safety hazard now when the door is open for ventilation. The deck would be built within the 30' setback area from the top of the bluff,but not into the bluff itself. There is native vegetation and ground cover plants covering the entire bluff plus trees. There was a similar sized deck in the same location (see photo) without negative impact on the bluff. The bluff area was calculated by Inspector Kyle Westergard on his site visit using a slope meter. We have polled the neighbors and received only positive feedback. Our next door neighbor is board member of the Silent Lakes Homeowners Association and he supports our plans, (his letter included) We really love this property and feel this would greatly enhance our enjoyment of it and we feel this request is in harmony with the purpose of the ordinance as it will have no negative effect on the bluff or lake.
