It was noted that the distance of the proposed addition from the side lot line averages over 10’. The noted hardship is when the original structure was constructed by the previous owner it was not set parallel with the side lot line. Time: ■ (2. After consideration, nnotion was made by George Walter, seconded by Craig Anderson and unanimously carried, to deny the variance as requested as no adequate hardship had been shown and a reasonable alternative does exist that will not require the granting of any variances. It was noted that the applicant’s lot is not a substandard lot. Daniel M. and Sheila L. Saurer Daniel M. and Sheila L. Saurer, Rothsay, MN, requested a variance of approximately 80’ from the required ordinary high water level setback of 200’ for the construction of a dwelling approximately 120’ from the ordinary high water level. The property is described as part of Government Lot 7, Section 9 of Sverdrup Township by Anna Lake. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Cecil Femling, seconded by Robert Schwartz and unanimously carried, to approve a variance of approximately 60’ from the required ordinary high water level setback of 200’ for the construction of a dwelling approximately 140’ from the ordinary high water level. Hardship is the precedence established on the lot to the west with a setback of approximately 120’ and the vacant lot to the east. The Board of Adjustment considers this variance a reasonable compromise in working towards the required 200’ setback. Larry and Judy Olson - Approved I Larry and Judy Olson, Fargo, ND, requested a variance of approximately 1’ from the required side lot line setback of 10’ for an 18’ by 32’ addition to an existing dwelling approximately 9’ from the side lot line at its closest point. The property is described as Lot 13, Block 1, Silent Haven, West Silent Lake in Dora Township. The audience was polled with no one speaking for or against the request. A letter from Gordon and Judith Jensen in favor of the variance request was read for the record. After consideration, motion was made by Cecil Femling, seconded by Craig Anderson and unanimously carried, to approve a variance of approximately T from the required side lot line setback of 10’ for an 18’ by 32’ addition to an existing dwelling approximately 9’ from the side lot line at its closest point. The property is described as Lot 6, Block 1, Deer Trail Estates, Star Lake in Star Lake Township. The Board of Adjustment acknowledged the applicant’s request to withdraw their variance application. John D. Gordon - Withdrawn John D. Gordon, Fargo, ND, requested a variance of approximately 29’ from the required ordinary high water level setback of 100’ for the construction of a dwelling approximately 71’ from the ordinary high water level. John Gunkelman, Contractor, appeared along with the applicant at the public hearing. Letters from Calvin and Dorothy Skogen and Roger Boe in favor of the variance request were read for the record. After consideration, a motion was made by Cecil Femling to approve the use of the string line. After additional discussion and consideration the previous motion was withdrawn and the applicant requested permission to withdraw his variance request. The Board of Adjustment accepted the applicant’s request to withdraw his variance application noting that other alternatives do exist and that the applicant’s lot is not a substandard lot. Lynne K. Ebner - Approved Lynne K. Ebner, Fargo, ND, requested a variance of approximately 10’ from the required ordinary high water level setback of 75’ for a 10’ by 24’ addition to the west side of the existing structure and for the addition of a second story approximately 65’ from the ordinary high water level. The property is described as Lot 16 Haugen’s Knollwood and Lot 1, Block 1, Haugen’s Knollwood First Addition, Pelican Lake in Dunn Township. John Gunkelman, Contractor, and the Honorable Judge Michael Kirk appeared along with the applicant at the public hearing. The audience was polled with no one speaking for or against the request. After consideration, motion was made by John Everts, seconded by Craig Anderson and unanimously carried, to approve a variance of approximately 10’ from the required ordinary high water level setback of 75’ for a 10’ by 24’ addition to the west side of the existing structure and for the addition of a second story approximately 65’ from the ordinary high water level. It was noted that the proposed additions will be no closer to the ordinary high water level than the existing structure and the applicant is maintaining the 10’ side lot line setback. Marcia Munson - Approved Marcia Munson, North Mankato, MN, requested a variance of approximately 78’ from the required ordinary high water level setback of 100’ and a variance of approximately 28’ from the required shore impact zone setback of 50’ for the replacement of an existing 10’ by 20’ deck with new decking, having a proper safety rail, and for the construction of a 6’ by 24’ deck, having a proper safety rail, to the side entry of the existing dwelling. The existing deck and the 6’ by 24’ deck will be connected together and the decks will be approximately 22’ from the ordinary high water level. The property is described as Lot 6, Block 2, Engstrom’s Beach, Big McDonald Lake in Edna Township. The audience was polled with no one speaking for or against the request. A letter from Dean and Nancy Slotten and a letter from Keith and Lynne Brokke in favor of the variance request were read for the record. After consideration, motion was made by Craig Anderson, seconded by Cecil Femling and unanimously carried, to approve a variance of approximately 78’ from the required ordinary high water level setback of 100’ and a variance of approximately 28’ from the required shore impact zone setback of 50’ for the replacement of an existing 10’ by 20’ deck with new decking, having a proper safety rail, and for the construction of a 6’ by 24’ deck, having a proper safety rail, to the side entry of the existing dwelling with the condition that the proposed deck additions will be considered the applicant’s water - oriented accessory structure and with the condition that the amount of deck in front of the dwelling cannot exceed 260 square feet.
