VARIANCE REQUESTED IS:
Variance Requested
This application request that I be allowed to build at approximately 72 feet from the higji water
mark which would be in line with the two neighbors cabins to the west. This will allow me to
build near tlie nature ridge that runs east to west on my lot at an elevation that should allow an
approved sewer system to be built without a mound. This would save me the expense of adding
jBU. At the 100 feet setback line I would have an obstructed view to the west and would be
viewing the back of the neighbors cabins. The 100 feet setback would also require that I add 3 to
4 feet of fill to pro^de a level building site with a view of the lake. The shore line management
ordinance does allow a string line setback but that would be approximately 15 ft behind the ridge
on the east side of the proposed building area. See the attached grid plot for reference.
In order to properly evaluate the situation, please provide as much supplementary information as possible, such as: maps, plans,
information about surrounding property, etc. APPLICANT SHALL BE PRESENT AT THE SCHEDULED HEARING.
I understand that I have applied for a variance from the requirements of the Shoreiand Management Ordinance of Otter Tall
County.

MOTION AS FOLLOV/S:
Time:19
Notion was made by Craig Anderson, seconded by John Everts and unanimously carried, to
permit the applicant to apply a string line from.the old cottage to the vest of the
appliant's lot to a point 100' back from the ordinary high water level and 10' in on Lot
2, Block 1, Mabuhay, with the front center of the proposed structure on the string line at
the center of the lot and at the center of the string line and to permit the applicant to
square up the structure with the lake. Allowing the applicant to square up the structure
with the lake means that the east side of the structure will exceed the string line by a
few feet and the vest side of the structure will be behind the string line by a few feet.

Donald H. Luhning - Withdrawn
Donald W. Luhning, Battle Lake, MN, requested a variance to subdivide a parcel of less
than 2.5 acres. The parcel would have approximately 40,200 square feet of area and
approximately 160' of water frontage, approximately 150' of lot width, approximately 320'
of depth on the west side of the lot, approximately 370' of depth on the east side of the
lot and 68' of width at the rear of the lot. The property is described as part of
Government Lot 2 and part of the SW 1/4 NE 1/4 of Section 5 in Girard Township on Ethel
Lake. Due to a possible conflict of interest Craig Anderson removed himself from this
variance hearing. The audience was polled with no one speaking for or against the
requested. After consideration, motion was made by Carl Johnson to deny the variance as
request as no adequate hardship had been shown, additional land is available for
development and that the proper course of action would be to plat the property. No action
was taken on this motion and after additional discussion the applicant decided to withdraw
his variance request.
Terry A. Hauger - Approved
Terry A. Hauger, Rothsay, MN, requested a variance of approximately 28' from the required
ordinary high water level setback of 100' for the construction of a dwelling 72' from the
ordinary high water level. The property is described as Lot 1, Block 1, Mabuhay, East
Spirit Lake in Dora Township. A letter from Jean Fruehauf opposing the granting of the
variance request was read for the record. The audience was polled with no one speaking
for or against the request. After consideration, motion was made by Craig Anderson,
seconded by John Everts and unanimously carried, to permit the applicant to apply a string
line from the old cottage to the west of the appliant's lot to a point 100' back from the
ordinary high water level and 10' in on Lot 2, Block 1, Mabuhay, with the front center of
the proposed structure on the string line at the center of the lot and at the center of
the string line and to permit the applicant to square up the structure with the lake.
Allowing the applicant to sqbare up the structure with the lake means that the east side
of the structure will exceed the string line by a few feet and the west side of the
structure will be behind the string line by a few feet.
Charles Cavanagh - Approved
Charles Cavanagh, Perham, MN, requested a variance to purchase a parcel of land
approximately 16' by 2' 6" from the adjacent property owner (Phillip Petterson); a
variance to construct a garage 6' towards the road and a variance of 9' from the required
side lot line setback 10'. The applicant will be complying with the terms of the variance
previously approved on September 2nd, 1993. The property is described as part of
Government Lot 1, Section 26 of Gorman Township on Little Pine Lake. The audience was
polled with no one speaking for or against the request. After consideration, motion was
made by George Walter, seconded by Craig Anderson and unanimously carried, to approve the
amended request as presented by Mr. Cavanagh and to grant a 1' 6* variance from the
required side lot line setback of 10'.
Erv. J. Wegscheid - Denied
Erv. J. Wegscheid, Perham, MN, requested a variance of 49' from the required ordinary high
water level setback of 100' for the enclosure of an existing deck with a screened in porch
51' from the ordinary high water level. The screened porch would be a second story. The
property is described as Lot 6, Gulliver's Travels, Paul Lake in Edna Township. Steve
Detwiller represented the applicant at the hearing. The audience was polled with no one
speaking for or against the request. After consideration, motion was made by Craig
Anderson, seconded by Cecil Femling and unanimously carried, to deny the variance as
requested as no adequate hardship had been shown and other alternatives exist for the
applicant.

Robert and Julie Pochardt, St. Cloud, MN, requested a variance of 84' from the required
ordinary high water level setback of 100' (Creek) for the construction of a garage and for
a future addition to the cabin 16' from the ordinary high water level of the creek and a
variance of 3' from the required ordinary high water level setback of 75' for an addition
to an existing structure 72' from the ordinary high water level. The property is
described as the SELY 25' of Lot 8, all Lot 9 and vacated road adjacent. Inlet Beach, Lake
Lida in Lida Township. A letter from Amos Anderson in favor of the variance request was
read for the record. The audience was polled with no one speaking for or against the
request. After consideration, motion was made by George Walter, seconded by Craig
Anderson and unanimously carried, to approve a variance of 84' from the required ordinary

noted that the applicant's proposed locations are the best and most reasonable locations
for the proposed additions.

Dear Sir:
Thank you for your letter of September 16, a copy of which

I do have a several valid objections the issuing of variance
to the required 100 foot set back which would allow for the
constuction of a building only 72 feet from the exisiting
south shore line of Spirit Lake.
Our home was constructed on the cite of an old cabin
that had been in our family for over sixty years.
cabin was torn down and a modern home built on location of
that old cabin, S4 feet from the shore line of the lake.

The meander line of Spirit Lake has fluxuated as much as

has been in the possession of my family,
the variance requested would only encouraging the building
of structures closer and closer to the shore line of Spirit

4. The natural elevation of the land east of our property
and continuing along the south shoreline of Spirit Lake is
such that to most conveniently and economically locate a
structure, disregard for the 100 foot set back could be a
prime reason for seeking the variance,
the beauty of the required 100 foot expanse of

This would diminish
5.As the 1ots to the east of the Hanger property are
developed, additional requests for variances may be made.
If such variances are granted , it could result in a
situation where the structures would be placed at various
set backs debending on the natural elevation of the land and
the ease of construction .
