Time:MDate of hearing: ____ MOTION AS FOLLOWS: 19 Motion was made by John Everts, seconded by Craig Anderson and unanimously carried, to approve a variance of 15' from the required top of bluff setback of 30' and a variance of 14' from the required ordinary high water level setback of 100' for the construction of a dwelling onto an existing basement foundation 15' from the top of the bluff and 86' from the ordinary high water level with the condition that any excavation in the bluff area will be stabilized immediately by sodding the affected area. It was noted that there is an existing basement foundation that was permitted in 1980. A hardship would be created if the applicant was required to move back. The granting of the variance results in the least amount of impact in the area. Erickson, Wadena, MN, requested a variance ol 62*75* irom the required ordinary high water level setback of 150' for a proposed 4'7*' by 11* 3" entry on an existing slab 87.25 feet from the ordinary high water level, a variance of 82.5' from the required ordinary high water level setback of 150', a variance of 7.5' from the required shore impact zone setback of 75' and a variance of 5' from the required side lot line setback of 10' for the modification of an existing roof located 5' from the side lot line and 67.5' from the ordinary high water level. The property is described as Lot 3 and the East 10' of Lot 4, Hilcoske's First Addition to River Ranch Beach, Otter Tail River in Otter Tail Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Carl Johnson, seconded by Randall Mann and unanimously carried, to approve the request as presented with the modification that will permit the applicant to fill the 6' 6* by 10' slab area adjacent to the storage portion of the structure on the lake side. It was noted that the modifications to the applicant's request will be no closer to the side lot line or the ordinary high water level than the existing structure. Daniel and Marilyn Possin - Denied Daniel and Marilyn Possin, Big Lake, MN, requested a variance of 50' from the required ordinary high water level setback of 200' for the construction of a structure 150' from the ordinary high water level. The property is described as part of Government Lots 2, 3, 6 and 7, Section 19 of Leaf Mountain Township on Lingenshoe Lake. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Carl Johnson, seconded by Randall Mann to approve the variance as requested as it is the best location for the proposed structure. The motion failed with Cecil Femling, Craig Anderson and George Walter voting no and with John Everts abstaining. After additional consideration, motion was made by Craig Anderson, seconded by Cecil Femling to deny the variance as requested as no adequate hardship had been shown. The motion carried with Carl Johnson voting no, Randall Mann not voting and with John Everts abstaining. It was noted that the granting of this variance request would have established a precedent. It was also noted other alternatives should exist due to the large parcel owned by the applicants. Richard E. Ross - Approved Richard E.
