and offered the gift to the Otter Tail County Solid Waste Department. Motion by Lee, seconded Windels
and unanimously carried to accept the software package and the acceptance letter to Adobe Systems as
presented by Ms. Tysdal.
Planning Commission Recommendations
Motion by Lee, seconded Windels and unanimously carried to approve the following Conditional Use
Application with conditions as recommended by the Planning Commission except to change condition 1) to
read “three seasons” rather than “one season” to allow for sufficient time to accurately assess the situation:

and Highway Engineer, Rick West, prior to implementation, 4) there will be no change to the existing road
right-of-way for County Highway #33 and, 5) the clearcutting of onsite vegetation is prohibited.

Fecal Coniform Testing
Land & Resource seasonal staff biologist, George Hausske, explained, at the request of the board, the
benefits of analyzing water samples for fecal colliform. The Land & Resource Administrator reported that
the water testing has been budgeted under the water plan grant funds, however, fecal colliform testing was
not budgeted for 1996. Motion by Lee, seconded Windels and unanimously carried to proceed with fecal
colliform testing at the 68 sites designated for water testing (water flowing out of the county) in addition to
the current nitrate and phosphorus testing.

Meeting of the Otter Tail County Planning Commission was held on June 5,
1996, at 7:00 P.M. in the Commissioner's Room, Court House, Fergus Falls,
Minnesota.
Roll Call;

Frank Lachowitzer, Bert Olson, Robert .Ronningen, Robert Schwartz, David
Trites and Leona Zimmerman.

Barb Hanson represented the County Attorney's Office and Bill Kalar
represented the Land & Resource Management Office.
Minutes of June 5. 1996;
A motion by Estes, second by Zimmerman to approved the May 1, 1996 minutes
as mailed. All members voted in favor.
Neil & Julie Wothe - Approved With Conditions;
A Conditional Use Application to open a r small shop retailing some of my
handcrafted jewelry and a few other handcrafted items. The hours would be
10:00 A.M. to 5:00 P.M.; Wednesdays, Fridays and Saturdays. People may call
me for appointments if they wish to seesme another time. It would be better
for me to be approved for a 7 day opening in the event I'd want to be open
more in the future. The 3 day opening is. my plan for this season or by
appointment. The property is described as Oak Manor Shores, Lots 29 & 30 of
Section 2 of Dora Township; Loon Lake (56-523), RD.
Neil & Julie Wothe represented the Application.
Courtney Neros expressed concerns with increased amount of traffic and the
safety of the children in the area. He also presented a petition and a copy
of a covenant which contained a provision prohibiting commercial uses in
this subdivision.
Sherry Rohr expressed her opposition to the business.

A motion by Trites, second by Lachowitzer to approve the application with
the following provisions: 1) The business may be open 7 days a week from
Memorial Day to Labor Day for one season. Business to be reviewed after
Labor Day. 2) Must maintain a roster of visitors. Visitors must not exceed
an average of 10 people per day. 3) If the business-exceeds the
aforementioned average and complainants are received by the Land & Resource
Management Office, the Application will be reviewed by the Planning
Commission with proper notification of the meeting provided.

Lyle Tweeton represented the Application.
A motion by Johnson, second by Olson to approve the Application as
presented. A reference was made by Zimmerman to the boat storage business
being conducted on this property. Mr. Tweeton must apply for a Conditional
Use Permit from the Planning Commission for approval to continue to operate
this business. This Application should be presented to Land & Resource
Management Office as soon as possible.

Vernon R. Strong - Approved With Conditions:
A Conditional Use Application to build a retaining wall approxin^ately 85'
long by 40" high being 17' from the water. The property is described as

Vernon Strong represented the Application.
A motion by Estes, second by Bergerud to approve with the following
provisions: 1) Rock must be placed (3 to 1 slope) at the base of the
retaining wall. 2) No more than 3 courses of block to be exposed. Also, the
retaining wall will be 48" in height and will be 13' from the water on the
West side and will be 6' from the water on the East side with the wall being
on the property line instead of as previously requested.

Motion by Windels, seconded Lee and unanimously carried to approve the sale of one used 1952
Pioneer 24" x 40' Conveyor (Gravel Screen) to the highest bidder, Gutzmer Construction of Hankinson,
ND, in the amount of $3,605.
CSAH 35, Right-Of-Way Acquisition
The Highway Engineer reported that a viewing of property in the eminent domain acquisition procedures
for the CSAH 35 project is required. The board set the time and date for viewing the property at
1:30 p.m., May 21, 1996.
Area I - Roadside Mowing Contract
Motion by Lindquist, seconded Lee and unanimously carried to approve the Chair’s signature to execute
the 1996-97 Roadside Mowing Contract for Area I with Duane Larson in the amount of $13,739.70.
Pedal De Ponds Bicycle Tour
Motion by Stone, seconded Windels and unanimously carried to approve of the 4th Annual Pedal De
Ponds Bicycle Tour contingent upon approval of the Sheriffs Department and that Otter Tail County is
not subject to liability relative to the Tour. The Highway Engineer will request verification of insurance
from the tour sponsors.
Upgrade of Traffic Signal - S.A.P. 56-601-35
Motion by Stone, seconded Windels and unanimously carried to approve payment to the City of
Fergus Falls, in the amount of $16,625, for replacement of traffic control signals at the intersection of
Cascade and Lincoln during a Downtown Redevelopment Project. The agreement was executed in
May, 1991, and payment authorized per Purchase Order No. 56294.
Sale of Snowplow Equipment
Rick West, Highway Engineer, requested the sale of two (2) Viking Brand Snowplows, three (3) Viking
Brand Snowplow wings, and one (1) mounting for the Viking plow and wing. Motion by Lindquist,
seconded Stone and unanimously carried to approve the sale of the above snowplow equipment.
Salary Policy - Temporary Positions
Motion by Lindquist, seconded Lee and unanimously carried to set the starting rate of pay for temporary
positions at the hourly entry level of the established position range.
Home Operated Business
*?:; Julie Wolhe appeared before the board regarding a home operated jewelry business she wishes to open
I , on Memorial Day weekend. Commissioner Lee explained that Ms. Wolhe did not realize that she
\f needed to apply for a Conditional Use Permit to meet the law to notify the neighbors in the area and
asked about the possibility of issuing a temporary permit. The County Attorney was not aware of
authority to issue a temporary permit.
