(8:12 p.m.) After discussion and consideration, Michael Harris made a motion, second by Thomas Lee and unanimously carried, to approve the variance as requested in the variance application dated October 20, 2013 and as depicted on. the drawing submitted with the application (date October 24, 2013), with the condition that the two existing sheds located near the,water and the lot line must be removed from their current location and can be replaced with one storage structure that does not exceed the total area of the two older sheds and with the condition that the new storage shed must be placed at least 10’ from the lot line and no closer to the ordinary high water level than the front (lakeside) of the proposed new dwelling. After discussion and consideration, Thomas Lee made a motion, second by Ward Uggerud and unanimously carried, to approve the variances for the drain field as requested noting that this is perhaps the best and only location and to approve the repairs to the existing non-conforming structure (boathouse) with the condition that it cannot exceed 8’ 7” in height. The change in the overall height was a modification suggested by the applicant in response to the Thorstad comments. Tony Renner - Approved the variance application as requested with a condition. (8:02 p.m.) Tony Renner, Lot 12 Plainview Sandy Beach First Addition, Little McDonald Lake in Edna Township, requested the following: requesting a variance of 8’ into the road right-of-way for replacement of a holding tank. Required setback is 10’ from road right-of-way. New tank will be 18’ from traveled surface. This location will resolve sewage system abatement. The audience was polled with no one speaking for or against the variance as requested. An email from Plainview Corporation addressing the applicant’s request was read for the record. After discussion and consideration, Paul Larson made a motion, second by Michael Harris and unanimously carried, to approve the variance as requested in the variance application dated October 23, 2013 noting the requirements of the Plainview Corporation and with the condition that a letter of approval must be obtained from Edna Township. The applicant noted that he has communicated with the Plainview Corporation and his working with them. It was also noted that there are no other available sites for the holding tank. Marjorie Jones - Denied. (8:07 p.m.) Marjorie Jones, part of Government Lot 2, Section 20 of Dunn Township by Lake Lizzie, requested the following: Existing dwelling is 85’ from ordinary high water line with permission from variance dated December 18, 2000. Due to terrain hardship and topography and is located in the bluff. We are planning to remove existing park model, deck and utility shed and replace with a new permanent residence 112’ from the ordinary high water line, which will be in the bluff. Current ordinance states that dwellings must be 30’ from top of bluff, with this law; we are not able to build any structure on either two of these lots. Access will be acquired from top of bluff. We would be abiding by all other ordinances other than top of bluff. TJ Haugrud, Contractor represented the applicant at the public hearing. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Steve Schierer made a motion, second by Thomas Lee and unanimously carried, to deny the variance as requested as no adequate hardship/practical difficultly had been shown that would allow for the granting of the variance as requested, a previously granted variance does provide the applicant with a reasonable use of the property and granting this variance would establish precedence, which the board does not wish to establish at this time. Sanders - Approved the variance application with conditions. (8:12 p.m.) Gail Sanders, Lots 8 and 9 Delaney’s Beach, Hoffman Lake in Dora Township, requested the following: Due to substandard size lot, we are requesting a variance to place a new dwelling and detached garage which would be closer to ordinary high water level than current requirements. The closest point of the dwelling will be approximately 34’ from ordinary high water level and the closest point on the garage will be approximately 50’ from ordinary high water level. Structures will be in line with neighboring properties. Required setback is 200’ from the ordinary high water level. Al, the proposed buyer, represented the applicant at the public hearing. The audience was polled with no one speaking for or against the variance as requested.
