After consideration, Steve Schierer made a motion, second by Michael Harris and unanimously carried, to approve the proposed
development (dwelling and porch) being no closer to the ordinary high water level than the existing building line with the condition
that if the building line is within the shore impact zone than the proposed porch must be the same size as the existing porch which
is 8’ 2” by 27’ 10” instead of the requested 8’ 2” by 37’ 10”. It should be understood that the variance as approved does not

Jeffrey and Marcia Stavenger, Lot 1 Martee Beach, part of Outlot D Blanche Lake Beach and part of Government Lot 1,
Section 12 of Everts Township by Blanche Lake, requested the following: Structure setback of existing building does not
meet current setback requirements of the ordinance. Requirement is 100' from ordinary high water level, structure is at 65’
11" from ordinary high water level. Request variance of 35’ {+/-) in order to make the following repairs/remodel: 1.)
Remove and repair existing foundation under a portion of the structure (14’ by 52’), due to mold conditions with the
structures frame and foundations, 2.)Change the existing V/z-story addition to a full 2-story addition (14’ by 52’), and 3.)
Remove and restructure the existing roof of the structure to change the pitch and make the roof higher. Also, extend the
roofline to create 2 covered patio areas (existing patios). Appearing with the applicants was Clay Dietrich. Contractor. The
audience was polled with Jill Langren expressing concerns with protecting the lake and with the establishment of
precedence. After discussion and consideration, Steve Schierer made a motion, second by Randall Mann and
unanimously carried, to approve the proposed development being no closer to the ordinary high water level than what
would be permit by the existing building line with the condition that no more than 25% of the total eligible lot area can be
covered with impervious surfaces. The existing building line is defined as the line that would be established from the
corner of the residential structure closest to the lot line on the right side of the applicants’ property to the corner of the
residential structure closest to the lot line on the left side of the applicants’ property. It was noted that the variance as
approved does not directly or indirectly grant any other variances for the proposed development.

William A. and Joyce E. Nerdahl, Lot 2 Delaney’s Beach, Hoffman Lake in Dora Township, requested a variance of 60’
from the required ordinary high water level setback of 100’ and a variance of 10’ from the required shore impact zone
setback of 50' for the placement of a 14’ by 66’ dwelling with an attached 8’ 2” by 37’ 10" porch 40’ from the ordinary high
water level. Mike Conlon appeared with the applicant at the public hearing. The audience was polled with no one speaking
for or against the variance as requested. Letters in support of the variance as requested from the following individuals
were read for the record: Bryan Olson, Jim and Mary Ann Kath, Lorna and Arlin Jacobson, Ed Kuklock, Mike Stender, Jon
Ittel and Tim and Cathy Aim. After consideration, Steve Schierer made a motion, second by Michael Harris and
unanimously carried, to approve the proposed development (dwelling and porch) being no closer to the ordinary high water
level than the existing building line with the condition that if the building line is within the shore impact zone than the

must be the same size as the existing porch which is 8’ 2" by 27’ 10” instead of the requested 8’ 2” by 37’ 10".

The Otter Tail County Board of Adjustment met Thursday, February 5, 2009, with the following persons in attendance:

Called to Order - Randall Mann Chair called the meeting of the Board of Adjustment to order at 2:00 p.m.
Minutes Approved - The Board of Adjustment approved the minutes of the December 3, 2008 meeting as mailed.
Chair and Vice Chair Selection -
Randall Mann, Chair, then called for nominations for Chair and Vice Chair of the 2009 Board of Adjustment. Steve
Schierer made a motion, second by Carl Zick and unanimously carried, to direct the Secretary of the Board of Adjustment
to cast a unanimous ballot for Randall Mann as Chair and for Steve Schierer as Vice Chair of the 2009 Board of
Adjustment.
The Board of Adjustment considered the foiiowing appiications for variance:
Mark and Sandy Tiiiwick - Approved the variance appiication as requested. (2:00 p.m.)
Mark and Sandy Tiiiwick, Lot 4 Block 1 Stalker View Acres, Stalker Lake in Tordenskjold Township, requested a variance
to have Lot 4 Block 1 of Stalker View Acres declared buildable for single family residential purpose. The lot has 39,282
square feet and the required square footage is 40,000 square feet. The plat was created/recorded on December 17, 1975.
The applicants were represented by Maury Foss. The audience was polled with no one speaking for or against the
variance as requested. After discussion and consideration, Steve Schierer made a motion, second by Carl Zick and
unanimously carried, to declared Lot 4 Block 1 Stalker View acres buildable for single family residential purpose. It was
noted that the variance as approved does not directly or indirectly grant any other variances for future development.
Deborah and John Garner - Withdrawn.
Deborah and John Garner, part of Government Lot 7, Section 27 of Rush Lake Township by Round Lake, requested the
following: This application for variance is an amendment to the variance request approved at the 10/2/08 Board of
Adjustment meeting. It is still our intention to demolish and remove the existent cabin and garage in Area “A” with no
variances required for the placement of a 58’ by 28’ modular, with an attached 10’ wide enclosed breezeway along the
west side of said modular. After another survey was completed delineating the Rush Lake Township cart way the
approved variance requests are now only partially accurate for placement of the garage in Area “C”. The garage will still
be placed in the same area as initially proposed, but will now be downsized to 20’ by 40’. We will still accept the approved
3’ variance from the 10' minimum structure setback on the east lot line, the 13’ variance from the 20’ setback from the cart
way on the Northwest Corner of the garage, and the 12’ at point “D” (on plan); however, we’ve adjusted the other requests
as follows: (1) a 20’ variance from the 20’ setback from the cart way on the Southwest Corner of the garage, and (2) a
“varying” variance from the 20’ minimum setback of the cart way for the North side of the garage, ranging from 12’ at point
“D” (on plan) down to 6’ at point “E” (on plan). Also note the existent road (in yellow) within the designated cart vyay. Prior
to the scheduled hearing a letter had been received from Katrian I. Wass, Attorney for Deborah and John Garner,
requesting that their application be removed from the Board of Adjustment agenda for the February 5, 2009 meeting as
Deborah and John Garner intend to submit an amended application.

Anne Eidsvold - Approved the variance as requested. (8:00 p.m.)
Anne Eidsvold, Lot 2 Sunset Shores, Clitherall Lake in Nidaros Township, requested the following; Current setback
on existing cabin is 97’ from the ordinary high water level. We would like to add an addition to the north and keep
lakeside even at 97’ from the ordinary high water level. Also, install new septic system and well. Required setback
from the ordinary high water level is 100’. The audience was polled with no one speaking for or against the variance
as requested. Richard Hochstein, Contractor appeared with the applicant at the public hearing. After consideration,
Randall Mann made a motion, second by Steve Schierer and unanimously carried, to approve the proposed
development as described in the variance application dated August 9, 2008 and as depicted on the drawing submitted
with the variance application. It was noted that the proposed development will be no closer to the ordinary high water
level than the existing cabin.
Randy and Sara Garrett - Approved the variance as requested with a Condition. (8:05 p.m.)
Randy and Sara Garrett, Lot 5 Hoffman’s Beach, Big McDonald Lake in Dora Township, requested a variance of 61.5’
from the required ordinary high water level setback of 100’, a variance of 11.5’ from the required shore impact zone
setback of 50’ and a variance of T from the required side lot line setback of 10’ for the addition of a second story to an
existing 20’ by 32’ dwelling 38.5’ from the ordinary high water level and 9’ from each side lot line. The audience was
polled with no one speaking for or against the variance as requested. After consideration, Paul Larson made a motion,
second by Michael Harris and unanimously carried, to approve a variance of 61.5’ from the required ordinary high
water level setback of 100’, a variance of 11.5’ from the required shore impact zone setback of 50’ and a variance of
T from the required side lot line setback of 10’ for the addition of a second story to an existing 20’ by 32’ dwelling
38.5’ from the ordinary high water level and 9’ from each side lot line with the condition that no more than 25% of the
total eligible lot area can be covered with impervious surfaces. The practical difficulty/hardship is a substandard lot of
record. It was also noted that the proposed development does not alter the general characteristics of the
neighborhood.
Kenneth Hanson - Approved the variance as requested with a condition. (8:07 p.m.)
Kenneth Hanson, part of Lot 4 and all of Lot 5 Northland Beach First Addition, Pelican Lake in Dunn Township,
requested a variance of 25’ from the required ordinary high water level setback of 75’ for the purpose of repairing and
renovating an existing three season porch located approximately 50’ from the ordinary high water level. An email from
Dave Currier in support of the variance as requested was read for the record. The audience was polled with no one
speaking for or against the variance as requested. A letter from Dave Haarstad in support of the variance as
requested was read for the record. An email from Dave Currier in support of the variance as requested was also read
for the record. After consideration, Steve Schierer made a motion, second by Les Estes and unanimously carried, to
approve a variance of 25’ from the required ordmary high water level setback of 75’ for the purpose of repairing and
renovating an existing three season porch located approximately 50’ from the ordinary high water level with the
condition that no more than 25% of the total eligible lot area can be covered with impervious surfaces. The Board .
noted that the applicant’s request is normal maintenance.
