The Board of Adjustment considered the following applications for variance: Bryce Forsyth - Approved the variance as requested with a condition. (6:32 p.m.) Bryce Forsyth, Lot 4 Block 1 Shenandoah Ridge, Hoffman Lake in Dora Township, requested a variance of 108’ from the required ordinary high water level setback of 200' for the construction of a two season porch and to replace a portion of an existing deck, on the lake side of house, 92’ from the ordinary high water level. Proposed two season porch will be 20’ wide by 12’ deep. Prior to 2009 the required structure setback was 100’. The audience was polled with no one speaking for or against the variance as requested. After consideration and discussion, Paul Larson made a motion, second by Steve Schierer and unanimously carried, to approve a variance of 108’ from the required ordinary high water level setback of 200’ for the construction of a 20’ wide by 12’ deep two season porch and for the replacement of a portion of an existing deck 92’ from the ordinary high water level with the condition that the proposed porch can be no closer to the ordinary high water level than the existing deck. The variance approval was based on the applicant voluntarily agreeing to remove the existing 10’ by 12’ screen porch. Richard Dombeck - Approved the variance as requested. (6:40 p.m.) Richard Dombeck, Lot 4 Silent Point, West Silent Lake in Dora Township, requested the following; Replace 14' by 30’ modular unit with same size 14' by 30' modular pre-fab unit. Set on existing foundation. Same footprint. Add upstairs. Height will go from 13.5’ to approximately 22’. Variance original unit granted September 3, 1998. The audience was polled with no one speaking for or against the variance as requested. After consideration and discussion, Steve Schierer made a motion, second by Joe Maske and unanimously carried, to approve the variance as requested in the application dated May 4, 2012 and as depicted on the drawing submitted with the application. The proposed project will occupy the same footprint as the existing structure. The variance as approved will provide the applicant with a reasonable use of his property. Jim and Robin Andrews - Denied. (6:45 p.m.) Jim and Robin Andrews, part of Government Lots 3 and 4, Section 1 and part of Government Lot 3 Section 12 of Dane Prairie Township by an unnamed lake, requested a variance of 2’ from the maximum allowable 20’ height of a non­ dwelling structure for the construction of a 40’ by 80’ structure having a height of 22’ and being located approximately 233’ from the ordinary high water level. The audience was polled with no one speaking for or against the variance as requested. Brad, the applicants’ contractor, appeared with the applicant at the public hearing. Letters from Gordon Fuchs and Neil Lindgren in support of the variance as requested were noted for the record. After consideration and discussion, Paul Larson made a motion, second by Michael Harris and unanimously carried, to deny the variance as requested as no adequate hardship/practical difficulty unique to the property had been shown that would allow for the granting of the variance as requested, the granting of the variance as requested would establish precedence that the Board does not wish to establish, the applicants can obtain a reasonable use of their property without the granting of the variance as requested and the applicants have adequate room and other alternatives available which would allow them to meet the requirements of the ordinance. October 1,1998 Page 5 James and Sharon Gowin - Denied James and Sharon Gowin, Battle Lake, MN, requested a variance of 4’ frdm the required lot line setback of 10’ for the location of a storage shed 6’ from the lot line. The property is described as Lot 21, Pleasant Shores, Lake Ethel in Girard Township. A letter from Randy and Joan Abbott in favor of the applicants’ request was read for the record. The audience was polled with no one speaking for or against the request. After consideration, motion was made by George Walter, seconded by Cecil Femling and unanimously carried, to deny the variance as requested noting that no adequate hardship had been shown and that a structure of reasonable size can be placed on the lot without the granting of a variance. Rich Dombeck - Approved Rich Dombeck, Hawley, MN, requested variances from the required ordinary high water level setback of 100’ and from the required road right-of-way setback of 20’ for the replacement of an existing 35’ by 8’ trailer with a 30’ by 14’ Dynamic Pre-Fab modular structure. The new structure would be placed ' approximately 16’ from the lake and approximately IT from the edge of the road. The applicant is also proposing the filling of a low spot, where the existing structure is located, with class 5 road gravel (approximately T depth) and to cover the west side of his lot with pea-gravel (3-4”) similar to existing lakeside. The property is described as Lot 4, Silent Point, West Silent Lake in Dora Township. September 3,1998 Meeting - A letter from Alan Fjerstad expressing concern with the existing road was read for the record. The audience was polled with no one speaking for or against the request. After much discussion and consideration, motion was made by Randall Mann, seconded by David Holmgren and unanimously carried, to table, with the applicant’s approval, this public hearing until the October 1, 1998 Board of Adjustment meeting so the applicant can review changes in the location of the road with the Department of Natural Resources. October 1,1998 Meeting - The audience was polled with no one speaking for or against the request. After consideration, motion was made by Randall Mann, seconded by John Everts and unanimously carried, to approve the replacement of and existing 35’ by 8’ unit with a 30’ by 14' unit 22’ from the ordinary high water level (water) and at least 10’ from the road right-of-way. It was noted that length of the structure is being reduced. It was also noted that the variance is being granted based on the fact that the existing road will be relocated, under the direction of Terry Lejcher, Department of Natural Resources, in an area that he has located and staked for the applicant. It was noted that the granting of this variance would provide the applicant with a reasonable use of his property. Hardship is a substandard lot of record.
