After discussion and consideration, Steve Schierer made a motion, second by Thomas Lee and unanimously carried, to approve a
variance of 50’ from the required ordinary high water level setback of 100’ for the placement of a dwelling 50’ from the ordinary
high water level. It should be noted that the proposed development will be setback further from the ordinary high water level than
the existing structure. The variance as approved does not directly or indirectly grant any other variances for the proposed
development.

Thursday, August 6, 2009
The Otter Tail County Board of Adjustment met Thursday, August 6, 2009, with the following persons in attendance:

Called to Order - Randall Mann Chair called the meeting of the Board of Adjustment to order at 6:30 p.m
Minutes Approved - The Board of Adjustment approved the minutes of the July 2, 2009 meeting as mailed.
The Board of Adjustment considered the following applications for variance:
Michael Harris
Randall Mann
Paul Larson
Steve Schierer
Gerald A. and Sandra J. SJolin - Approved the variance as requested with a condition. (6:32 p.m.)
Gerald A. and Sandra J, Sjolin, Lot 5 Inlet Beach First Addition, Lake Lida in Lida Township, requested a variance for
the repair of an existing boat house, and basement walkout. It will not change the size, appearance, or function of the
existing structure. It is concrete and block replacement only. No increase in impervious which is at 36% now or 11%
over allotted. Work will be as close as 5’ setback from lake. The audience was polled with no one speaking for or
against the variance as requested. After discussion and consideration, Steve Schierer made a motion, second by
Paul Larson and unanimously carried, to approve the variance as described in the variance application dated July 8,
2009 and as depicted in the drawing submitted with the variance application with the condition that the structure as
repaired must have the exact measurements as the existing original structure.
Aaron Jaeger - Approved the variance as requested. (6:40 p.m.)
Aaron Jaeger, Lot 10 Jaegers Silent Lake Beach, West Silent Lake in Dora Township, requested a variance of 50’
from the required ordinary high water level setback of 100’ for the placement of a dwelling 50’ from the ordinary high
water level. The audience was polled with no one speaking for or against the variance as requested. A letter from the
Otter Tail County Highway Department requesting that the garage be placed at least 20’ from the road right-of-way
was read for the record. After discussion and consideration, Steve Schierer made a motion, second by Thomas Lee
and unanimously carried, to approve a variance of 50’ from the required ordinary high water level setback of 100’ for
the placement of a dwelling 50’ from the ordinary high water level. It should be noted that the proposed development
will be setback further from the ordinary high water level than the existing structure. The variance as approved does
not directly or indirectly grant any other variances for the proposed development.
Richter Trust - Approved the variance as requested with a condition. (6:45 p.m.)
Richter Trust, Lots 31 and 32 Cedar Park Club, Swan Lake in Dane Prairie Township, requested a variance of 38’
from the required ordinary high water level setback of 100’ for the replacement of a carport with a 5’ by 14’ breezeway
62’ from the ordinary high water level for the purpose of connecting two dwellings and a variance of 21 ’ from the
required ordinary high water level setback of 100’ for a second story addition to existing dwelling 79’ from the ordinary
high water level. Also, proposing a 20’ by 24’ two story addition 102’ from the ordinary high water level. Donald
Lindblom represented the applicant at the public hearing. The audience was polled with no one speaking for or
against the variance as requested. After discussion and consideration, Thomas Lee made a motion, second by Steve
Schierer and carried with Paul Larson voting no, to approve a variance of 38’ from the required ordinary high water
level setback of 100’ for the replacement of a carport with a 5’ by 14’ breezeway 62’ from the ordinary high water level
for the purpose of connecting two dwellings and a variance of 21 ’ from the required ordinary high water level setback
of 100’ for a second story addition to existing dwelling 79’ from the ordinary high water level as depicted on the
drawing submitted with the variance application with the condition that no more than 25% of the total eligible lot area
can be covered with impervious surfaces. It was noted that the proposed development will be no closer to the
ordinary high water level than the existing development.

After consideration and discussion, Steve Schierer made a motion, seconded by Paul Larson and unanimously
carried, to approve a variance of 50’ from the required ordinary high water level setback of 100’ for the placement of a
dwelling 50’ from the ordinary high water level with the condition that before a site permit can be issued for the new
dwelling the existing garage must be placed at least 50’ from the ordinary high water level and at least 10’ from the lot
line.

Kelly and Diana Longtin, Lot 9 Morningside Shores, Ten Mile Lake in Tumuli Township, requested a
variance of T 6" from the required road right-of-way setback of 20’ for the placement of the southwest
corner of a detached garage 12’ 6" from the road right-of-way. Randall Mann, Chair, polled the audience
with no one speaking for or against the variance as requested; A letter from Tumuli Township and letters
from various property owners in support of the variance as requested were noted for the record. After
consideration and discussion, Cecil Femling made a motion to approve the variance as requested. The
motion died for lack of a second. After additional discussion and consideration, Steve Schierer made a
motion, seconded by Paul Larson and unanimously carried, to deny the variance as requested as no
adequate hardship unique to the property had been shown that vyould allow for the grantjrig of the variance
as requested, there is adequate room for the placement of a.garage/storage building without the granting of
any variances, the placement of the garage in the proposed location creates public safety concerns and the
applicants can obtain a reasonable use of there property without the granting of the variance as requested,
The Board viewed the requested variance as-if the applicants had requested the variance prior to starting
the project and the Board noted that they would not have approved this request had the request been
made before starting the project.

placement of a dwelling 45’ from the ordinary high water level. Randall Mann, Chair, polled the audience
with Aaron Jaeger speaking for the variance as requested. Letters from Roger and Bonnie Fritz and Peggy
Larson in support of the variance as requested were noted for the record. After consideration and
discussion, Steve Schierer made a motion, seconded by Paul Larson and unanimously carried, to approve
a variance of 50’ from the required ordinary high water level setback of 100’ for the placement of a dwelling
50’ from the ordinary high water level with the condition that before a site permit can be issued for the new
dwelling the ,existing garage must be placed at least 50’ from'the ordinary high water level and at least 10’
from the lot'line.
John and Wendy Lindlief- Approved with a condition. (7:10 p.m.)
John and Wendy Lindlief, part of Government Lot 1, Section 23 of Girard Township, by East Battle Lake,
requested a variance of 11 ’ from the required shore impact zone setback of 50’ and a variance of 61’ from
the required ordinary high water level-setback of 100’ for the construction of a 22’ by 24’ attached garage
and for a second story addition over the garage and over part of the existing dwelling, which would be 39’
from the ordinary high water level. Randall Mann, Chair, polled the audience with Allen Koep speaking for
the variance as requested. After consideration and discussion, Paul Larson made a motion, seconded by
Michael Conlon and unanimously carried, to approve a variance of 11’ from the required shore impact zone
setback of 50’ and a variance of 61 ’ from the required ordinary high water level setback of 100’ for the
construction of a 22’ by 24’ attached garage and for a second story addition over the garage arid over part
of the existing dwelling with the condition that the two existing utility building must be removed before a site
permit can be issued for the proposed development. The Board noted that all of the proposed
development would be behind the existing string line.
