Robert and Kathleen Hanson - Approved the variance as modified with a condition. (6:45 p.m.)
After discussion and consideration, Steve Schierer made a motion, second by Michael Harris and unanimously carried, to approve
the placement of an addition (no size stated for the addition) no closer to the ordinary high water level than the rear of the existing
dwelling and at least 30’ from the top of the bluff with the condition that no more than 25% of the total eligible lot area can be
covered with impervious surfaces. It was noted that the reason for the modification is that the applicants’ proposed location is in a
very fragile and sensitive area. It should also be noted that the variance as granted does not directly or indirectly grant any other
variances for this proposed development.

OF THE
OTTER TAIL COUNTY BOARD OF ADJUSTMENT
Thursday, September 3, 2009
The Otter Tait County Board of Adjustment met Thursday, September 3, 2009, with the following persons in
attendance:

Called to Order - Randall Mann Chair called the meeting of the Board of Adjustment to order at 6:30 p.m.
Minutes Approved - The Board of Adjustment approved the minutes of the August 6, 2009 meeting as mailed.
The Board of Adjustment considered the following applications for variance:
Wiliiam Maruska - Approved the variance as modified. (6:57 p.m.)
. William Maruska, Lots 14 and 15 Crystal Beach, Clitherall Township by Clitherall Lake, requested the following:
proposing to replace the existing 9’ by 15’ deck , which is currently 0’ from the ordinary high water level with a new 20’
by 10’ deck approximately 10’ from the ordinary high water level. The audience was polled with no one speaking for
or against the variance as requested. After discussion and consideration, Paul Larson made a motion second by
Thomas Lee to approve the variance as requested. After additional discussion and consideration the motion was
amended to read as follows: Paul Larson made a motion, second by Thomas Lee and unanimously carried, to
approve the replacement of the existing deck with a new deck no larger than 9’ by 15’ in size and at least 10’ from the
ordinary high water level. The Land and Resource Department will establish the ordinary high water level for the
applicant. It was noted that the existing deck is in need of repair and the proposed location is an improvement over
the existing deck location.
Reinke Family Lake Property - Denied the variance as requested. (6:32 p.m.)
Reinke Family Lake Property, 1.86 acre parcel in Government Lot 4, Section 23 of Amor Township by Otter Tail Lake,
requested the following: This 1.86 acre tract of land was recorded December of 1978. The lot has the required
square footage (81,022) but does not have the lot width of 200’. The lot has 140’ of lot width proposing to have the lot
declared buildable for single family residential use. The audience was polled with no one speaking for or against the
variance as requested. Letters from Lindsay Bush, Perry and Diane Weeks, Robert and Darlene Nelson and Ira and
June Tanner in opposition to the granting of the variance as requested were read for the record. An email from Bud
and Linda Mellon asking questions and expressing concern was read for the record. After discussion and
consideration, Michael Harris made a motion, second by Steve Schierer and unanimously carried, to deny the
variance as requested as the proposed use is hot consistent with similar back lot use in this immediate area, the
applicant has the ability without the variance to enjoy the same rights and privileges as other back lot owners in this
immediate area and the granting of the variance as requested would establish precedence for this immediate area.

Robert and Kathleen Hanson, Lots 1 and 2, Maple Lane Beach and Outlets C and D, East Silent Lake Shores, East
Silent Lake in Dora Township requested a variance of 5’ from the required top of bluff setback of 30’ and a variance of
35’ from the required ordinary high water level setback of 100’ for a 10’ by 18’ addition to the east side of the house
25’ from the top of the bluff and 65’ from the ordinary high water level. The audience was polled with no one speaking
for or against the variance as requested. After discussion and consideration, Steve Schierer made a motion, second
by Michael Harris and unanimously carried, to approve the placement of an addition (no size stated for the addition)
no closer to the ordinary high water level than the rear of the existing dwelling and at least 30’ from the top of the bluff
