(7:13 p.m.) After discussion and consideration, Thomas Lee made a motion, second by Steve Schiererand unanimously carried, to approve the variances necessary for the replacement of an existing 16’ by 10’ deck with a 14’ by 16’ screened porch, which will be 30’ from West McDonald Lake, 22’ from Brown Lake and 12’ from the road right-of-way and to approve the replacement of the existing holding tank with a new holding tank in the most compliant location possible as determined by the Land and Resource Department, which means if the existing shed is more than 10’ from the lot line and, if necessary to facilitate/accommodate the placement of a septic/holding tank, the existing shed can be moved to a location which is 10’ from the lot line. The septic/holding tank must be placed at least 10’ from the structures. Structure will be 30’ from West McDonald and 22’ from Brown Lake. Measurements in past approved variance were incorrect due to measuring difficulty because of snow cover. Structure will be 12’ from right-of-way. Requesting to replace existing holding tank with a new holding tank 30’ from west McDonald, 25’ from Brown and 6’ from existing shed. The audience was polled with no one speaking for or against the variance as requested.' (7:30 p.m.) Beverly Blair, part of Government Lots 1 and 6, Section 13 of Aurdal Township by an unnamed lake, requested a . variance of 29’ from the required ordinary high water level setback of 200’ for the placement of a 30’ by 48’ dwelling 171’ from the ordinary high water level and a variance of 48’ from the required ordinary high water level setback of 200’ for a 32’ by 40’ addition onto an existing shed located 152’ from the ordinary high water level. Tony Koep appeared with the applicant at the public hearing. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Paul Larson made a motion, second by Thomas Larson and unanimously carried, to.approve a variance of 29’ from the required ordinary high water level setback of 200’ for the placement of a 30’ by 48’ dwelling 17T from the ordinary high water level and a variance of 48’ from the required ordinary high water level setback of 200’ for a 32’ by 40’ addition onto an existing shed located 152’ from the ordinary high water level. The proposed development (location and size) will not negatively impact the neighboring properties, The terrain features are the applicant’s practical difficulty. It was also noted the lake was recently reclassified from a general development lake to a natural environment lake. The audience was polled with no one speaking for or against the variance as requested. A letter from the Little McDonald, Kerbs and Paul Lake Improvement District in support of the variance as requested was read for the record. After discussion and consideration, Steve Schierer made.a motion, second by Paul Larson and unanimously carried, to approve a variance of 125’ from the required ordinary high water level setback of 200’ and a variance of 10’ from the required road right-of-way setback of 20’ for the placement of a dwelling and attached garage, in a 50’ by 60’ rectangle 75’ from the ordinary high water level and 10’ from the road right-of-way with the condition that before any permits for the proposed development.can be issued Lots 26 and 27 Plainview Sandy Beach'(Parcel Nos. 20-000-99-0361-000 and 20-000-99-0362-000) and Lot 13 Block 1 Plainview Sandy Beach Third Addition (Parcel; No. 20-000-99-0773-000);must have the same recorded ownership.
