(6:33 p.m.) After discussion and consideration, Steve Schierer made a motion, seconded by Marion Gill and unanimously carried, to approve a variance of 57’ from the required ordinary high water level setback of 100’ and a variance of 7’ from the required shore impact zone setback of 50’ for the placement of a 12’ by 30’ single story addition 43’ from the ordinary high water level and in the location as depicted on the drawing dated April 25, 2010, which was submitted with the variance application. It was noted that the proposed addition is to the rear of the existing structure and will be no closer to the side lot line than the existing structure. The variance as approved does not directly or indirectly grant any other variances for the proposed development. Assessor and the MN DNR bk 0407-001 329,512 - Victor Lundeen Company, Fergus Falls, Minnesota MINUTES OF THE MEETING OF THE OTTER TAIL COUNTY BOARD OF ADJUSTMENT Thursday, June 3, 2010 The Otter Tail County Board of Adjustment met Thursday, June 3, 2010, with the following persons in attendance: : Marion Gill Thomas Lee Mark Ronning, Land and Resource Management David Hauser, County Attorney ; Michael Harris Randall Mann Paul Larson Steve Schierer Called to Order - Randall Mann, Chair called the meeting of the Board of Adjustment to order at 6:30 p.m. Minutes Approved - The Board of Adjustment approved the minutes of the May 13, 2010 meeting as maiied. The Board of Adjustment considered the following applications for variance: Richard and Barbara Dale - Approved the variance application as requested. (6:33 p.m.) Richard and Barbara Daie, Lot 7 Schermerhorn Beach, West McDonald Lake in Dora Township, requested a variance of 57’ from the required ordinary high water level setback of'100’, a variance of 7’ from the required shore impact zone setback of 50’ and a variance of 6” from the required side lot line setback of 10’ for.the placement of an addition 43’ from the ordinary high water-leveH and 9’ 6” from the side lot line The audience wasipolled with no one speaking for or against the variance as requested. (6:36 p.m.) Mary Jane Peterson Trust. Lot .2 Block 1 Stalker View Acres, Stalker Lake in Tordenskjold Township, requested a variance to have Lot 2 Block 1 Stalker View Acres declared buildable for single family residential use. The lot has 34,729 square feet of area and the required lot area for a recreational development lake is-40,000 square feet, of area. The plat of Stalker View Acres was recorded on'.December 17'^ 1975. Henry Peterson appeared with the applicant at the public hearing. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Steve Schierer made a motion, seconded by Thomas Lee and unanimously carried, to declare Lot 2 Block 1 Stalker View-Acres as a buildable lot for single family residential use. It was noted that the granting of the variance as requested will provide the applicant with the same rights and privileges ■ as others in this immediate area and is consistent with past actions of the Board of Adjustment. Aaron Smith and Priscilla Walker - Approved the variance application as requested. (6:38 p.m.) Aaron Smith and Priscilla Walker, part of Government Lot 1 l and part of the Southwest Quarter of the Southwest Quarter, Section 3 .of Hobart Township by Wymer Lake, requested the following: Want to move.25’ by 31’ cabin which is,26’ from lake and foundation is falling out from under it. We want to put a new foundation (basement) under it when moved and is 50 feet from lake edge. We want to repair the existing cabin. With the lay of the land, we would like the basement to be a natural walkout. The audience was polled .with no one speaking for or against the variance as requested. After discussion and consideration, Marion Gill made a motion, seconded by Thomas Lee and unanimously carried, to approve the variance as requested in the application dated March 30, .2010 and as depicted on the drawing submitted with the variance application. It was noted that the proposed location is a significant improvement over the current structure location and the proposed walkout is to the rear of the structure away from the lake.
