After consideration and discussion, Darren Newville made a motion, seconded by Terry Marthaler, and carried to
approve the after the fact variance request to allow the fireplace bump-out to be 9’ ifom the lotline. This decision is
based on the Findings of Fact and Decision Form, which contains the criteria reviewed and the Board’s fmding
have been attached to and incorporated as an official part of the minutes which have been placed on file with the
Land & Resource Management Department.

A variance may be granted only where the strict enforcement of county land use controls will result in a "practical difficulty". A
determination that a practical difficulty exists is based upon consideration of the following criteria:
The applicant identified the following practical difficulty: The property owners decided to build on the property and understood
what we thought were the property lines and after it was built the neighbors must have thought that it was to close and had the
property surveyed and from the survey that was done it was determined that the bump-out on the house for the fireplace is only 9'
from the lotline. The rest of the dwelling meets setback requirements.

Board of Adjustment Chair
The Board of Adjustment may impose conditions in the granting of variances. A condition must be directly related to and must bear
a rough proportionality to the impact created by the variance. {Mitigating impervious surface with storm water management, deep
rooted vegetative buffers, rain gardens, etc.)
It is the Board of Adjustment's job to apply appropriate legal standards to a specific fact situation. Variances are meant to be an
infrequent remedy where an ordinance imposes a unique and substantial burden.

The Otter Tail County Board of Adjustment Members convened on April 14, 2022, at 6:00 p.m. at the Government Services Center.
The meeting was held in person and via Microsoft Teams.
The following persons were in attendance;

Called to Order - Michael Donoho, Chair called the meeting of the Board of Adjustment to order at 6:00 p.m.
Minutes Approved - The Board of Adjustment approved the minutes of the January 13, 2022, meeting. Terry Marthaler made a
motion, seconded by Mark Johnson to approve the January 13, 2022, Meeting Minutes.
Nominations
Nominations for Vice Chair - Darren Newville made a nomination, seconded by Mark Johnson to elect Terry Marthaler to serve as
Vice Chair of the Board of Adjustment for 2022. Rick Wilson made a motion to cease nominations and cast a ballot for Terry
Marthaler, seconded by Darren Newville and carried to elect Terry Marthaler to serve as Vice Chair of the Board of Adjustment for
2022.
The Board of Adjustment considered the following application(s) for variance:

Brian & Sarah Christopherson, Lot 3 of Shermerhom Beach, Big McDonald Lake (56-386) in Dora Township requested the
following: New home permitted by County and constructed based on mutually understood property line and setback. After new home
w as constructed, a new survey revealed a change in the property line placing the small fireplace bump-out on one side for the home 9’
instead of 10’ from property line. This is an after the fact request.
Brian & Sarah Christopherson, property owners, represented the variance application. The audience was polled with Vem Amtson
speaking in opposition to the variance as requested indicating that they had talked to a surveyor to survey the property, specifically the
lotline, but the surve\ors were delayed in getting to the property. Property owners also expressed concerns with the verbiage in the
meeting notice stating that the lotline was mutually agreed upon. The Amtson’s indicated that they did not have a conversation with
the property owner about the property line. The Arntson’s also submitted a picture showing a pin location by the boathouse.
After consideration and discussion, Darren New \ ille made a motion, seconded by Terry Marthaler, and carried to approve the after the
fact variance request to allow the fireplace bump-out to be 9’ from the lotline. This decision is based on the Findings of Fact and
Decision Form, which contains the criteria rev iew ed and the Board’s finding have been attached to and incorporated as an official part
of the minutes w hich have been placed on file w ith the Land & Resource Management Department.
Bradley & Brenda KneisI - Approved Revised Variance as Requested (6:25 p.m.)
Bradley & Brenda KneisI, E 55’ of Lot 1 of Sandra’s Beach L' Addition, East Battle Lake (56-138) in Girard Township requested the
following: Due to the location of the approved septic system, w e are proposing to build with a setback of 35’ from the OfJWL,
increase the square footage allowed within the shore impact zone to 490 sq. ft. (412.5 is allowed on our lot), and increase the
impervious to 29.13% to allow for a driveway to access the garage. The only way the septic system could be designed on our narrow
lot was to be placed in one location to maintain proper distance from the neighbor’s existing well. Solely due to the constraint of the
