A variance may be granted only where the strict enforcement of county land use controls will result in a "practical difficulty". A determination that a practical difficulty exists is based upon consideration of the following criteria: The applicant identified the following practical difficulty: The property owners decided to build on the property and understood what we thought were the property lines and after it was built the neighbors must have thought that it was to close and had the property surveyed and from the survey that was done it was determined that the bump-out on the house for the fireplace is only 9' from the lotline. Variances are meant to be an infrequent remedy where an ordinance imposes a unique and substantial burden. MINUTES OF THE MEETING OF THE OTTER TAIL COUNTY BOARD OF ADJUSTMENT Thursday, April 14,2022 The Otter Tail County Board of Adjustment Members convened on April 14, 2022, at 6:00 p.m. at the Government Services Center. The meeting was held in person and via Microsoft Teams. The following persons were in attendance; Rick Wilson Mark Johnson Rick West Michael Donoho Darren Newville Terry Marthaler Chris LeClair, Director, Land & Resource Management Ben Olson, Assistant County Attorney Members Absent: Thomas Lee Called to Order - Michael Donoho, Chair called the meeting of the Board of Adjustment to order at 6:00 p.m. Minutes Approved - The Board of Adjustment approved the minutes of the January 13, 2022, meeting. Terry Marthaler made a motion, seconded by Mark Johnson to approve the January 13, 2022, Meeting Minutes. Nominations Nominations for Vice Chair - Darren Newville made a nomination, seconded by Mark Johnson to elect Terry Marthaler to serve as Vice Chair of the Board of Adjustment for 2022. Rick Wilson made a motion to cease nominations and cast a ballot for Terry Marthaler, seconded by Darren Newville and carried to elect Terry Marthaler to serve as Vice Chair of the Board of Adjustment for 2022. The Board of Adjustment considered the following application(s) for variance: Brian & Sarah Christopherson - After the Fact Variance Application Approved as Requested (6:04 p.m.) Brian & Sarah Christopherson, Lot 3 of Shermerhom Beach, Big McDonald Lake (56-386) in Dora Township requested the following: New home permitted by County and constructed based on mutually understood property line and setback. This is an after the fact request. Brian & Sarah Christopherson, property owners, represented the variance application. The audience was polled with Vem Amtson speaking in opposition to the variance as requested indicating that they had talked to a surveyor to survey the property, specifically the lotline, but the surve\ors were delayed in getting to the property. Property owners also expressed concerns with the verbiage in the meeting notice stating that the lotline was mutually agreed upon. The Amtson’s indicated that they did not have a conversation with the property owner about the property line. The Arntson’s also submitted a picture showing a pin location by the boathouse. After consideration and discussion, Darren New \ ille made a motion, seconded by Terry Marthaler, and carried to approve the after the fact variance request to allow the fireplace bump-out to be 9’ from the lotline. (412.5 is allowed on our lot), and increase the impervious to 29.13% to allow for a driveway to access the garage. The only way the septic system could be designed on our narrow lot was to be placed in one location to maintain proper distance from the neighbor’s existing well.
