James Heisler - Denied. (7:14 p.m.)
After consideration and discussion, Leona Zimmerman made a motion, seconded by Cecil Femling and carried with
Michael Conlon voting no, to deny the variance as requested noting that no adequate hardship unique to the property
had been shown that would allow for the granting of the variance as requested. The Board noted that it appeared that
the applicant was attempting to make the property fit the desired structure instead of making the structure fit the
property.

a motion, seconded by Steve Schierer and unanimously carried, to allow the placement of a deck no closer
to the ordinary high water level than the existing dwelling and at least 10’ from the side lot line with the
condition that no more than 25% of the total lot area can be covered with impervious surfaces. The Board
noted that had they approved the variance as requested it would have placed the proposed deck ahead Of
the sting line and within the shore impact zone.
