project. The work you propose at the location stated is not within the
jurisdiction of the Corps of Engineers.
No work will be done in a navigable water of the United States, and no
dredged or fill material will be placed in any water of the United States,
including wetlands. Therefore, a Department of the Army permit is not
required to do this work.
This letter is valid only for the project referenced above. If any change
in design, location, or purpose is contemplated, contact this office at (612)
725-7558 to avoid doing work that may be in violation of Federal law. PLEASE

Dear Mr. Kalar:
I am in receipt of your letter dated September 29, 1987,
concerning the fill which was placed on the Harris', Moltzan's,
and my lot. There was very little fill placed on my lot and I
don't think it slopes to the road. However, I would recommend
that the fill be allowed to settle over the winter, and that
you take another look at the situation in the Spring.
The only reason any fill was placed on the North edge of my lot
was to prevent me from having a low spot after Harris and
Moltzan filled their lots. I never had a problem in that area
before, but it was assumed that I would have a problem if they
were allowed to fill their lots without putting a little
additional fill on the edge of mine. Without that fill, the
North edge of my lot would have become the lowest area and it
would have collected the runoff.
I would be happy to meet with you or discuss this matter on the
telephone, and I look forward to hearing from you at your
convenience.

Conditional Use Permit #3450 for lot on West Silent Lake (56-519).RE:
Dear Mr. Landberg:
On September 17, 1987 our office conducted an onsite inspection of your
property. This inspection revealed that too much fill material had been
placed on your property.
Conditional Use Permit #3450 (copy enclosed) required that all fill material
remain at least one (1) foot below the existing road grade. This provision
was apparently not followed since the total fill project (yours, Moltzan's
and Harris') now slopes to the road. Since this is the case, water runoff
now appears to be directed over the public road which may result in it being
damaged.
Please contact our office on or before October 13, 1987 so that this matter
may be resolved.

A motion by PeCterson, second by Lachowitzer to approve the
conditional use application of Jvles Moltzan. West Silent Lake,
No. 56-519, RD, on Lot 1 of Silent Point, Section 31 of Dora
Township providing that the fill stays 1 foot below the road and
also the filling is to be done by Harris, Landberg and Moltzan
at the same time (Harris must apply for a conditional use
permit). David Landberg spoke to the commission.

Voting: All members in favor except Femling abstained.
A motion by Petterson, second by Landberg to approve the
conditional use application of David Landberg. West Silent Lake,
No. 56-519, RD, on Lots 2 & 3 (etc.), Section 31 of Dora
Township allowing to surface the driveway with a clay gravel
base and also to fill according to the Conditional Use Permit
issued to Mr. Moltzan. Jyles Moltzan spoke to the commission.

commission.

A motion by Portmann, second by Hatling to approve the
conditional use application of Steven Bergeson. Pelican Lake, No.
56-786, GD, on Lot 7, Block 1 of Haugen's Point, Section 8 of
Dunn Township to allow up to 18 inches of fill plus 4 inches of
black dirt on top of the pad on an area 80 feet wide by 50 feet
deep, all being 75 feet back from the lake, the fill must taper
to the lot lines and also a maximum fill of 1 foot for a driveway
at 12 feet wide. No fill is to be closer than 75 feet of the
lake.
