(8:50 p.m.) After consideration and discussion, Paul Larson made a motion, second by Robert Schwartz and unanimously carried, to approve a variance of 22’ from the required ordinary high water level setback of 75’ for the placement of a dwelling with a full basement 53’ from the ordinary high water level. Hardship/practical difficulty is a substandard lot and the condition of existing foundation which is in need of repair. The applicant’s proposal is basically repair/maintenance. The proposed development is in-line with the neighboring properties. The variance as approved does provide the applicant with the ability to enjoy the same rights and privileges as others in this immediate area. The existing dwelling is not being replaced. Proposing to add second story. Replacement will not be any closer to the lake or road right-of-way than existing structure. Requesting to increase impervious surface to 32.7, currently 31.2% equal 1.5% increase for front platform. The audience as polled with no one speaking for or against the variance as requested. After consideration and discussion, Paul Larson made a motion, second by Tom Lee and unanimously carried, to approve the proposed development as described in the variance application dated July 20, 2015 with the condition that impervious surface coverage upon completion of the proposed development cannot exceed the current coverage, which is understood to be 31.2% and with the condition that the lakeside deck cannot exceed 10’ by 24’. Hardship/practical difficulty is existing structure setbacks and the flooding that has occurred in this area. The applicants’ proposal is basically repairs needed from prior flooding in this area. The applicants’ structure is in-line with other structures within this immediate area. It was noted that the applicants will have an adequate use of their property without the granting of a variance to increase impervious surface coverage. The variance as approved does not directly or indirectly grant any other variances for proposed or future development. Kathy and Bruce Engkjer - Variance application approved as requested with a condition. (8:30 p.m.) Kathy and Bruce Engkjer, Lot 6 Block 5 Crystal Lida Beach, Crystal Lake in Lida Township, requested the following: This is an after-the-fact request. Excess non pervious area. Small walkway for cart to bring grocery’s to back door for my wife. Impervious surface currently at 52%. Allowable coverage is 25%. The audience was polled with Mark Michels expressing concern with the variance as requested. An unsigned letter questioning the requested variance was read for the record, as well as an unsigned note in opposition to the variance as requested. After consideration and discussion, Steve Schierer made a motion, second by Thomas Lee and unanimously carried, to allow the walkway to remain as currently placed with the condition that 200 square feet of other impervious materials must be removed on or before September 30, 2015. It was noted that this particular lot has significant impervious surface coverage when compared to other lots within this immediate area and removing more impervious surface coverage than was added by the additional walkway is a reasonable request. It was also noted that the applicants’ request is an after the fact request.
