Assessor and the MN DNR L R Official/Date bk 0407-001 329,512 - Victor Lundeen Company, Fergus Falls, Minnesota MINUTES OF THE MEETING OF THE OTTER TAIL COUNTY BOARD OF ADJUSTMENT Thursday September 1, 2011 The Otter Tail County Board of Adjustment met Thursday, September 1,2011, with the following persons in attendance: Ken Erickson Thomas Lee Scott Ellingson, Land and Resource Management David Hauser, County Attorney Michael Harris Randall Mann Paul Larson Steve Schierer Called to Order - Randall Mann, Chair called the meeting of the Board of Adjustment to order at 6:30 p.m. Minutes Approved - The Board of Adjustment approved the minutes of the August 4, 2011 meeting as mailed. The Board of Adjustment considered the following applications for variance: Keith F. and Diane B. DeBlieck - Application approved as modified. (6:32 p.m.) Keith F. and Diane B. DeBlieck, part of Lot 10 and all of Lot 11 of the Survey Lots of Government Lot 5 and 6, Section 33 of Tordenskjold Township by Stalker Lake, requested the following; In front of straight line of two houses by our cabin. Lift existing cabin 26' by 30’ to install a 40 inch foundation being 48' from lake and construct an addition 16’ by 36’ that will be 52’ from lake. Setback requirement is 100’. The audience was polled with no one speaking for or against the variance as requested. After consideration and discussion, Steve Schierer made a motion, seconded by Ken Erickson and unanimously carried, to approve the proposed development, as described in the variance application dated August 2, 2011 and as depicted on the drawing submitted with the application, being no closer to the ordinary high water level than 50’ or the existing structure whichever provides the greatest setback from the ordinary high water level. If the existing structure is less than 50’ from the ordinary high water level then the proposed development must have a setback of at least 50’. If the existing structure is more than 50’ from the ordinary high water level then the proposed development must be placed no closer to the ordinary high water level than the existing structure. The variance as approved does not directly or indirectly grant any other variances for the proposed development. The variance as approved is consistent with past actions of the Board of Adjustment. The proposed development includes both the lifting of the existing cabin and the new addition. ^^/<Sary Hempeck - Approved the application as requested. (6:40 p.m.) Gary Hempeck, part of Lot 32 and all of Lot 33, National Community Service Camp, West McDonald Lake in Dora Township, requested the following: I would like to move my wooden stairs from the deck over 2’. The open stairway is currently only 29” from the cabin wall and is open. Someone can easily fall down the stairway. We have relatives with wheelchairs and walkers that cannot safely go by open stair. Proposing to replace the existing deck because the joists have rotted out. The replacement deck will be in the existing location and will not be closer to the lake then the deck now and will be the same size deck. The current deck sits back 30’ from the lake.
