I was advised by our Landscaper with Lake Shore Services, Fergus Falls, MN block steps would tie into the retaining wall for better strength, create less movement of ground and structure over time. They did have a scaled drawing of a proposed location for the — _ dwelling and detached garage. Their lot is a substandard lot of record (1930). These are the items of __ concern after reviewing their plan: 1) There is a dedicated alley way between Lot 5 and Lot 6; as a result they would need to be setback 20' from this alley instead of the 10' lotline setback. They would like to " vacate this alley to be able to use the 10' setback and give them a little more area. This alley is not used — - as a road or access to lake by anyone currently. The neighbor uses the area for parking of his boat & etc. __ This will be their first step to complete before proceeding with any plans. 2) There is an area which is shown on the survey map as dense underbrush. I had Kyle come up and speak with them regarding this area and checking the map for any wetland ; it doesn't appear that it is but Kyle thought it should be verified onsite once the snow is gone. 3) They wish to build a walkout basement dwelling. We discussed the elevation of the lot and it appears it does not qualify as a bluff so a walkout dwelling could be done and it appears it would be a natural walkout. As currently proposed, the dwelling would not meet the 20' setback from the alley. 4) Also, discussed septic system setbacks and they will have a ~ designer/installer onsite to see where the system could be located. They will submit a plan once the — vacation is completed. Dave Wenzel: Motion by Huebsch, second by Froemming, and unanimously carried to approve the Preliminary Plat titled “Recreational Retreat” consisting of five non-residential, non-riparian lots with conditions as recommended by the Planning Commission. The Preliminary Plat is located in Pt of GL 3 & SEVi NW%, Section 3 of Edna Township; Little McDonald Lake (56-328), GD. Conditional Use Permit - Kimo’s Kamo, John Kimple: Motion by Froemming, second by Rogness and unanimously carried to approve a Conditional Use Permit for several projects at Kimp’s Kamp resort with conditions as recommended by the Planning Commission. Conditional Use Permit - Jamie & Maria Peterson: Motion by Lindquist, second by Froemming, and unanimously earned to approve a Conditional Use Permit for construction of retaining walls with a condition as recommended by the Planning Commission. The project is located in National Community Service Camp Lot 5 & 58 and vacated road & adj alley, Section 13 of Dora Township: West McDonald Lake (56-386), RD. Conditional Use Permit - Covenant Capital LLC. Darrin Trites: Discussion took place regarding the language in the Planning Commission recommendation to deny a multiple family rental business in a single family residential home. Neighbor, Steve Zimmerman, provided the commissioners with his explanation of what has occurred at the rental home and expressed his opinion that any rental (even to single families) is a commercial venture. The County Attorney indicated that Otter Tail County’s zoning under the Shoreland Management Ordinance prohibits multi-family rentals in a single family residential classification. Motion by Lindquist, second by Froemming, and unanimously carried to deny a Conditional Use Permit for a multiple family rental business (commercial use) because it is incompatible with the existing single family residential nature of the area. otter Tail County, Planning Commission September 10, 2014, Page 2 MCMK Properties, Michele Brant: Applicant was not present, in order to allow time for the Applicant to arrive, the Planning Commission decided to consider this request later in the evening (see below).
