Nystrom - Approved as modified and with condition. (6:42 p.m.) Motion was made by Steve Schierer, second by Cecil Femling and unanimously carried, to approve a variance of 60’ from the required ordinary high water level setback of 100’, a variance of 10’ from the required shore impact zone setback of 50’ and a variance of 5’ from the required side lot line setback of 10’ for the placement of a 12’ by 16’ storage shed 40’ from the ordinary high water level and 5’ from the side lot line with the condition that the existing 12’ by 22’ storage shed located by the waters edge must be removed on or before August 31,2002. Hardship is a substandard lot of record. It was noted that this is a substantial improvement to the applicants’ property and that the granting of the variance is a good trade off which results in the removal of a 12’ by 22’ storage shed located 3 to 5’ from the ordinary high water level. Junius, Suite 130 Fergus Falls, MN 56537 Ottertail County Board of Adjustment, Landowner proposes to raze existing 12’x22’ shoreline storage shed and replace it with a 12’xl6’ shoreline storage shed that has been moved back from waters edge by approximately 40’. Current shed is 3-5 feet from waters edge and has seen consistent damage from earth movement brought on by the lake ice. Current shed floor has been repaired numerous times and is now about 8 inches above its original position. I have also repaired the siding and doors due to racking of the structure from the related earth movement. Front sliding door currently hits the ground due to movement in February of 2002. I would like to replace this shed with a smaller one that is set back from the lake by about 40 feet and put it about 3-5 feet from the lot line. Proposed shed is staked out on my lawn in the place I would like to put it. Thank you for your consideration. AS A RESULT, IT MAY NOT BE POSSIBLE FOR OTTER TAIL COUNTY TO MEET THE LEGAL REQUIREMENT TO TAKE ACTION WITHIN 60 DAYS OF THE RECEIPT OF THE COMPLETED APPLICATION. I UNDERSTAND THAT IN THE ABSENCE OF A WAIVER OF THE 60 DAY REQURIEMENT, THE COUNTY MAY HAVE NO ALTERNATIVE BUT TO DENY THE APPLICATION.
