No change shall be made, without written permission previously obtained from the Commissioner of Natural Resources, in the dimensions, capacity or location of any items of work authorized hereunder. 3. This perait shall becoae effective on the date it is recorded in your County in the Office of the Recorder. Provided, the work affecting protected waters authorized herein shall not be coaaenced until <a Notice of Perait has been conspicuously posted at the construction site and a copy of the recorded perait is posted on or near the preaises upon which such work is conducted. A Notice of Perait will be issued by the Coaaissioner upon his receipt of a Certified copy of the recorded perait. 12. All general and special provisions of this perait shall bind the peraittee, his heirs and assigns and shall run with the land. 13. After the coapletion of the project authorized, peraittee shall supply the Departaent of Natural Resources with photographs of the project area. H. Peraittee shall aaintain the authorized project in a stable and safe condition. At any tiae the Coaaissioner finds that the projecti is subject to instability, creates a navigation hazard, has becoae a public nuisance, or has fallen into a state of disrepair, he shall order the owner to repair the project within a specified tiae. 15. Any Coaaissioner's Order terainating this perait aay also require the peraittee, at his own expense, to reaove within the tiae specified in said Order, any authorized project constructed under this perait and, if applicable, any unauthorized project in violation of this perait. Said Order shall also require the peraittee to restore, if necessary, the protected waters or beds thereof to the condition existing before the unauthorized activity. 16. This perait does not obviate any requireaent for federal assent froa the U.S. Corps of Engineers, 1135 U.S. Post Office and Custoa House, St. Paul, Minnesota 55101. II. Spoil material shall not be placed on the beds of protected waters, and, wherever possible, such material should not be placed anywhere within areas subject to flooding. III. Upon completion of construction, the bed of the protected water shall be restored as nearly as practicable to the original cross-section. IV. The permittee shall cover or protect all exposed soil resulting from the construction authorized by placing riprap, sod, and/or seed on banks and slopes of said construction for the prevention of soil erosion, sedimentation and lake/stream discoloration. V. Future maintenance of this project shall not exceed the dimensions herein authorized. Prior to commencing*any maintenance work, permittee shall advise the Department of Natural Resources of the type of materials, equipment, and procedures to be used.
