Thomas Terfehr - Variance application approved as requested. (6:55 p.m.)
Thomas Terfehr, Lot A Okeson Beach and part of Government Lots 1 and 5, Section 11 of Eagle Lake Township by
Eagle Lake, requested the following: Request a 32’ variance to position front of replacement house at 43’ from
ordinary high water level and for a 4’ walkway connecting decks at 39’ from ordinary high water level. This positon on
the lot aligns the house with neighbor’s house and minimizes grade and fill requirements. House will be behind the
building line. Ricky Leitch, Contractor appeared with the applicant at the public hearing. The audience was polled with
no one speaking for or against the variance as requested. After discussion and consideration. Ward Uggerud made a
motion, second by Thomas Lee and unanimously carried, to approve a variance of 32’ and a variance of 36’ from the
required ordinary high water level setback of 75’ to position the front of the dwelling 43’ from the ordinary high water
level and for the placement of a 4’ walkway (which connects two decks) 39’ from the ordinary high water level as
depicted on the drawing submitted with the variance application. The proposed development will be further back from
the ordinary high water level than the existing development.

requested the following: Storage shed will be short of road right-of-way setbacks or property and lake shore setbacks,
new trailer will be shore of lake shore setbacks but same as old one.
Shed Option # 1 - request a variance to place shed 6’ from property line and approximately 48’ from ordinary high
water level (no closer than existing dwelling).
Shed Option # 2 - request a variance to place shed 8’ from road.
Also request to replace existing dwelling with new double wide in same location. Approximately 48’ from ordinary high
water level. The audience was polled with no one speaking for or against the variance as requested. After discussion
and consideration, Thomas Lee made a motion, second by Paul Larson and unanimously carried, with the applicant’s
verbal permission, to table this public hearing until the September 11, 2014 meeting so that the applicant’s request
can include a request to have the property declared buildable.
September 11, 2014 Meeting - Douglas W Gullekson, part of Government Lot 9, Section 36 of Dora Township by
Round Lake, requested the following a variance to have lot declared buildable for residential purposes In order to
replace existing mobile home with new double wide or a built home on premises in same location but 12-16’ deeper.
Also put 12’ by 32’ storage shed or smaller on lot. All would be approximately 48’ from ordinary high water level as is
existing. Shed #1 variance of 6’ from property line, 48’ from ordinary high water level. #2 8’ from road right-of-way
and #3 48’ from ordinary high water level. Mr. Doug Gullekson was represented at the September 11, 2014 meeting
by Justin Gullekson his son. The audience was polled with no one speaking for or against the variance as requested.
An email from Mike Lange in opposition to the variance as requested was read for the record. A letter from the Otter
Tail County Attorney’s office dated September 4, 2013 referencing complaints and an outstanding issue was noted for
the record. After discussion and consideration, Steve Schierer made a motion, second by Michael Harris and carried
with Thomas Lee voting no, to deny the variance application as requested noting concern with ingress and egress
access to the property, impervious surface coverage, the lot size might not be adequate for the proposed
development and outstanding issues/complaints as referenced in a September 4, 2013 letter from the Otter Tall
County Attorney’s office.
Daren and Amy Tollefson - Variance application approved as requested. (7:25 p.m.)
Daren and Amy Tollefson, part of Government Lot 5, Section 28 of Maplewood Township by Crystal Lake, requested
the following: Due to the lay of land and shoreline there is no place 200’ or more to set structures. Also, there is a
natural gas pipeline running through the property that reduces area for structure placement. We are requesting a
variance of 130.5’ for placement of a camper, 165.5’ for a placement for a storage shed: and 117’ for placement of a
detached garage from the required 200’ setback. We are requesting a variance of 80’ for a sewage tank from
required 150’ setback. The audience was polled with no one speaking for or against the variance as requested. After
discussion and consideration, Paul Larson made a motion, second by Thomas Lee and unanimously carried, to
approve the variances for the proposed development as requested in the application dated August 16, 2014 and as
depicted on the drawing submitted with the application. The variances as approved do not directly or indirectly grant
any other variances for the proposed development or for any future development. It was also noted that the variance
for the camper is only for the camper and not for some other type of residential structure. Hardship/practical
difficultly Is the unique shape of the property, the pipeline, and the wetland area.

The following email is regards to a pending VarianGe Request for
the following property;

The variance requested is the following:
Addition of a storage shed to be built short of road right-of-way
setbacks or property and lake shore setbacks.

The GSpot as the Gullicksons call this property is not a residence or
even a summer cabin. Its more like a small campground where the
Gullicksons and their friends come on the weekends. This almost
always results in a ditch full of cars, trucks, boat trailers and
campers.
As the attached photos show, the entire lot is and the ditch is full.

Some of the issues this presents are as follows.
1. This property has no approach, or driveway access from it to
Hwy 108 so the G Spot guests just drive down the ditch and up out
of the ditch onto Hwy 108. There is no where to stop or wait when
entering the 55 mph zone. And traffic is coming downhill from
both directions. The attached photos will show tracks coming and
going from both direction well past the east and west boundaries of
the property in question.
2. The owners of this property have repeatedly demonstrated they
have absolutely no respect for the properties that border their small
lot. On the west wide of this property is the picnic area and public
access for Round Lake.
The Gullicksons claim they though they owned the picnic area so
the state paid to have a surveyor prove to them they didn't. This
had little or no effect on the property line issue. The Gullicksons
continued to invite more people to the G Spot than the property
could hold and the overflow again went into the picnic area. So
DNR put up signs about every 10 ft on the property line facing the
G Spot indicating where the public access property line was. Again,
the signs had little or no effect and some of the signs were simply
pulled out of the ground.
The following year DNR put up a fence and boulders along the
parking area to stop the G Spot guests from using the public access
as a private driveway and the picnic area as a personal
campground.

3. The existing septic system is apparently not adequate to the
"current" use of the property despite the fact that many of the
guests are using the Public Toilets in the Access parking lot.Even
with the "extra" public toilets the G Spot has put a port potty near
the lake to help with the over flow.

Allowing the G Spot to add additional living spaces on the already
overtaxed lot is only going to exacerbate the problems.
The Gullickson have indicated they want to place a shed short of the
road right of way. I'm not sure where exactly they think the RW
currently is since only recently they moved the RW right of way
stake to make room for a new tent camper spot which extends out
into the State Hwy right of way.
The question of the setback from the lake brings up another
issue. When the Gullicksons bought this property it hadn't been
occupied for quite a while. The shore line was covered with the
average lake vegetation. Once they arrived the Gullicksons
proceeded to remove all of the vegetation along the entire lake
shore frontage and then to "create" a beach. When I say "create" I
mean they removed the soil from the lakeshore back to a point
about 10 from the original shore line, then built a retaining wall and
back filled between the retaining wall and the lake with sand they
hauled in. The high water this year has significantly eroded the
shore line they created so the "Ordinary high water level" for this
property has already changed and is likely to change significantly in
the future.
This entire lot before the beach improvement was only .39 acres,
or about 17000 square feet. It is several 1000 sq. ft smaller
now. It is already completely full of campers, boat trailers, tents, a
trailer and a porta potty and the gullicksons can hardly park a car
on their own property and routinely use the right of way and
adjoining properties as their parking and overflow camping. I can't
imagine how they think they will be able to add a bigger trailer and
a shed on this lot.
I'm hoping the board will not only disapprove this variance but will
direct the State Hwy patrol to address the driveway issue, the DNR
to address the lakeshore and public access issues, and Lake Shore
management to address the "beach" that was created and the porta
potty on the beach. Additionally I believe it would be prudent
under the circumstances to have the septic system inspected to see
if it is sufficient to handle 15-20 guests on a weekend. Given the
size of the lot and number of guests that use it. Any defect in the
existing septic system absolutely will end up in the lake.

On the July 4*, 2013, holiday weekend, the Otter Tail County Land and Resource Management
Office again received a complaint regarding multiple dwellings (tents and campers) on your
property.
The Land and Resource Office previously sent letters to you dated July 31, 2012, and July 29,
2011, which addressed similar concerns. Under Section III, District Requirements, 4B of the
Otter Tail Shoreland Management Ordinance, Single Family Residential Lots shall contain only
one dwelling unit A copy of the Otter Tail County Shoreland Management Ontinance is
available fiom their office or online at Otter Tail County’s website.
A complaint will be filed with the Otter Tail County District Court should the Otter Tail County
Land and Resource Management Office receive a similar complaint in the future.
Further, there is a safety concern regarding the multiple vehicles parked on your property, the
vehicles being within the right of way, and accessing the highway via the right-of-way wdiich
you should address with the Miimesota State Highway Patrol.

Paul T. Kelly and Norma J. Olson, part of Government Lots 3 and 4, Section 11 of Maine Township by Pickerel Lake,
requested the following: We are requesting a variance in the normal ordinary high water level setback of 100’ to build
an addition onto our existing dwelling. Our property on Pickerel Lake has been in the Olson-Kelly family since the
1950’s. We inherited this property (~6.8 acres) and existing dwelling (-1968 square feet) in the late 1980’s: the
dwelling is located within the 100’ setback. The proposed addition will contain an attached garage, one bedroom and
closet (total -2006 square feet), and a small deck (-96 square feet). The requested setback for the proposed addition
will be -61’ from ordinary high water level. If this variance is approved, we will also relocate and upgrade the existing
septic system (from 750 gal to -1500 gal). The audience was polled with no one speaking for or against the variance
as requested. Letters from Keith and Lori Hanson, Terry Jensen, Barbara and Dick Nelson, and Scott Rocholl in
support of the variance as requested was read for the record. After discussion and consideration, Michael Harris
made a motion, second by Paul Larson and unanimously carried, to approve a variance of 39’ from the required
ordinary high water level setback of 100’ for an addition to an existing cabin located approximately 6T from the
ordinary high water level as described in the variance application dated July 23, 2014 and as depicted in the drawing
dated July 22, 2014. The proposed development will not obstruct the view from the adjacent properties. Proposed
development will be placed to the side and behind the existing development. The hardship/practical difficulty is the
terrain.
Paul A. Hayden - Variance application approved as requested. (7:50 p.m.)
Paul A. Hayden, Reserve Lot A Block 1 Larsen’s Minasha-Da Subdivision, Dead Lake in Dead Lake Township,
requested the following; Request variance from setback requirement of 200’ to 100’ at closet point attaching building
to existing structure which was granted a variance in 1988. The audience was polled with no one speaking for or
against the variance as requested. Milt Paulson represented the applicant at the public hearing. Mr. Hansen, a
potential property owner, also appeared at the public hearing. After discussion and consideration, David Wass made
a motion, second by Thomas Lee and unanimously carried, to approve a variance of 100’ from the required ordinary
high water level setback 200’ for an addition to an existing structure 100’ from the ordinary high water level at the
closet point as depicted on the drawing submitted with the variance application. The proposed development will not
obstruct the view from the adjacent properties. The variance as approved does not directly or indirectly grant any
other variances for the proposed development or for any future development.
Holly Matson - Variance application approved as requested. (7:56 p.m.)
Holly Matson, Government Lots 6, 7 and 8, Section 5 of St. Olaf Township by Johnson Lake, requested a variance of
50’ to build a new dwelling and garage at 150’ from ordinary high water level (to be no closer than existing structure).
Gary Schroeder appeared with the applicant at the public hearing. The audience was polled with no one speaking for
or against the variance as requested. After discussion and consideration, Michael Harris made a motion, second by
Paul Larson and unanimously carried, to approve a variance of 50’ from the required ordinary high water level setback
of 200’ for the construction of a dwelling and garage 150’ from the ordinary high water level. The proposed
development will be no closer to the ordinary high water level than the existing structure. The hardship/practical
difficulty is the extreme high water level on Johnson Lake.
Doug Gullekson - Tabled (8:00 p.m.)
Doug Gullekson, part of Government Lot 9, Section 36 of Dora Township by Round Lake, requested the following:
Storage shed will be short of road right-of-way setbacks or property and lake shore setbacks, new trailer will be short
of lake shore setbacks but same as old one.
Shed Option # 1 - request a variance to place shed 6’ from property line and approximately 48’ from ordinary high
water level (no closer than existing dwelling).
Shed Option # 2 - request a variance to place shed 8’ from road.
Also request to replace existing dwelling with new double side in same location. Approximately 48’ from ordinary high
water level. The audience was polled with no one speaking for or against the variance as requested. After discussion
and consideration, Thomas Lee made a motion, second by Paul Larson and unanimously carried, with the applicant’s
verbal permission, to table this public hearing until the September 11, 2014 meeting so that the applicant’s request
can be modified to include a request to have the property declared buildable.

high water level setback of 100’ and a variance of approximately 3’ from the required shore
impact zone setback of 50’ for the construction of a roof over an existing 11 ’ by 13’ deck
located approximately 57’ from the ordinary high water level. The property is described as part
of Government Lot 9, Section 36 of Dora Township by Round Lake.. Cyril Palubicki
represented the applicant at the public hearing. The audience was polled with no one speaking
for or against the request. After consideration, motion was made by Cecil Femling, seconded
by Craig Anderson and unanimously carried, to deny the variance as requested as no adequate
hardship had been shown and the granting of the variance would advance the structure towards
the ordinary high water level.
Anton Schreiner - Approved
Anton Schreiner, Fargo, ND, requested a variance of approximately 66’ from the required
ordinary high water level setback of 100’ and a variance of approximately 16’ from the required
shore impact zone setback of 50’ for the addition of a second story to an existing structure
approximately 34’ from the ordinary high water level. The property is described as part of
Government Lot 1, Section 33 of Dunn Township by Lake Lizzie. The audience was polled with
no one speaking for or against the request. After consideration, motion was made by John
Everts, seconded by Cecil Femling and unanimously carried, to approve a variance of
approximately 66’ from the required ordinary high water level setback of 100’ and a variance of
approximately 16’ from the required shore impact zone setback of 50’ for the addition of a
second story to an existing structure approximately 34’ from the ordinary high water level. It
was noted that the original structure has a flat roof and that the second story addition will be no
closer to the ordinary high water level than the original structure.
Arthur J. Miller - Approved
Arthur J. Miller, Fergus Falls, MN, requested a variance to subdivide a parcel of less than 2.5
acres from an existing 130.24 acre parcel. The tract would be approximately 1 acre. The
property is described as part of the East Half of the Southwest Quarter and part of the East Half
of the Northwest Quarter, Section 28 of Fergus Falls Township. Willis Roehl appeared along
with the applicant at the public hearing. The audience was polled with no one speaking for or
against the request. After consideration, motion was made by Cecil Femling, seconded by
Randall Mann, and unanimously carried, to approve the subdivision of a one acre parcel from
an existing 130.24 acre tract with the condition that a registered surveyor’s drawing and a letter
from the adjacent property owners stating that there is no dispute with the proposed lot lines
must be provided at the time of recording. It was noted that the proposed parcel would have
public road access and that no remnants would be remaining after the subdivision. The
applicant’s request is reasonable when considering the other development in the immediate
area.
Todd J. Baribeau - Approved
Todd J. Baribeau, St. Paul, MN, requested a variance of approximately 140’ from the required
ordinary high water level setback of 200’ and a variance of approximately 40’ from the required
shore impact zone setback of 100’ for the construction of a 30’ by 32’ cabin approximately 60’

As per our phone conversation of the above date, enclosed
is a copy of the denial of variance on our property at
Round Lake,, Dent, Minnesota.
Perhaps it is a matter of semantics or the fact that I do
not understand the terminology, but I cannot see how
putting on a roof over the existing deck (which has been
there since 1979) would "advance the structure towards the
ordinary high water level",
I am enclosing a photograph of our trailer showing the
large oak tree which hangs over the deck. We really do
not wish to cut down the tree because of the shade it
provides, but on the other hand the falling acorns, debris, etc. (especially when the squirrels are about) deny us the
pleasure of eating outdoors when we have guests. The
trailer is rather small to entertain more than four persons
inside. One of the main attractions for us is being on the
lake and enjoying the view. Another problem about not having
a roof is that it seems no matter how often you sweep them
up, the acorns can create a hazardous situation if you do
not watch where you are stepping, especially for small
children and the elderly.
We had previously tried putting up a motor home type canvas
awning, but unfortunately we left town for two days and forgot
to roll it up. A storm came thru and tore it from the mounting,
so it is not very practical.
Perhaps we'll invite you all for dinner when we're in
residence and you can better judge our plight. We thank
