Applicants understand the concerns and have already taken steps to address these concerns. They have installed 300 linear feet of fencing in order to keep the dogs confined at all times. They have also purchased bark collars for many of the dogs and are in the process of purchasing bark collars for all the dogs to mitigate any sounds from barking. Additionally, there was one dog that tended to try to leave the property. That dog unfortunately had to be put to sleep. .1 Applicants are also in the process of taking the following steps to address concerns raised by their neighbors; Applicants will erect a privacy fence between the shepherd kennel and the neighboring property. Applicants will also be completely fencing in the area that the dogs are in when they are outdoors so that none of the dogs will ever be free to leave the property. Additionally, applicants will be insulating the inside of the kennei to eliminate noise when the dogs are inside. Further, applicants have installed indoor radios in the kennels so the dogs cannot hear outside ambient noises and react with barking. Applicants will also be installing heavier gauge runs to better faciiitate the dogs coming to and going from their kennels. In addition, applicants will be planting extensive shrubs, trees, and other vegetation to provide natural barriers between their property and the properties around them to further eliminate any noise from their animals and increase the aesthetic appeal of the property. Additionally, applicants keep their puppies inside the kennels at all times and seli the puppies when they are eight (8) weeks old at the latest. Further, applicants remove their dogs’ waste from the property on a weekly basis and permit no odors nor unsightliness to linger. Lastly, as appeared to be successful this past fall, applicants plan to keep their dogs indoors during upcoming deer hunting seasons so as not to affect the neighboring wildiife. Appiicants have a passion for taking excellent care of their dogs. To them, the dogs are family. It is the applicants’ hope that gaining insight into the plans and steps already taken by the applicants and their commitment to making sure the neighborhood is informed and that the area remains a tranquii and enjoyable environment for aii those who call it home, will alleviate any concerns about the application for a permit. The Shoreland Management Ordinance considers Agriculture as a permitted use; therefore, a Conditional Use Pemriit is not required. Acceptance of Withdrawal: The Planning Commission accepted the modified request to withdraw the Conditional Use Permit Application for a Comrnercial Use (dog kennel) and acknowledged the proposed use for breeding dogs as a perniitted use (Agriculture) per the Shoreland Management Ordinance. Applicants understand the concerns and have already taken steps to address these concerns. They have installed 300 linear feet of fencing in order to keep the dogs confined at all times. They have also purchased bark collars for many of the dogs and are in the process of purchasing bark collars for all the dogs to mitigate any sounds from barking. Additionally, there was one dog that tended to try to leave the property. That dog unfortunately had to be put to sleep. Applicants are also in the process of taking the following steps to address concerns raised by their neighbors: Applicants will erect a privacy fence between the shepherd kennel and the neighboring property. Applicants will also be completely fencing in the area that the dogs are in when they are outdoors so that none of the dogs will ever be free to leave the property. Additionally, applicants will be insulating the inside of the kennel to eliminate noise when the dogs are inside. Further, applicants have installed indoor radios in the kennels so the dogs cannot hear outside ambient noises and react with barking. Applicants will also be installing heavier gauge runs to better facilitate the dogs coming to and going from their kennels. In addition, applicants will be planting extensive shrubs, trees, and other vegetation to provide natural barriers between their property and the properties around them to further eliminate any noise from their animals and increase the aesthetic appeal of the property. Additionally, applicants keep their puppies inside the kennels at all times and sell the puppies when they are eight (8) weeks old at the latest. Further, applicants remove their dogs’ waste from the property on a weekly basis and permit no odors nor unsightliness to linger. Lastly, as appeared to be successful this past fall, applicants plan to keep their dogs indoors during upcoming deer hunting seasons so as not to affect the neighboring wildlife. Applicants have a passion for taking excellent care of their dogs. To them, the dogs are family. It is the applicants’ hope that gaining insight into the plans and steps already taken by the applicants and their commitment to making sure the neighborhood is informed and that the area remains a tranquil and enjoyable environment for all those who call it home, will alleviate any concerns about the application for a permit. ’ • k! Our biggest concern, at this point, is whether they will continue to follow through with their promises once they have the permit in hand. The new Permit Application Request states that the existing number of adult dogs is (20). We were present at the February 14 Public Hearing when one of the neighbors asked the Scotts how many adult dogs they had at that time, and their answer was (11). The new request already shows an increase of (9) dogs even though they have not yet received a permit. If they receive the permit, who is going to monitor their operation to make sure they remain in compliance, and, if the neighborhood has future unpleasant experiences related to the kennel operation, what recourse would we have? It is unfortunate that, due to their previous lack of consideration for the neighborhood, we simply do not trust them to follow through with the conditions set forth in the Permit Request. Currently they have 5 dogs residing at their residence and they want to now increase their amount of dogs to 20 and put in larger kennels for the dogs. These 5 dogs that they currently own are a nuisance on a daily basis. They bark at all hours of the day loud enough to disturb us and residing neighbors'. They have purchased bark collars, for them and they only work part of the time. Just the other day one of my neighbors was walking to the mail box and their dogs barked at her all the way to the mail box. They didn't stop barking until Steve finally came out and shocked them to be quite. Their barking has disturbed family gatherings so much that when we walk through the woods we are not sure if the dogs are safe or dangerous, and besides not knowing if they are running in the woods with or without supervision. The dogs have also disturbed my hunting conditions on my own property, with their constant barking. They are so loud at times that it keeps game animals who would normally travel through the woods during hunting season to choose a different path due to the noise. I'm also concerned with that many dogs on the premise who is taking care of them on a regular basis. Every time I go to town, no matter the time of day I see their vehicle parked on the street in town. Keeping them locked up in the kennels are not good for the dogs either. If the dogs need to play do they let them run loose or do they have a supervised area for them to play in? Also with that many dogs so close to the lake, what kind of smell and poop and urine will do to the lake environment. We as a community thrive to be environmental conscious, where would they be putting all that extra poop and will it seep into the lake at some point. They have had constant noise violations served on them, because of the noise. By adding more dogs it will not keep the noise down and will disturb the neighbors, who live there and the ones who come up to the lake for a weekend getaway from the hustle and bustle of the cities. At the meeting of the Planning Commission my clients were made aware of some of the concerns of their neighbors. They would like to take this opportunity to address those concerns and let you know about the steps that they have taken and additional steps they will be taking to mitigate the concerns raised. The primary concerns were noise from barking, dogs being permitted to wander the area, and waste being permitted to accumulate on the property. The Scotts understand your concerns and have already taken steps to address these concerns. They have installed 300 linear feet of fencing in order to keep the dogs confined at all times. They have also purchased bark collars for many of the dogs and are in the process of purchasing bark collars for all the dogs to mitigate any sounds from barking. Additionally, there was one dog that tended to try to leave the property. That dog unfortunately had to be put to sleep. The Scotts are also in the process of taking the following steps to address concerns raised by their neighbors, They will erect a privacy fence between the shepherd kennel and the neighboring property. The Scotts will also be completely fencing in the area that the dogs are in when they are outdoors so that none of the dogs will ever be free to leave the property. Additionally, they will be insulating the inside of the kennel to eliminate noise when the dogs are inside. Further, the Scotts have installed indoor radios in the kennels so the dogs cannot hear outside ambient noises and react with barking. The Scotts will also be installing heavier gauge runs to better facilitate the dogs coming to and going from their kennels. In addition, the Scotts will be planting extensive shrubs, trees, and other vegetation to provide natural barriers between their property and the properties around them to further eliminate any noise from their animals and increase the aesthetic appeal of the property. Additionally, the Scotts keep their puppies inside the kennels at all times and;sell the puppies when they are eight (8) weeks old at the latest. Further, the Scotts remove their dogs’ waste from the property on a weekly basis and permit no odors nor unsightliness to linger. Lastly, as appeared to be successful this past fall, the Scotts plan to keep their dogs indoors during upcoming deer hunting seasons so as not to affect the neighboring wildlife. The Scotts have a passion for taking excellent care of their dogs. To them, the dogs are family. It is our hope that gaining insight into the plans and steps already taken by the Scotts and their commitment to making sure the neighborhood is informed and that the .area remains a tranquil and enjoyable environment for all those who call it home. I purchased the 23 acres of property in 2006 because of the ideal location for peaceful and private surroundings yet close proximity to Star Lake and other public amenities. In the three years Steve and Rebecca have owned the adjacent property we have encountered nonstop dog barking. I have called in noise complaints for dogs barking at least three times. The most serious incident/police report was in October of 2017 when one of their German Shepherds became loose and chased me down on my own property forcing me to defend myself with a shovel. They called and called for the dog, but had no control over him as the dog continued to circle me as I tried to walk up the driveway and get to the safety of the cabin. My girlfriend and I have been fearful of this dog for years, as he has been loose on 3 different occasions and has come on our property, barking and teeth bared, even though the Scott's yell his name over and over again. In this October incident the Ottertail County Sheriff's Deputy (Joe Aksnes) came to the scene after they gained control of the dog. He spoke with us and then with them. They ended up putting this particular dog down. My adjacent neighbors have called in nuisance barking numerous times as well With the incessant barking it has drastically impaired our enjoyment of the property and has diminished the free and unaltered range of wildlife we had previously enjoyed watching and hunting. I do not trust the Scott's ability to maintain control over the number of dogs they have currently, let alone adding more with expanded kennels. I respect free enterprise however myself and so many of the neighbors are already frustrated to no end with the barking and current lack of respect for other's privacy. We advocate for peaceful relaxation on property we have all worked hard to acquire and enjoy peacefully. I have fully read through the proposal and personally don't see any issues with the impervious surface request. My primary concerns are with noise, animal control, and dog feces waste. The Scott's property is within Lake Shore Management setbacks which implies population density. The plan outlines privacy fences which need to be installed already today. The dogs they have now instantly bark when anyone moves or makes a noise on my property. These 5 dogs that they currently own are a nuisance on a daily basis. They bark at all hours of the day loud enough to disturb us and residing neighbors'. Their barking has disturbed family gatherings when our kids and their families are up for a visit, so much that when we walk through the woods we are not sure if the dogs are safe or dangerous, and besides not knowing if they are running in the woods with or without supervision. The dogs have also disturbed my hunting conditions on my own property, with their constant barking. They are so loud at times that it keeps game animals who would normally travel through the woods during hunting season to choose a different path due to the noise. I'm also concerned with that many dogs on the premise and so close to the lake, what kind of smell and poop and urine will do to the lake environment. We as a community thrive to be environmental conscious, where would they be putting all that extra poop and will it seep into the lake at some point. They have had constant noise violations served on them, because of the noise. By adding more dogs it will not keep the noise down and will disturb the neighbors, who live there and the ones who come up to the lake for a weekend getaway from the hustle and bustle of the cities. My family and I'm sure the surrounding neighbors and their families would want to enjoy a nice night around the campfire roasting marshmallows and telling stories than trying to do all that over the barking of the dogs at the neighbors. We strongly oppose granting this request as we have property just west of the Scotts at 32025 Hwy 108 and have experienced barking at all hours of the day and night. Our property borders theirs on the east side. We are staunchly AGAINST the expansion of their existing kennels. The dogs they have now are a constant nuisance with their continual barking at all hours of the day and night and the volume would increase X4 if this permit were approved. With 30 adult breeding dogs and 16 boarding dogs, there could easily be over 100 dogs at any one time when you include puppies. What would they do with all of the waste that these dogs would produce? I stay in a cabin most of the summer months directly behind the Scott's about 1/2 mile from their property. In my perception, they have proven to be irresponsible dog owners in various ways. Their dogs bark continually. We have called the Ottertail County Sheriff's Dept several times to complain. However, the most egregious situation happened last summer when one of their German Shepherds got loose and circled my boyfriend in our yard as he protected himself with a shovel. This lasted fro 7-10 minutes. They called and called for the dog, but had no control over him as he continued to circle Terry as he tried to walk up the driveway and get to the safety of the cabin. We have been fearful of this dog for years, as he has been loose on 3 different occasions and has come on our property, barking and teeth bared, even though the Scott's yell his name over and over again. The Ottertail County Sheriff's Deputy (Joe Aksnes) came to the scene after they gained control of the dog. He spoke with us and then with them. They ended up putting this particular dog down, but I do not trust their ability to maintain control over the number of dogs they have currently, let alone adding more to the kennels. I feel strongly that they are not capable of controlling the dogs, let alone the barking that is incessant. We, along with several of our neighbors, enjoy the peace and quiet of the lake and also use our property to deer hunt and duck hunt. We feel that the constant barking has impeded our sense of a peaceful lake retreat, not to mention our hunting. I am opposed to this permit and would like this email added to the number of letters I'm sure you will receive from other neighbors. Thank you. We can only imagine how the barking noise will be magnified if they are allowed to board and breed up to 30 or 40 more dogs!! Their location on the hill above the bay causes the barking sound to carry across the lake. We have heard their dogs barking as far as out by the island in the middle of the lake. We also have concerns about this being a commercial operation, whether the Scott property will need to be re-zoned for commercial use, and if that will affect our property taxes. We already know that having a dog kennel across the road will make our propery harder to sell, should we ever want to sell it. There are also concerns about how the dog waste will be disposed of, where the run-off will go when the kennels are cleaned, and how all that will affect the lake water, nearby ground water, and probably other environmental concerns we haven't even thought of yet. A dog boarding/kennel facility would adversely affect so many nearby neighbors, people using the public access across the highway and people enjoying a quiet day fishing on Star Lake.
