Fritzgibbon opposing the granting of the variance request was read for the record. Patricia Scott - Approved Patricia Scott, Wahpeton, ND, requested a variance of 26' from the required ordinary high water level setback of 75' for the construction of an 8' by 24' addition to an existing dwelling 49' from the ordinary high water level. After consideration, motion v/as made by Bert Olson, seconded by Dan Oehler and unanimously carried, to approve a variance of 26' from the required ordinary high water level setback of 75' for the construction of an 8' by 24' addition to an existing dwelling. The addition will be no closer to the lake than the existing dwelling. Steven J. Henry - Approved Steven J. Henry, Pelican Rapids, MN, requested a variance to split an existing 2.7 acre parcel into two tracts of less than 2.5 acres. One parcel would have a minimum of 80,000 square feet and a lot width of approximately 500'. The other parcel would have approximately 37,600 square feet of area. The smaller parcel would be deeded to an adjacent property owner. The property is described as part of Government Lots 3 and 4, Section 27 of Dunn Township on Franklin Lake, Steven Kantrud represented the applicant at the hearing. After consideration, motion was made by Craig Anderson, seconded by Cecil Femling and unanimously carried, to approve the variance as requested with the conditions that a registered surveyor's drawing and a letter stating that there are no property line disputes will be provided at the time of recording. Paul Michael Hermes - Approved Paul Michael Hermes, Fergus Falls, MN. requested a variance of 3 r from the required ordinary high water level setback of 100' for the construction of a 12' by 48' addition to an existing dwelling 69' from the ordinary high water level. The addition would have a deck added on the top which would have a 3' railing around the entire deck. The property is described as Lots 4, 5 and 6, White Swan Beach, Swan Lake in Dane Prairie Township. Peter Hermes represented the applicant at the hearing. The audience was polled with Nella and Odin Johnson speaking against the request. After consideration, motion was made by John Everts, seconded by Craig Anderson and unanimously carried, to approve construction up to what the string line test would permit and any excavation plans for the proposed construction must be reviewed and approved by the Land and Resource Management office. The granting of this variance allows the applicant to enjoy the same rights and privileges as his neighbors. Charles Ponto - Approved Charles Ponto, Frazee, MN. requested a variance of 3' from the 18' maximum height requirement of a non­ dwelling structure (one story) for the construction of a 50' by 100' building with a height of approximately 21', The property is described as part of Government Lot 6. Section 27 of Hobart Township on Long Lake, The audience was polled with no one speaking for or against the request. After consideration, motion was made by Cecil Femling, seconded by Dan Oehler and unanimously carried, to approve a variance of 3' from the 1 8' maximum height requirement of a non-dwelling structure for the construction of a 50' by 100' building with a height of approximately 21'. Plats: Written notice shall be sent to the property owners of record within one half (1/2) mile of a proposed subdivision. Written notice shall also be sent to the Town Board. of the Township wherein the proposed subdivision lies, the governing body of any city or village of which the Incorporated limits lie within two (2) miles of the proposed subdivision and the Commissioner (must Include a copy of the proposed subdivision), written notice provided for the above shall be given not less than fourteen (14) days prior to the date the Planning Commission will consider said subdivision, although failure of any property owner to receive such notification shall not Invalidate the proceedings. A copy of approved amendments and plats and final decisions granting Variances or Conditional Uses under local shoreland management controls must be sent to the Commissioner and postmarked within ten days of final action. * The F. Amendments: This Ordinance may be amended In whole or In part by the Board of County Commissioners after proper public hearing conducted by the Planning Commission and as provided In Minnesota Statues 394.2S. 9. Enforcements And Penalties: A. This Ordinance shall be administered and enforced by the Administrative Officer who Is hereby designated the enforcing officer. B. Any violation of the terms and provisions of this Ordinance shall constitute a misdemeanor. All fines paid for violations shall be credited to the County General Revenue Fund. Each 24-hour day that a violation continues shall constitute a separate offense. C. In the event of a violation or a threatened violation of this Ordinance, the County Board and/or the Administrative Officer, in addition to other remedies may Institute appropriate actions or proceedings to prevent, restrain, correct or abate such violations or threatened violations, and It shall be the duty of the County Attorney to Institute such action. This .will Include, but not be limited to, actions for Injunctive relief before a court of competent jurisdiction. - D. Any taxpayer or taxpayers of the County may Institute mandamus proceedings In District Court to compel specific performance by the proper officer or officers of any duty required by this Ordinance. E. All employees of the Otter Tall County Land and Resource Management Office, members of the County Board of Commissioners, Planning Commission and Board of Adjustment, In the performance of their duties, shall have'free access on all land Included In Shoreland Management use districts. F. All public bodies of water not specifically designated or enumerated In "Waters of Otter Tall County Classification" are hereby given the classification of Natural Environment. G. Effective Date This Ordinance as amended shall be In full force and effect on and after February 5, 1992. Construction not completed on February 5, Is considered a new construction and shall 1992, without a conform to allpermit, requirements of this Ordinance.
