Motion by Rogness, second by Huebsch, and unanimously carried to approve payment of the County
Board bills per Attachment A of these minutes.
Planning Commission Recommendations
Preliminary Plat - "Miller’s Buchanan Oaks”. Mary D. Banz & Greg Miller:
Motion by Erickson, second by Rogness, and unanimously carried to deny the proposed Preliminary
Plat known as “Miller’s Buchanan Oaks” consisting of two single family residential lots for the reasons
stated in the November 17, 2010, Planning Commission minutes. The property is described as Lot 6
Block 1, Buchanan Oaks, Section 35 of Rush Lake Township; Buchanan Lake (56-209), GD.
Conditional Use Permit - Man/in & Ann Hexum:
Motion by Huebsch, second by Erickson, and unanimously carried to approve a Conditional Use
Permit for operation of a Bar & Grill (short-order food) based on the revised plan dated October 28,
2010. The property is described as Lots 4, 5 ex trs and ex platted. Sec 24 of Dora Township; Big

Conditional Use Permit - Robert O. Leaders Tst:
Motion by Huebsch, second by Lindquist, and unanimously carried to approve a Conditional Use
Permit for an After-The Fact earthmoving request subject to conditions as recommended by the
Planning Commission which includes partial project restoration. The property is described as Pt of
GL 4 (.65 AC), Section 18 of Leaf Lake Township; West Leaf Lake (56-114), RD.
Request from US Fish & Wildlife Service
On behalf of the USFWS, Land & Resource Director, Bill Kalar, requested an exemption to Otter Tail
County’s grade and fill permit requirement when the USFWS is working on wetland restoration
projects. No support was expressed for a change in the Shoreland Management Ordinance. No
action was taken.

A Conditional Use Permit Application (as stated by the Applicant on the Application): Request
permit to fill in washed out area approx. 25’ x 40’ with washed sand, in front of camper.
Need to maintain flat surface due to sons handicap. Unlevel surface has him to fall
backwards due to seizures. Since last permit to fill excessive erosion from heavy rains
running down road created large gulley in middle of lot. We have owned lot for thirty seven
years and always had a sandy beach. This is an After-The-Fact request. The property is
described as Silent Point Lot 1, Section 31 of Dora Township: West Silent Lake (56-519),
RD.
Motion - October 13, 2010: A motion by Kinzier, second by Gill to table (at the Applicant’s
request) to November 17, 2010 to allow the Applicant time to provide a detailed plan. The
plan must be submitted to Land & Resource Management by October 29, 2010.
Jyles & Bernice represented the Application.
Motion: A motion by Trites, second by Boyer to table (at the Applicant’s request) to
December 8, 2010, allowing the applicant to provide a plan that Includes establishment of
vegetation and reduces the erosion into the lake, must be approved by Land & Resource.

A Conditional Use Permit Application (as stated by the Applicant on the Application): A 60 x 50
structure, for the purpose of a short order Food, Bar & Grill and seating for 60, open 7 days
a week from 7 A.M. - 10 P.M., year around, 4’ x 10’ sign on building (unlit). (5 acres to be
separated from Parcel #16000240139000. If approved - earthmoving plan to be applied for
upon approval of commercial use.) The property is described as Lots 4, 5 ex trs and ex
platted, Sec 24 of Dora Township: Big McDonald Lake (56-386), RD.
Motion - October 13, 2010: A motion by Trites, second by Maske to table (at the Applicant’s
request) to November 17, 2010, to allow the Applicant time to provide details, including: 1.
Pedestrian traffic. 2. Lake access and highway crossing. 3. Structure details including
outside seating. 4. Plot plan identifying the layout onsite, 5. Site visibility. 6. Identification
of any proposed outside lighting.

Arlyn Foss indicated he was not against the project, but expressed concerns regarding
assurance of the proposed 10:00 P.M. closing, and it becoming a liquor establishment.

revised October 28, 2010 plan. Voting: All members in favor.
“The Palms of Lida First Addition” / Q5 Inv. LLLP - No formal Action:
Bruce Qvammen (Q5 Investments, LLLP) & Scott Walz (Surveyor) addressed the Planning
Commission regarding the September 20, 2006 Planning Commission approval of “The
Palms of Lida First Addition”, Lake Lida (56-747), GD. Condition #2 stated: “Lot 25 Block 1
shall be a Non-Residential backlot which is to be owned by an owner’s association: prior to
approval for construction of any storage unit(s), the design must be reviewed by this
Commission.” The Commission reviewed a revised plan showing that the storage units
would be located on part of Lot 20 & all of Lots 21, 22, 23 & 25, Block 1 these storage units
would be owned by Bass Harbor Owners Association (not only individuals in the
development). No formal action was taken, it was recommended that the developer provide
a plan and discuss it with Bill Kalar (Land & Resource) and David Hauser (County Attorney).

Arlyn Foss agreed with the concerns in the correspondence that was read, and spoke
against the request. Lori Meder indicated that in addition to the concerns identified in their
letter, she had concerns regarding an increase in cost to & need of law enforcement. David
Leonard expressed concerns regarding use of alcohol, traffic and noise. Charlotte
Anderson indicated that she agreed with the comments and spoke in opposition to the
request being so close to her cabin. Nona King indicated she agreed with all of the
opposition that has been expressed. Joann Sather spoke in favor of the request, has not
had any problems in living near a bar in Dent, stating it would be convenient to have this in
the area. Mike Meder questioned who was in business with the Hexum’s (Chairman
indicated this is not relevant).

Bev Honkola & Joseph Lawson (Little Pelican Lake (56-761) - Removal of Condition:
Bill Kalar spoke to the Commission regarding a request from Joseph Lawson to remove the
requirement of a retaining wall as being a condition of the approval on June 9, 2010.
Motion: A motion by Gill, second by Kinzier to allow the project without the requied rip rap,
provided the banks can be stabilized with a vegetative cover. Voting: All members in
favor.

In regards to hearing on Bar & Grill for Marvin & Ann Hexum on Big McDonald Lake
Road.
We are not in favor of this land becoming commercial for the purpose of a Bar & Grill.
We have concerns with the increased traffic year round, decrease in property values,
safety of walkers and kids and increased noise.

Dear Mr. Olson:
As a seasonal lake property owner on Charlie Trapp Road, >ve would like to voice our opposition to the
proposed conditional use pcnnil application request by Marvin and Ann Hexum for a short order food, bar, and
grill. We have enjoyed die qu.ici tranquility of West McDonald Lake since purchasing the property in October
19S9. Since this time, there has been little change in the surrounding area until the Hexum's built their vacation
rental properly adjacent to the proposed bar and grill site. The rental property Ills nicely widi the relaxed
atmosphere of the area.
Our concern and opposition with the Hexum’s conditional use permit is outlined below;
1. Traffic - ,A. short order food, bar, and grill facility woald increase traffic on the access road from
Highway lOS and around the area known as "Turtle Pond" to lake residents. "Turtle Pond" is a high-
traffic area for pedcsinans. bicyclists, ATVs, and golf caits. We would not feel as comfortable letting
our children go around '’Turile Pond" alone and probably avoid the cntraiice/c.xii ai.'ea altogether. Also,
having this located approximately 1 Vi miles off ofHigliway lOS w-ouldmcan patrons, employees,
service, and delivery vehicles will be using the windy lake road. This is a definite safety concern -
especially arnighi.

As residents of West McDonald Lake since 1973, it is our judgment that a facility as described in the
Permit Application request by Marvin and Ann Hexum to build a bar and grill on Engstrom Road would do
nothing to enhance the environment of the McDonald Lake homeowners.
On the contrary, it would, in our opinion, degrade a beautiful, peaceful environment that we now

Engstrom Beach Road. 1 am concerned about the noise, i.e. cars starting, doors shutting
and people talking that this proposed establishment would create. Certainly, no outside
music should be allowed. Also, there would obviously be increased traffic coming off of
Highway 108. Many residents walk and ride bicycles on this road. They could no longer
safely do this. I have for 37 years driven 640 miles three to four times a year to enjoy the
peace and tranquility of my lake home at 42638 Engstrom Beach Road. This area to me
is residential and agriculture, and not a place to locate a commercial establishment such

This is concerning the conditional use permit request for above mentioned
property. For this property to be used as a Bar & Grill in a family orientated
neighborhood is ridicules. Not only will this increase traffic on a very narrow township
road, but some of that traffic will be drivers with too much alcohol in their systems. A
number of people jog along this road as well as young children driving golf carts. Many
adults allow their children to drive golf carts, which are not licensed for travel on a
township road. We believe an eating establishment would entice children to take these
golf carts even further from the lake shore roads. We also feel there are plenty of eating
establishments nearby that offer similar food and beverage. There does not appear to be
any good reason to add a commercial establishment to an otherwise quiet family setting.
Engstrom Beach Road is a dead end road which normally would deter people from using
it. We are concerned an eating establishment would bring in people that would not
otherwise even know there are multiple lake homes that are vacant during the winter.
This in turn could lead to vandalism and theft of those unprotected properties.

Dear Commissioners:
As landowners of 33923 Charlie Trapp Road and of 33975 Happy Drive, we are opposed to the
granting of a conditional use permit. Our Charlie Trapp Road property is directly across the road
from the proposed site and our Happy Drive property has direct line of site to this property. Our
reasons for opposition are outlined below.
1. Increased Traffic:
a. In order to make the bar and grill profitable, Hexum's will need to bring people into this
area from all over. This will bring in people who have no other reason to be in the area
except to consume alcohol.
b. All roads on which the lake homes are on in this area are no outlet roads. Many
patrons of the bar will most likely decide to explore the area after they have consumed
alcohol "just to see what's down here."
c. These roads are heavily used by children walking, riding bikes, and riding scooters.
There is also heavy foot traffic as residents of the area and their guests take walks and
run for exercise. Currently, residents feel their children are safe and know that the rest
of the community watches out for them. The foreign traffic brought into this area by
the Hexum bar will destroy this safety and freedom we currently enjoy and for which
we all pay hefty taxes to have.
d. The increased traffic will also include commercial trucks for food and alcohol deliveries
and garbage pickup. Inevitably, a driver will miss the driveway to the bar and decide
that our Charlie Trapp Road property will do for turning around. Or these large trucks
will have to drive down to either cul-de-sac and try to turn around.
e. These roads are built for only one vehicle at a time. This increases the risk of accidents
or property damage because vehicles going in the opposite direction will have to move
out of the way by backing up or pulling off the road. Backing up increases the risk of
accidents and possibly running over someone. Pulling off the road means going onto
other people's property. It also means that residents of the area cannot feel safe with
their children, walkers, runners, etc. because of a new risk of being struck by these
large vehicles.
f. With the increased traffic on these roads, the costs of road repairs and maintenance will
increase for the townships. This is a direct impact to our property taxes.

g. With increased traffic on the main road into the area, the county and the Dent EMT will
see increased costs in law enforcement and emergency medical response. The main
road contains several sharp curves with the road flanked by water. There will be an
increase in accidents from those who are consuming alcohol and then driving out of this
area. ,
h. The county will experience an increase in 911 calls as residents experience vandalism
and thefts resulting from bringing in outside ^traffic with the only reason for being there
is to consume alcohol.
i. This is particularly concerning during the winter months when many homeowners are
absent for several months at a time. As owners directly across from the proposed site,
this is a major concern for us as we have 32 x 100 foot shop and a private two-hole
golf course. During the winter, snowmobilers will more than likely take advantage of
our open 5 acres, and destroy our golf course. After the snowmobilers have a bump at
the bar someone will decide to see what's in the shop! We are snowmobilers ourselves
so we are not opposed to snowmobilers in general - just those that drink and drive and
destroy other people's property.
j. Snowmobilers will also exit the lake at any property along this area that appears to be
any easy way off the lake. This will cause damage and or destroy parts other people's
property as well. Remember, we all pay a lot of taxes for our properties and the
privilege of enjoying beautiful West McDonald Lake and Big McDonald Lake.
2. Zoning as Commercial:
a. If this conditional use permit is granted, this will only be the beginning of
commercializing the area. What's next, a hotel; a multiplex rental unit?
b. Commercializing of this area will devalue our property and those around us. This
means fewer taxes for the county. It means losses for the owners when they need or
want to sell. It means more difficulty in selling property.
c. Our neighbors and us spend a great deal of money to have these homes to get away
from commercialism.
3. The Life of a Bar in Rural Minnesota
a. The likely hood of this bar being profitable enough in the hours of operation as stated is
slim. This means that the Hexum's will find it necessary to increase their hours and will'
probably do so up to the state mandated closing time.
b. With the ban on smoking in public entities, there will be smokers standing outside to
smoke. They will probably go for a walk along our roads to have a smoke. Of course,
they will flick their cigarettes and other garbage like beer bottles into the protected wet
lands across the road from the bar, throw their cigarettes and other garbage into the
ditches, or onto our property or others property. Cigarettes not completed extinguished
will increase the risk of fire particularly in the ditch and wooded areas along the road.
c. The stink of grease from the fried cooking is grossly unappealing. So are the barrels of
grease, beer boxes, and garbage dumpsters that we will look at from our shop or from
our lake home on Happy Drive.
d. When the Hexum's realize the bar is not profitable, they will sell it. Typically, when this
happens, it starts a string of owners who can't make any money from it. The building
will become dilapidated because there isn't any money for building maintenance. The
crowd attracted by the various owners simply becomes less and less desirable
particularly in a family oriented community like ours here on West and Big Mac.
e. All in all this will become a pollution generking business from vehicle exhaust, cigarette
smoke, vented kitchen smells, and garbage.
Recapping, our primary reason for opposition is the safety of our children. We feel perfectly at ease
allowing our children to go to our golf course and shop without us. With a drinking establishment
directly across the road, we will not be able to allow them the freedom and assure the safety they
enjoy now. We will also no longer feel it safe for them to ride their bikes and scooters around due to
, the increased traffic that will include drunk drivers.
This greatly devalues the land for us from an enjoyment and a monetary perspective. We will
experience increased trespassing on our property for which we will call the sheriff EVERY TIME. We
also will not hesitate to call 911 to inform county law enforcement of bar patrons who have been
perched at the bar for quite some time and are more thari likely driving while intoxicated.
Other reasons include increased crime, property; damage, pollution, noise, and repulsive smells.
The idea of bar being allowed in this area and in this particular location literally makes us ill. The
shattered, peace and tranquility that is so coveted by us and our neighbors will be destroyed.
We hope that you take our concerns seriously when making your decision on this conditional use
permit.

Some of our concerns:
Our road (Engstrom Beach Road) has steep grade hills and some very acute curves. Even
now as a dead end private property access route, traffic races past at a rather high rate of
speed. This place of business will definitely increase the flow of traffic with both cars
and trucks. This road passes between our home and our lake access. At times we do
take our lives in our hands when we have to cross the road to access our boat.. With the
traffic increase, will Engstrom Beach Road be able to handle it without much damage?
The people living along this area will be asked to repair it either by assessment to our
taxes or by tax levies from either Dora or Edna Townships.
Will speed signs (25 or 30) miles per hour be posted and INFORCED? Now some use
the 55 mile per hour in the summer months. At one time a speed sign was posted and
very few paid any attention to it.
Presently,, people of all ages use this road (including older adults, children and pets) for
walking, running, golf carts, and ATV’s. There are NO shoulders on either side of the
road. Will the increase traffic cut into these activities? When we want to pull out of our
driveway to get on Engstrom Beach Road, we have a hill and brush that makes it difficult
to get on the road. Cars drive over the hill at good speeds and have had near accidents in
the past.
How will this affect the value of our property when it comes to a time when this will be
necessary? It could have a negative effect. Hours will be 7 A.M. - 10 P.M. seven days a
week and having a bar serving hard liquor could make a added danger with DUTs etc ■
These are concerns we have and hope you will take them into consideration when you
make your decision. We respect the owner very much but we are very skeptical how this
will affect our present living conditions.

This letter is to inform you that we are strongly opposed to the application to build a bar
and grill at 42265 Engstrom Beach Rd. in Ottertail County. We recently bought our lake
home on beautiful West McDonald for the peace and tranquility it has to offer. The
proposed bar and grill would only congest the long, narrow, curvy road it would be
adjacent to. The first thing we noticed when we moved in was how many people walk,
jog and bike down that road. Also, not knowing exactly why there is a wreath memorial
placed next to the road, we can't but imagine there must have been a tragic accident on
that road.
We moved from Ida Lake which has the Road House Bar and Grill adjacent to that lake.
We experienced loud noise and the parking lot would be at times full with buses, and
many motorcycles from motorcycle rallies. Although, this bar and grill sits on a busy
intersection, it still caused congestion at many times. Please, keep beautiful West
McDonald Lake peaceful and not accept this application. Dent, MN is 4 miles away and
has restaurants. Also, the Pickle Factory Bar and Grill is just 5 minutes away. This is a
dead end, narrow, curvy road that is off the beaten path.

Gentlemen:
As lake shore owners on Engstrom Beach, we vote “no” for the conditional use permit application request

road is just a lake road, covered with a light paving, paid for by all the lake owners, plus the Township. It
would not withstand heavy commercial traffic, and the township would have to spend a lot of money
keeping up this road. Also, there are many childen riding bikes, etc. on these roads. This is a vacation area
not a city or highway. With a bar themare many problems that could occur on the roads.

Minnesotans incorrectly view rural roads as safe, study shows

A new University of Minnesota study shows that drivers are more prone to risk-taking on rural
highways, even Aough that’s where most fatal accidents occur.
The perception that rural roadways are safer is common. But Minnesotans are much more likely to die
on rural highways than on roads in urban areas where most people live, according to a traffic safety
survey done by the university’s Center for Excellence in Rural Safety.
Last year, about 70 percent of all traffic fatalities occurred outside the seven-county Twin Cities
metropolitan area.
The survey foimd that 69 percent of respondents statewide felt safe on urban freeways. But 79 percent
felt safe on rural, two lane highways.
Northfield’s police chief, Mark Taylor, agrees with the study’s findings.
Taylor, who served as a McLeod County sheriff’s deputy for about 20 years before coming to Northfield
in 2007, believes that those driving in rural areas tend to disobey speed limits and stop signs more and
are less likely to wear seat belts than drivers in urban areas. And while he’s seen rural residents take
driving less seriously in those areas, city folk often pay less attention in rural areas, he said, recalling a
long ago car accident where a driver unfamiliar with the area ran a stop sign. Three were killed in the
wreck.
In tovm, Taylor has noticed improved driving habits. Area residents, he believes, are used to driving in
suburban and rural areas, as well as on highways. And that, he says, makes their driving skills sharper.
They’re more attentive to other cars, at,intersections and in dealing with traffic, he said.
“Those in rural areas can get too complacent.”
Center for Excellence in Rural Safety director Lee Munnich said drivers appear to be taking unnecessary
risks on rural roads. Munnich said the survey shows people are more relaxed and comfortable with risk
taking on roads where they're most likely to be killed.
“They feel that there isn't the same level of risk as there is in urban areas, but the opposite is true,”
Munnich said. “There are significant safety hazards, and their behaviors — such as not wearing a seat
belt, or using a cell phone, eating while driving — all of these things are a higher risk in rural areas.”
The risk-taking on rural roads includes drinking and driving. The survey shows one in four rural
residents is more likely to drink and drive on rural roads. That level is nearly as high for urban residents
who responded to the survey.
“Even though they knew that it was not a good thing to do, they were more likely to drink and drive on
rural roads thanurban roads,” Munnich said. “And the statistics show that a high proportion of rural
road fatalities are attributable to drinking and driving.”
That's true in Minnesota, where nearly three-quarters of the alcohol-related traffic deaths happened on

rural roads. State law enforcement agencies increased patrols Labor Day weekend — typically among the
deadliest each year for alcohol-related crashes
State public safety officials say there's a range of reasons why more fatal accidents happen on rural
highways. For one, while law enforcement agencies report a 90 percent compliance with seat belt laws,
the rate is lower in rural Minnesota.
Cheri Marti, director of the state Office of Traffic Safety, said speeding is also a big problem on rural
roads. Those roads tend to have narrower shoulders, more curves and are often poorly lit. She says the U
of M study should be a wake-up call for drivers.
“It confirms what we're seeing statistically in traffic fatalities year after year,” Marti said. “So this is a
trend that isn't changing. So there does seem to be something going on in the rural community that's very
different than the urban community.”
V Marti said the key to changing people's attitudes lies with enforcement and with public education
campaigns.
“We can't get into people's cars and force them to make different decisions behind the wheel,” she said.
“I think that people are dangerously overconfident in their vehicles and certainly not sensitive enough to
the safe driving behaviors that they really need to practice.”
The U of M survey also revealed another big myth about traffic safety: 83 percent of respondents
considered winter to be the most dangerous season for driving on rural roadways. In reality, one in three
fatal accidents occurs during the summer, especially on holiday weekends.
