The above-entitled matter was heard before the Otter Tail County Planning Commission on the 8th
day of June 2022 and granted by the Otter Tail County Board of Commissioners on the 14th day of
June 2022, on the request for a Conditional Use Permit pursuant to the Otter Tail County Shoreland
Management Ordinance for the following property:

PLANNING COMMISSION RECOMMENDATIONS
Motion by Johnson, second by Bucholz and unanimously carried to approve a Conditional Use Permit for
David & Reanna Covington, current property owners of 44033 Hawes Beach Rd., Section 2, Otter Tail
Township; Buchanan Lake (56-209), GD, along with Pat Morstad, with a purchase agreement contingent upon
permit approval, to use the existing building as a maintenance and storage shop for a landscape business.
This location is for equipment and not commercial use.
Motion by Johnson, second by Mortenson and unanimously carried to approve a Preliminary Plat titled
“Sherman Oaks", owned by Patrick & Carol Richter, consisting of 13 Residential Non-Riparian Lots, 2 Blocks,
Lots 2 & 3 BIk 1- Duplex Lots as an option; and a Conditional Use Permit application request, provided a 66
foot dedicated road right-of-way providing access to parcel 52-000-18-0120-000 is included, being adjacent
to the SW lot line of 6 block 1, and the proposed septic system areas are fenced off for protection. The proposal
is located at 43661 Mosquito Heights Rd, Sections 17 & 18, Pine Lake Township; Big Pine Lake (56-130),
GD.

LAND AND RESOURCE POLICY #11 - SURVEY REQUIREMENTS
OTTER TAIL COUNTY RESOLUTION NO. 2022-53
WHEREAS, the Otter Tail County Shoreland Management Ordinance gives discretion to the Administrative
Officer to Require a professional drawing as part of an application where clarification of issues such as: lotline,
impervious surface, OHWL, drainage or topography is needed by the County; AND
WHEREAS, a policy standardizing when a survey is required allows for consistency;
NOW THEREFORE BE IT RESOLVED THAT, Otter Tail County by this resolution adopts the proposed Land
& Resource Policy No. 11 Survey Requirements as an official policy of Otter Tail County effective July 1,2022.
The motion for the adoption of the foregoing resolution was introduced by Commissioner Johnson, duly
seconded by Commissioner Bucholz and, after discussion thereof and upon vote being taken thereon, passed
unanimously.

All correspondence has been forwarded to the Planning Commission and Applicant for review.

Dora Lake Township
Dear Commissioners:
My name is Marshall McCullough. My wife and I own 140 acres of land in Dora Township that
are adjacent to the parcel subject to the proposed non-dwelling PUD and Conditional Use Permit,
and surround it on three sides. We are strongly opposed to this project. A commercial storage
facility simply doesn’t belong in this location.
It is my understanding that as this property is within 1,000 yards of Dora Lake, a conditional use
permit is required. The Otter Tail County Shoreland Management Ordinance, Section 1,
Subparagraph 2, states the purpose and intent of the Ordinance. In summary, it provides that it is
in the best interest of the public’s health safety and general welfare to provide for the wise
subdivision, use and orderly development of the land, and to preserve, enhance and conserve the
economic and natural environmental values of the property. We do not believe placing a storage
unit miles away from any other commercial property, and in a highly visible location, meet the
intent of the Ordinance.
Section 3, Subparagrapli 91 of the Ordinance further provides that the Planning Commission shall
consider the Conditional Use Permit if it meets this general purpose and intent. Some of the
factors to consider, include:
Compatibility with the surrounding area. There is no other commercial property
within miles of this proposed project. All surrounding property is wooded or
agricultural. This use is not compatible.
1)
Environmental hnpact on Wildlife. This project will affect wildlife in the area,
just as any commercial business would.
2)
Any hazards that may be created. The approach to this property is from County
Highway 4 with a speed limit of 55 miles per hour and on a curvy and hill portion
of the highway. Large recreational vehicle and trailer slowing down to enter this
property be dangerous and will cause a safety hazard.
3)
Density and location of the development. This property is in a undeveloped
agricultural area. It belongs near a town or other commercial property.
4)
Suitability of the Area. This is not a suitable area for commercial development. It
should remain environmental.
5)
6)Adequate traffic control. There are no traffic controls into this property for slow
moving vehicles attempting to access or leave the property.
Otter Tail County is currently working on a long range strategic plan. While not legally binding,
it does set forth the County’s desire for thoughtful proactive planning and structured
development within the County. Some of the visions and goals set forth in the Strategic Plan
can be summarized as follows:
1)Preserve and enhance the quality of our natural environment, and minimize
impact on natural resources from development activities.
Efficiently manage and support orderly growth through an efficient transition
from rural to urban areas.
2)
3)Evaluate strategies to protect agricultural resources and rural character with the
County.
4)Encourage clustering of development in suburban areas.
The haphazard placement of a storage unit on this property in a natural and environmental area
goes against the Long-Range Strategic Plan for the County.
We know that the current property is an eyesore. The home and garage need to be tom down,
and the garbage removed to an appropriate landfill. But, placing a storage unit in the middle of
this beautiful, environmental and agricultural area is not the answer. It would be an improvement
from the current situation but not an solution that meets the current Ordinance or the Long-Range
Strategic Plan.
If the Permit is granted, we respectfully request that it include the following additional
conditions:
1) the remainder portion of the property cannot be developed in the future.
2) the trees on the West half of the property cannot be removed
3) no outdoor storage or parking will be allowed, and
4) no overnight slays on the property.

the June 8“' Planning Commission meeting. If required, the applicants should obtain and comply with any necessary
permits as applicable, including the National Pollutant Discharge Elimination System (NPDES)/State Disposal System
(SDS) Construction Stormwater permit. Information on the MPCA's Construction Stormwater permitting program,
including who needs to obtain the permit prior to construction, can be found on the MPCA's website
at https://www.pca.state.mn.us/water/construction-stormwater. In general, permit coverage is needed by the owner or

days to make such title marketable.
Pending correction of title the payments hereunder required shall be postponed, but upon
correction of title and within 10 days after written notice, the buyer shall perform this agreement
according to its terms.
If said title is not marketable and is not made so within 120 days from the date of written
objections thereto as above provided this agreement shall be void, and neither principal shall be
liable for damages hereunder to the other principal and all money theretofore paid by the buyer
shall be refunded; but if the title to said property be found marketable, or be so made within said
time, and said buyer shall default in any of the agreements and continue in default for a period
of 10 days, then and in that case the seller may terminate this contract, and on such termination
all the payments made upon this contract shall be retained by said seller, as their respective
interests may appear, as liquidated damages, time being of the essence hereof; but this provision
shall not deprive either party of the right of enforcing the specific performance of this contract
provided such contract shall not be terminated as aforesaid, and provided action to enforce such

North, Range 41 West of the Fifth Principal Meridian in Qtter Tail Gourity, Minnesota,
described as follows:
Commencing at a found iron monument which designates the west quarter corner
of said Section 8; thence South 88 degrees 15 minutes 30 seconds Easton an
assumed bearing along the south line of said Southwest Quarter of the Northwest
Quarter for a distance of 300.00 feet to the point of beginning of the land to be
described; thence continuing South 88 degrees;15 minutes 30 seconds East along
said south line for a distance of 289.00 feet; thence North 00 degrees 23 minutes
03 seconds West for a distance of 61.68 feet to an iron monument on the northerly
right of way line of County State Aid Highway No. 4; thence continuing North 00
degrees 23 minutes 03 seconds West for a distance of 178.42 feet to an iron
monument; thence North 88 degrees 15 minutes 30 seconds West parallel with the
south line of said Southwest Quarter of the Northwest Quarter for a distance of
285.62 feet to an iron monument; thence South 00 degrees 25 minutes 14 seconds
West parallel with the west line of said Southwest Quarter of the Northwest Quarter
for a distance of 184.06 feet to an iron monument on said northerly right of way line;
thence continuing South 00 degrees 25 minutes 14seconds West parallel with said
west line for a distance of 55.94 feet to the point of beginning. The above-
described tract contains 1.58 acres.
SUBJECT TO an easement for County State Aid Highway No. 4 right of way
purposes over, under and across that part of the above tract described as follows:
Beginning at the aforementioned point of beginning; thence South 88
degrees 15 minutes 30 seconds East along said south line for a distance of
289.00 feet; thence North 00 degrees 23 minutes 03 seconds West for a distance
of 61.68 feet to an iron monument; thence North 89 degrees 23 minutes 36
