Approval of Minutes Motion by Windels, seconded Lee, and unanimously carried to approve the minutes of July 2, 1996, as submitted. Approval of Waterfowl Easement Motion by Lee, seconded Lindquist, and unanimously earned to certify the acquisition of lands by the U.S. Rsh & Wildlife Service for a waterfowl easement which has been secured from Franklin T. Melby on the following described lands: T. 133 N..R.42W.. 5th P.M. Section 35, W 1/2 SE 1/4 General consensus of the board was to table the purchase request of the U. S. Rsh & Wildlife Service until the next regular board meeting. Approval of Contract - 56-635-21 & Etc. Motion by Lindquist, seconded Lee, and unanimously carried to authorize the Chair's signature to execute the contract for S.A.P. 56-635-21 & Eta (overlay projects). Performance Evaluation Summary Motion by Windels, seconded Lindquist, and unanimously carried to accept the performance evaluation summary as submitted for Tom Fawcett, Social Services Director, and to maintain the summary in his personnel file. Forgiveness of Penalty Steve Andrews, Treasurer, appeared relative to a request for forgiveness of penalty for Magnar Tenold (parcel # 18-000-99-0386-000). The postmark date for the tax payment was May 18,1996, and the penalty was $22.80. The board directed Mr. Andrews to write a letter to Mr. Tenold explaining that Otter Tail County's policy requires payment of penalty if the tax payment is late. Payment is considered late if postmarked after the tax deadline date. . Ditch No. 23 Wally Senyk, County Attorney, presented the Otter Tail County Ditch No. 23 Rndings and Order Denying Petition for Repair for the Chair's signature. Motion by Windels, seconded Lee, and unanimously carried to collect $1,500 plus interest from the individuals who petitioned for the repair of Ditch No. 23. Planning Commission Recommendations Bill Kalar, Land & Resource Administrator, presented the July 2, 1996, Planning Commission minutes. Several questions regarding the Conditional Use Application of Roger & Eunice Shelstad were discussed. The Chair directed Mr. Kalar and Commissioner Stone to view the property and return to the board in two weeks. General consensus of the board is that there are very few non-residential backlots that are not tied together with a residual lakeshore parcel. Motion by Lindquist, seconded Lee. and unanimously carried to keep the language of the Shoreland Management Ordinance ‘as is* relative to non-residential backlots. Approved With Conditions:Roger & Eunice Shelstad A Conditional Use Application to excavate approximately 60-75 cubic yards of soil to smooth-out a ridge between my house and the shoreline. As it is now, I can just see the end of my dock. The area involved is 60' wide and 40' deep at the center lines. The excavation will be done with a backhoe and a bobcat. Erosion will be controlled with sod and immediate grass seeding. The excavation will be 60' long x 40' wide (at center), cut being 6' at the deepest part tapering to 0' at all points. The property is described as Pt. of Government Lot 7 (Parcel C) of Section 12 of Maine Township, Pickerel Lake (56-475), RD. Roger Shelstad represented the Application; Rick Olson spoke to the Commission indicating that he was denied to remove a 3' ridge and now it appears that you are going to grant approval to remove 6' of a ridge. A motion by Estes, second by Bergerud to approve the request with the following conditions: 1. The width of the cut is to be 72' along the north ridge (and 25' on neighbors' ridge). The neighbor is to submit a plan to Land & Resource for their reviewal and approval. 2. The maximum depth of the cut is 4'. 3. The portion of the primary ice ridge (adjacent to the dock) that has deteriorated must be restored and maintained at a height of not less than 12". 4. Must stabilize the area immediately according to Land & Resource Office's recommendations. Voting; All members in favor, except Zimmerman.
