March 28th ,1996 - Motion by John Everts, seconded by Randall Mann and unanimously carried, to waive the property owner's certification, as required by the Otter Tail County Subdivision Controls Ordinace for the propsoed 2.5 acre subdivision approved by the Board of Adjustment on January 4th, 1996. It should be noted that the certification requirement is being waived because the 2.5 acre subdivision was approved with the condition that the tract must be forever attached to Lot 1, Haven Hills. 19 M JL, e. Minnesota kkjJU ^ cr>^ S H/S'-^Cro /5-00 3 IS-OO a-^ /OAle, ^ iit ^ MINUTES OF THE MEETING OF THE OTTER TAIL COUNTY BOARD OF ADJUSTMENT March 28th, 1996 The Otter Tail County Board of Adjustment met Thursday, March 28th, 1996, with the following persons in attendance: Craig Anderson John Everts Cecil Femling Randall Mann Robert Schwartz George Walter Kyle Westergard, Land and Resource Management Wally Senyk, County Attorney Kurt Mortenson, Assistant County Attorney Call to Order - The meeting was called to order at 6:00 p.m. by Chairman George Walter. Minutes Approved - January 4th, 1996 Hearing no corrections or additions the minutes of the January 4th, 1996, meeting were approved as mailed. The following variance requests were heard; Melvin Rosentreter - January 4th, 1996 Board Action Amended. Wally Senyk, County Attorney, presented information regarding the property owner’s certification required, by the Subdivision Controls Ordinance, on all registered surveyor’s drawing. After consideration of the information presented, motion was made by John Everts, seconded by Randall Mann and unanimously carried, to waive the property owner’s certification, as required by the Otter Tail County Subdivision Controls Ordinance for the proposed 2.5 acre (Melvin Rosentreter) subdivision approved by the Board of Adjustment on January 4th, 1996. It should be noted that the certification requirement is being waived because the 2.5 acre subdivision was approved with the condition that the tract must be forever attached to Lot 1, Haven Hills. Harry J. and Anna P. Jackim - Tabled Harry J. and Anna P. Jackim, Moorhead, MN, requested a variance of 2’ from the required 50’ separation of a well from a holding tank for the location of a holing tank 48’ from the well. The property is described as Lot 7, Nedberge - Nye Survey Lots of Government Lots 1, 2, and 3, Section 1 of Edna Township on Devils Lake. Per the request of the applicants, motion was made by John Everts, seconded by Cecil Femling and unanimously carried, to table the applicant’s request until the next scheduled meeting. Shelda A. Warren - Tabled Shelda A. Warren, Moorhead, MN, requested a variance to subdivide a parcel of less than 5 acres (approximately 2.5 acres) from an existing 93.62 acre parcel. The property is described as the Northeast Quarter of the Northeast Quarter, except tract, the Southwest Quarter of the Northeast Quarter and part of Government Lot 1, Section 10 of Dunn Township on Pelican Lake. Per the request of the applicant, motion was made by John Everts, seconded by Cecil Femling and unanimously carried, to table the applicant’s request until the next scheduled meeting. WIKUTES OF THE HEETIHG OF THE OTTER TAIL COUNTY BOARD OF ADJUSTMENT January 4th, 1996 The Otter Tail County Board of Adjustment met Thursday, January 4th, 1996, with the following persons in attendance: John Everts Cecil Femling Randall Mann George Waiter Tim Griep, Land and Resource Management Kyle Westergard, Land and Resource Management Wally Senyk, County Attorney Call to Order - The meeting was called to order at 2:00 p.m. by Chairman George Walter. Chairman 1996 The first order of business for the 1996 year was the selection of the Chairman, was made by John Everts, seconded by Randall Mann and carried to nominate George Walter. Motion was made by Cecil Femling, seconded by John Everts and carried with George Walter voting no, to direct the Secretary to cast a unanimous ballot selecting George Walter as Chairman for the 1996 year. Motion Vice Chairman 1996 Chairman Walter then called for nominations for Vice Chairman. Everts, seconded by Cecil Femling and carried to nominate Craig Anderson, by Randall Mann, seconded by Cecil Femling and unanimously carried, to direct the Secretary to cast a unanimous ballot selecting Craig Anderson as Vice Chairman for 1996. The minimum size required for a metes and bounds parcel within the shoreland area is 5 acres. The property is described as Government Lot 3, Section 2 of Dora Township by Loon Lake. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Cecil Femling, seconded by John Everts and unanimously carried, to approve a variance to subdivide a 2.5 acre parcel from an existing 44.21 acre parcel with the conditions that the parcel must be forever attached to Lot 1, Haven Hills and that a registered surveyor's drawing must be provided at the time of recording. 4 £ 4-
