replace with a screen porch (15x15) and small patio. and patio will be no closer to the
OHWL than the deck currently is.r
By remaining within the existing footprint we are able to retain several mature trees that provide shade
and privacy to our neighbors and maintain the natural environment of the property. As such, the variance
is required due to the natural features and topography of the lot. Adding to either side of the cabin would
require multiple trees to be removed as well as disturbance to the ground for relocating of all utilities.

After consideration and discussion, Terry Marthaler made a motion, seconded by Douglas Larson
and carried by roll call vote to approve the variance to construct a 15’ x 15’ Screen porch being
65’ from the ordinary high-water level. This decision is also based on the Findings of Fact and
Decision Form, which contains the criteria reviewed and the Board’s finding have been attached
to and incorporated as an official part of the minutes which have been placed on file with the
Land & Resource Management Department.

a rough proportionality to the impact created by the variance. {Mitigating impervious surface with storm water management, deep
rooted vegetative buffers, rain gardens, etc.)
It is the Board of Adjustment's job to apply appropriate legal standards to a specific fact situation. Variances are meant to be an
infrequent remedy where an ordinance imposes a unique and substantial burden.

variance to be added to structures existing on February 5, 1992, if all of the following criteria
and standards are met:
1. A thorough evaluation of the property and structure reveals no reasonable location for a
deck meeting or exceeding the existing OHWL setback of the structure.
2. The deck encroachment toward the OHWL does not exceed 15% of the existing shoreline
setback of the structure from the OHWL oris not closer than 30 ft. to the OHWL, whichever
is more restrictive.
