It was noted that the applicants have a large lot with adequate area and a location for the proposed structure that would not require the granting of a variance. (7:50 p.m.) Gregory and Melanie Moffet, West Half of Lot 7, South Turtle Lake in Sverdrup Township, requested a variance of 4’ from the required west lot line setback of 10’, a variance of 7’ from the required east lot line setback of 10’ and a variance of 12’ from the required ordinary high water level setback of 100’ for the placement of sunroom on an existing concrete patio 6’ from the west lot line, 3’ from the east lot line and 88’ from the ordinary high water level. The audience was polled with no one speaking for or against the variance as requested. After consideration and discussion, Rick Wilson made a motion to approve a variance of 12’ from the required ordinary high water level setback of 100’ and to deny the variances as requested from the required side lot line setback for the placement of the proposed development (sunroom) 88’ from the ordinary high water level and at least 10’ from the east and west lot line. The practical difficulty is a substandard lot or record. The variance as approved will provide the applicants with a reasonable use of their property. It should be noted that the variance as approved does not directly or indirectly grant any other variances for the proposed development. Bradley W. and Sheila R. Childs, Lot 1 Block 1 South Oaks, Buchanan Lake in Otter Tail Township, requested a variance of 6’ from the required lot line setback of 10’ for the placement of storage building 4’ from the north property line. The audience was polled with no one speaking for or against the variance as requested. Three letters of support, which were submitted with the application from Scott Bakko, Donald Dreyer, and Scott Schneider were noted for the record. After consideration and discussion, Michael Harris made a motion, second by Rick Wilson and unanimously carried, to deny the variance as requested as no adequate practical difficulty/hardship unique to the applicants’ property had been shown that would allow for the granting of the variance as requested. (8:13 p.m.) Joel Bradford and Gail Childs, part of the Northeast Quarter of the Southwest Quarter, Section 23 of Fergus Falls Township by an unnamed lake, requested the following: Structural Setback Variance - Structures sited at minimum of 160’ from ordinary high water level instead of 200’ typical of DNR Basin. The audience was polled with Sherri Money speaking for the variance as requested. After consideration and discussion, Steve Schierer made a motion, second by Ward Uggerud and unanimously carried, to approve a variance of 40’ from the required ordinary high water level setback of 200’ for the placement of the proposed development as described in the variance application dated May 22, 2013 and as depicted on the submitted drawing 160’ from the ordinary high water level. The variance as approved does not directly or indirectly grant any other variances for the proposed development or future development. Duaine and Sandra Miranowski - Variance application was approved as requested with conditions. (8:20 p.m.) Duaine and Sandra Miranowski, Reserve Lot A, Stalker View Acres First Addition and part of Government Lot 2, Section 27 of Tordenskjold Township by Stalker Lake, requested a variance to create a substandard metes and bounds parcel, which will be attached to Reserve Lot A of Stalker View Acres First Addition. The proposed metes and bounds parcel will meet the minimum size required for platted back lots. The proposed metes and bounds parcel will be 300’ on the south side (road), 270' deep on the east side, 300’ wide on the north side and 31T deep on the west side.May 9, 2013 meeting - The audience was polled with no one speaking for or against the variance as requested. After consideration and discussion, Thomas Lee made a motion, second by Michael Harris and unanimously carried, to table with the applicants’ verbal permission, this variance hearing until the June 13, 2013 meeting, to provide the applicants with an opportunity to consider the County Attorney’s opinion and position regarding the request and to provide the applicants with additional time to re-discuss their application with both the Land and Resource Department and the County Assessor’s office. Reserve Lot A is not buildable for residential purposes, and 5.) residential development can only occur on the newly created back lot area.
