The string line would be established between Lot 4, which is a vacant lot, and the structure on Lot 6. Crouse - Approved James B. Crouse, Battle Lake, MN, requested a variance to convey 15.65’ from the westerly edge of Parcel “A” for permanent attachment to the adjacent property and a variance to convey the westerly 40’ of Parcel “C” for permanent attachment to the adjacent property. Parcels “A” and “C” are identified on a drawing on file in the County Auditor’s office. If the variance is granted the applicant will have approximately 145’ of frontage and the adjacent property owner will have approximately 100’ of frontage. The property is described as part of Government Lot 4, Section 3 of Everts Township by Otter Tail Lake. The audience was polled with no one speaking for or against the request. After consideration, motion was made by John Everts, seconded by Randall Mann and unanimously carried, to approve a variance to convey 15.65’ from the westerly edge of Parcel “A” for permanent attachment to the adjacent property and a variance to convey the westerly 40’ of Parcel “C” for permanent attachment to the adjacent property with the provision that a registered surveyor’s drawing must be provided. The granting of the variance request will provide the adjacent property owner with a more standard sized lot and with public road access. The balance of the applicant’s property will meet or exceed the size requirements for platted lots on a general development lake. Kenneth J. Lill - Denied Kenneth J. Lill, Fergus Falls, MN, requested a variance of approximately 3.5’ from the required soil treatment area setback of 20’ for the location of a drain field approximately 16.5’ from the garage. The property is described as Lot 8, Fleming Patterson Beach, Swan Lake in Dane Prairie Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by John Everts, seconded by Craig Anderson and unanimously carried, to deny the variance as requested as no adequate hardship had been shown and other reasonable alternatives are available to the applicant that do not require the granting of a variance. Tim Sucher- Denied Tim Sucher, Ottertail, MN, requested a variance to enclose an existing 8’ by 24’ deck located on site 6 with screen. The property is described as Sub Lot 1 of Government Lots 3 and 4, Section 23 of Rush Lake Township by Rush Lake. Don Jelinek represented the applicant at the public hearing. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Randall Mann to approve the variance as requested. This motion died for a lack of a second. After additional consideration and discussion, motion was made by John Everts, seconded by Robert Schwartz and unanimously carried, to deny the variance as requested as no adequate hardship had been shown and the granting of the variance would be inconsistent with a very recent change in the ordinance which defines the types and sizes of additional structures that are allowed in resort/cluster type developments. Donald Langren - Approved Donald Langren, Ottertail, MN, requested a variance of approximately 10’, on the south side of Lot 5, from the required ordinary high water level setback of 100’ for the construction of a dwelling approximately 90’ from the ordinary high water level on the south side of Lot 5 and in line and square with the dwelling on the neighboring Lot 6. The property is described as Lot 5, Oxcart, Blanche Creek in Otter Tail Township. The audience was polled with no one speaking for or against the request. i - July 3, 1997 Page 3 Donald Jensen - Approved Donald Jensen, Woodbury, MN, requested a variance of approximately 3’ from the required side lot line setback of 10’ for the construction of a 24’ by 36’ garage/shop approximately 7’ from the north lot line and approximately 7’ from the south lot line. The property is described as.Lot 46, Kimber Beach, Blanche Lake in Girard Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Craig Anderson, seconded by Robert Schwartz and unanimously carried, to approve a variance of approximately 3’ from the required side lot line setback of 10’ for the construction of a 24’ by 36’ garage/shop approximately 7’ from the north lot line and approximately 7’ from the south lot line with the condition that both the applicant and the contractor must meet with Bill Kalar, Land and Resource Director, to discuss the requirements of the County’s Shoreland Management Ordinance. It was noted that in this immediate area there are a number of nonconforming structures. It was also noted that the applicant’s proposed garage would be constructed on a back lot. Hardship is a substandard lot of record. Malcolm L. and Sheila M. Moore - Approved Malcolm L. and Sheila M. Moore, Battle Lake, MN, requested a variance of approximately 6’ from the required side lot line setback of 10’ for the construction of a 4’ by 6’ addition approximately 4’ from the side lot line and a variance of approximately 2’ from the required side lot line setback of 10’ for the construction of a 4’ by 2’ addition approximately 8’ from the side lot line. The property is described as the West 40’ of Lot 5, Blanche Lake Beach, Blanche Lake in Everts Township. Ronald Swenson, Architect and General Contractor, appeared along with the applicants at the public hearing. The audience was polled with no one speaking for or against the request. After consideration, motion was made by George Walter, seconded by Cecil Femling and carried with John Everts abstaining, to approve a variance of approximately 6’ from the required side lot line setback of 10’ for the construction of a 4’ by 6’ addition approximately 4’ from the side lot line and a variance of approximately 2’ from the required side lot line setback of 10’ for the construction of a 4’ by 2’ addition approximately 8’ from the side lot line. It was noted that the proposed additions will be no closer to the side lot lines than the existing structure and the existing steps and porch on the East Side will be removed. Hardship is a substandard lot or record. David LaVern Grimm - Approved David LaVern Grimm, Fergus Falls, MN, requested that the required 20’ road right-of-way setback be waived and that the applicant be allowed to construct a 24’ by 30’ garage approximately 8’ from the property line on the north side of the garage. The property is described as Lot 2, except the westerly 5’ and all of Lots 3 and 4, Eureka Beach, Jewett Lake in Elizabeth Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Randall Mann, seconded by John Everts and unanimously carried, to approve the construction of a 24’ by 30’ garage approximately 8’ from the property line on the north side of the proposed garage and to waive the required 20’ road right-of-way setback with the condition that the applicant receives written township approval varying the road right-of-way setback. It was noted that the variance is from a road that is no longer in use and that the properties in this immediate area are serviced by another road. • ,July 3, 1997 Page 6 After additional consideration, motion was made by Randall Mann, seconded by John Everts and unanimously carried to approve a variance of 4’ from the required side lot line setback of 10’ for the placement of an addition to an existing 14’ by 22’ garage no closer than 6’ from the side lot line. Hardship is a substandard lot of record. The applicant must bring the structure into compliance with the approved variance by July 1, 1997. It should be noted that the 8’ by 12’ addition was already in place when the public hearing was held, therefore, the applicants were given until July 1, 1997, to bring the structure into compliance. Recently, a written request has been received from Marvin Rapp requesting an extension of the July 1, 1997 date and indicating his plans to bring the structure into compliance. After consideration, motion was made by John Everts, seconded by Craig Anderson and unanimously carried, to extend the date from July 1, 1997, until September 1, 1997, at which time the structure must be brought into compliance with the variance as approved on November 7, 1996. Donald William Bernauer - Approved Donald William Bernauer, Perham, MN, requested a variance of approximately 25’ from the required ordinary high water level setback of 200’ for the construction of a 36' by 110’ cold storage building approximately 175’ from the ordinary high water level. The property is described as part of Government Lot 3, Section 10 of Edna Township by Rusch Lake. The audience was polled with no one speaking for or against the request. After consideration, motion was made by John Everts, seconded by George Walter and unanimously carried, to approve a variance of approximately 25’ from the required ordinary high water level setback of 200’ for the construction of a 36’ by 110’ cold storage building approximately 175’ from the ordinary high water level. It was noted that the proposed structure will not obstruct the view from the neighboring property and that the applicant’s property is heavily wooded between the structure and the lake. Hardship is the terrain of the applicant’s property. Patrick Daugherty - Denied Patrick Daugherty, Robbinsdale, MN, requested a variance to “allow garage to remain as built with floor, stud walls, exterior deck, and sliding glass door on upper level for use as storage on upper level only”. The property is described as Lot 4, Paulson’s Timberlane Addition. Stephen F. Rufer, Attorney, and Jose’ Cervantes, Housing Inspections Supervisor for the City of Minneapolis, appeared along with Maureen and Tim Daugherty. Mr. Jose’ Cervantes presented a letter from Donald Olson, Structural Engineer, expressing concerns with the corrections to the structure that have been suggested by the County. The audience was polled with Donald Greene, Woody Dickson, Joe Kassahn and Mark (the last name is unclear on the tape) speaking to the variance requested. A letter from Deborah A. Spiczka opposing the applicant’s request was read for the record. After much discussion and consideration, motion was made by Craig Anderson, seconded by John Everts and unanimously carried, to deny the variance as requested as no adequate hardship had been shown and to recommend that the violation to be handled through the administrative process. Marvin and Ruth J. Rapp - Time Extension On November 7, 1996, the County Board of Adjustment heard the following variance request: Ruth J. Rapp, Clitherall, MN, requested a variance of 8’ from the required side lot line setback of 10’ for the placement of an 8’ by 12’ addition to an existing garage approximately 2’ from the side lot line. It was noted that the stmcture will be approximately 275 to 300’ from the ordinary high water level and it was also noted that the mn off from this location is away from the lake towards the road. The applicant indicated that his farm operation is serviced by a lagoon. Hardship being an agricultural use located within the shoreland area. The granting of this variance is consistent with prior actions of the Board of Adjustment.
