Michael J and Joan M Giese - Approved as requested. (8:47 p.m.)
Motion was made by Paul Larson, second by Cecil Femling and unanimously carried, to approve a variance of 7’ from
the required ordinary high water level setback of 75’ for maintenance to an existing foundation, which is located 68’
from the ordinary high water level. It was noted that there would be no changes made to the foot print of the existing
building and what is being proposed would be considered normal maintenance to this structure.

Request for Variance from Standard
Structure Setback from Ordinary High Water Level of 75 feet.
This request is being made by Mike and Jean Giese for the property located at
OTFS #40, Rustic Acres. The structure (a 836 square foot cabin) is currently
setback 68 feet from high water level.
In an effort to maintain the current structure it has been determined by building
professionals that repair must be done to the existing foundation. The repair
would include lifting the cabin structure high enough so that the existing joists
and footings could be replaced and return the cabin to the repaired foundation.
No change to the size of the cabin is planned and no disruption of the
surrounding landscape/locality would occur. This repair is needed so that no
further damage will occur requiring extensive construction.
The part of the lot to the east of the cabin is wooded and swampy limiting any
access. When the cabin was built the septic tank and drain field were placed
directly behind the cabin taking up the back yard, this eliminates the possibility
of building to the back of the lot. Both of these conditions make it difficult if not
impossible to relocate the existing cabin without considerable hardship and
unnecessary change to the existing topography and locality.
