Conditional Use Permit - Fanners State Bank:
Land & Resource Director, Bill Kalar, stated that this Conditional Use Permit request for a dock and lift
business in an existing building was recommended for denial by the Planning Commission. Neighbor,
Karen Wells, presented a picture board and spoke against the request because of insufficient parking,
plans to clear cut trees, potential for unsightly storage, and potential for excessive noise, which
renders the site incompatible with the surrounding residential area. Another neighbor opposed to the
CUP request spoke of large delivery trucks not having room to get in and out of the property.
Neighbor, Bill Schafer, stated that he has lived in the area for 35 years and feels that the type of
business that the Bank and Mr. Hein are suggesting is not the type of business that should be in that
location. Karen Wells also brought up the issue of wetlands on the property. Motion by Froemming,
second by Erickson, to deny a Conditional Use Permit for a Docks & Lifts business for the reasons as
outlined in the Otter Tail County Planning Commission minutes dated July 18, 2007. Chairman
Mosher called for a vote. Motion carried with Nelson, Block, Froemming, and Erickson in favor and
Mosher abstaining. The property is described as Lot 1 Hawes Beach, Section 2 of Otter Tail
Township; Buchanan Lake (56-209), GD.
Conditional Use Permit - Dean & Jo Allmendinger:
Mr. Kalar stated that this Conditional Use Permit request deals with construction of retaining walls and
shoreline riprap and the Planning Commission recommended approval with conditions. Applicant,
Dean Allmendinger, questioned Condition No. 3 as it relates to the requirement that the step blocks
must be above ground. Discussion followed. Motion by Block, second by Froemming, and
unanimously carried to approve a CUP for shoreline riprap and retaining walls with the following
conditions;
1. Elimination of the washed sand area into the lake. 2. The only rock work allowed is rip rap
along the existing shoreline. 3. The maximum width of the stairway must not exceed 4 feet
and the stairway between the retaining walls may be set in ground. 4. The lake access
stairway must be constructed above ground. 5. An Engineer must approve the project. 6.
The work must be completed no later than October 1, 2007. 7. Appropriate erosion control
measures must be implemented.
The property is described as Magnell’s Addition to Clarisa Haven Lots 7 & 8, Section 28 of Girard
Township; West Battle Lake (56-239), GD.
Conditional Use Permit- Randy & Kathy Heim:
Motion by Erickson, second by Block, and unanimously carried to approve a Conditional Use Permit
to replace existing failed retaining walls with conditions as recommended by the Planning
Commission. The property is described as Lot 18 Pelican Lake Park & Lot 17 Pelican Lake Park 3"*
Addition, Section 5 of Dunn Township; Pelican Lake (56-786), GD.
Committee Member Appointment to the Planning Commission
Motion by Nelson, second by Erickson, and unanimously carried to appoint Marion Gill of Perham,
MN, to the Otter Tail County Planning Commission to replace the term of Jim Arno.
Countvwide Zoning
Commissioner Nelson stated that he would like to look into Countywide zoning. Mr. Kalar stated that
the first step is to look at other ordinances to identify what you wish to accomplish from Countywide
zoning. Mr. Nelson stated that the Ag Advisory Committee and the SWCD have requested zoning
and that protection of agriculture is important.

Permit to be vaiid through August 31, 2008 and to ailow the work to take place after the

Steve & Juiie Hannia - Approved With A Condition:
A Conditional Use Permit Application (as staled by the Applicant): Level out area 10 feet from
lake (14 x20) and area (12 x 20) 20 feet from lake, adding a retaining wall 20 feet from
shore 2’ high & 20' long and a wall 3’ high 40’ long 35' from lake, moving 37 cubic yards of
material to level out (black dirt and sand). Also adding a firepit 20' from the shore and
adding 10 yards sand for a play area 5’ off the shore. Using rocks for the walls and rocks
& flagstone for the firepit. Total of 47 cubic yards for project. The property is described as
Franklin Knoll Res Lot A & vac rd ad] & W 30' of 5 & all Lot 6 & 7 BIk 1 & vac rd ad].
Section 22 of Dunn Township; Franklin Lake (56-759), RD.
Steve Hannig represented the Application.
Motion: A motion by Wilson, second by Estes to approve as presented, excluding the 10
yards of sand for the play area. Voting: All Members in favor.

Dean & Jo Allmendinaer - Approved With Conditions:
A Conditional Use Permit Application (as stated by the Applicant): Riprap shore line & add
sand. Build rock retaining wall to stop soil movement; slightly indent lawn area to hold
water. Plant deep rooted plants on slope; install paver patio with positive drain from
foundation with a French drain between patio & lake. Install retaining walls to stop soil
erosion to foundation and to lake. Install paver patio on south east comer of house; build
stainway to walkout area. Replace wood deck up to IT 2" from home as per Wayne's
recommendation. The property is described as Magnell's Addition to Clarisa Haven Lots 7

A Conditional Use Permit Application (as slated by the Applicant): Want to replace existing
railroad tie retaining walls with modular concrete retaining wall block. Construction of new
wood steps & landings from top deck to the bottom of hill. Total excavation will account for
approx. 65 yards of soil to be put back into place & compacted. Retaining walls to be
installed as per manufacturer's specifications. The property is described as Lot 18 Pelican
Lake Park & Lot 17 Pelican Lake Park 3"“ Addition, Section 5 of Dunn Township; Pelican
Lake (56-786), GD.
Randy Heim and Richard Lahrem (Hebron Brick & Block Supply) represented the
Application,
Motion: A motion by Erickson, second by Wilson to approve provided: 1. Appropriate
erosion control measures must be implemented prior to and during construction. 2. The
Impervious surface must not exceed 25% of the lot area, scale drawing confirming this
must be provided to Land & Resource prior to processing the Permit.
Members in favor, except Zimmerman and Estes, reason being incompatibility with
surrounding area.
Adjourn: At 9:30 P.M., Chairman Olson set the Meeting. The next Meeting is scheduled

Craig Gwen Bruns - Approved With Conditions:
A Conditional Use Permit Application(as stated by the Applicant): Rework roadbed and ditches
on existing driveway. 1. Cut area shown on Attachment B is 760 x 50 x 5, approximately
7,037.04 cubic yards. Fill area shown on Attachment B is 500 x 60 x 3, approximately
3,333.34 cubic yards and 270 x 220 x 2, approximately 4,400.00 cubic yards 2. Level for
landscape and drainage around new home as shown on Attachment C. Cut area 200 x
160 X 5, approximately 5,925.93 cubic yards. Use cut spoils to fill 150 x 200 x 5,
approximately 5,555.56 cubic yards. Backfill around dwelling maximum 8 feet depth
sloping out 5 feet from foundation. The property is described as SE1/4 SW1/4, NW1/4
SE1/4 and Lots 2 & 3 (157 AC), Section 14 of Friberg Township; Johnson Lake (56-699),
NE.
Gwen Bruns and Jenny Rochell represented the Application. Ms. Bruns indicated that
they would also like to request a retaining wall being parallel with the house, approximately
125’ from the lake, 2’ high and 100' long.
Motion: A motion by Erickson, second by Maske to approve provided; 1. Appropriate
erosion control measures must be implemented for the entire project. 2. The two existing
houses must be removed. 3. Allow the Conditional Use Permit to be valid through July 18,
2008. 4. Allow the driveway to be constructed after September 1, 2007. 5, Allow the
retaining wall as requested at the July 18, 2007 Meeting. Voting: All Members in favor.
Break: At 7:20 P.M., the Commission took a 10 minute break.
Farmers State Bank - Denied:
A Conditional Use Permit Application (as stated by the Applicant): Sheldon Hein is requesting
this permit to retail Advanced Docks & Lifts at 44033 Hawes Beach Rd. The facility will
have 19 - 10 x 20 ft. parking spaces. Will be open 8:00 A.M. to 6:00 P.M., Monday
through Saturday. 1-6x8 lighted sign in display area west of building. The building will
be used for office & assembling the docks & lifts. The existing building "40 x 100” was
previously used for commercial purposes. The property is described as Lot 1 Hawes
Beach, Section 2 of Otter Tail Township; Buchanan Lake (56-209), GD.

COMMERCIAL PROPERTY, HOWEVER THE TYPE
