On the property at the time was a small cabin and a two story garage. The upper story of the garage was a bedroom. This factor was essential to the sale as the two bedrooms in the cabin were very small (6'-6" x 9'-6" and 5'6" x 9'6" respectfully). Only with this bedroom was each of our two children able to have their own bed. The property was advertised and sold to us with this room functioning as a bedroom. The bedroom above the garage was furnished with a bed and bedroom furniture when we viewed it and subsequently bought the property. In speaking with Mr. and Mrs. Ron Tisher, the previous owners, I was able to learn that; 1. The garage was built in the spring of 198.3. 2. A building permit was obtained for the construction. 3. It was the intention from the beginning to construct the garage with the bedroom to accomodate their family. 4. The room has been used as a bedroom continually since 1983. In consulting with local legal counsel, I understand that the statute in this situation is designed to prevent two dwellings on one property to prevent over-crowding on the lake. With that in mind let, me say; 1. The bedroom in question was not built as a separate dwelling but rather an additional sleeping room to accomodate an average family or four. 2. The bedroom could not be used for the purpose of housing another family unit thus contributing to the over-crowding of the lake. 3. The garage is located 6 feet from the cabin and is joined by both an upper and lower deck. In conclusion I do not believe this property to violate the spirit of the statute in question and the loss of this additional sleeping space would drastically reduce the livability and thus the value of this propery. The property has existed for quite a period of time with this extra bedroom without adverse effect to the lake and it's community. With this in mind I do ask that the Board find in favor of my varrance request. Craig Surdy 4231 Highland Rd.
