Sumstad, Clitherall, MN, request a variance of 80’ from the required ordinary high water level setback of 200' for an 18’ by 22’ addition being 120’ from the ordinary high water level. The property is described as a 3.13-acre tract in Government Lot 8, Section 17 of Leaf Mountain Township by Spitzer Lake. The audience was polled with no one speaking for or against the request. David Holmgren noted that he had received a phone call from Mr. Joel Koep in favor of the applicant’s request. After consideration, motion was made by Randall Mann, second by David Holmgren and unanimously carried, to approve a variance of 80’ from the required ordinary high water level setback of 200’ for an 18’ by 22’ addition 120’ from the ordinary high water level noting that the proposed addition is behind the applicant’s existing dwelling, is not view obstructing, is across the road from the lake and is consistent with past action of the Board of Adjustment. Hardship is an existing pre-ordinance dwelling within the 200’ setback area. Floyd Walter - Denied Floyd Walter, Ottertail, MN, requested a variance of 40’ from the required ordinary high water level setback of 200’ for the location of a dwelling site 160’ from the ordinary high water level. The property is described as Lot 6, Auditor’s Subdivision Number 114, Dead Lake in Dead Lake Township. A letter from Steve Zukowski in support of the applicant’s request was read for the record. Steve Zukowski indicated support for the applicant’s request so long as he could receive the same setback variance for his property. They are concerned that, if granted, the requested variance would alter their view of the lake and the wildlife. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Steve Schierer, second by Mark Steuart and unanimously carried, to deny the variance as requested noting the following: 1. the proposed development is new development, 2. reasonable use of the property can be obtained by the applicant without the granting of a variance, 3. adequate space is available for development at the required 200’ setback, and 4. no adequate hardship had been shown that would permit the granting of the variance as requested. rold Winkelman - Denied as requested. - Approved a 4’ by 4’ by 4’ well house.
