I am trying to open my own dealership in ottertail coimty, address 42969 county road
one. What I do is buy motorcycles, snowmobiles, boats, and some cars at auctions and then
resell them, mainly online sales. I sell very few locally so the traffic in and out will not be a
problem. I will operate mainly by appointment only, but will be around in the afternoons from
2pm to 6pm. In the mornings I do all my emails and online auctions..
I think the property I bought is perfect for what I am doing, since a insulated building is
already up, and there is a nice tree line to hide vehicles being sold or waiting pickup. I do have a
large yard light in operation now, with ample parking for 10-15 vehicles, which would never be
used for that many customers. I will or would like to have a sign by the road, since there already
one in existence, I would just put my business name and number on it instead. I would also like
one sign on the garage if possible to meet the state of mn dealer regulations.
I am approximately 390 feet fi’om the river with county road 1 being a buffer between
my property and the water. I also own the property at 33159 ottertail river road, and if you have
noticed on that property and this one as well, I have done extensive clean up and turned them
both into respectful looking properties. It is not my intension to make the properties look like a
dump like they did, I respect the nature and all wildlife, and will do everything in my power to
keep nature the way it is suppose to be.

the public. There will not be heavy traffic coming or going for sales; will be pick up and drop

Jason Stowers represented the Application.
Andrew Billy spoke and indicated he has no problem with motorcycle noises, stated the
Applicant has cleaned-up the area and that a fence could be installed to block the view,
spoke in favor of the Application.

Larry Peasley, Jason & Renee Goff, and Gary Kugler represented the Application.
Jean Prochnow (Heilberger Lake Association) expressed concerns regarding the high water
of Heilberger Lake, indicating High Island Lake flows into Long Lake & Jewett Lake,
expressing concerns with the effect on their water clarity. Wes Binner agreed with the
concerns of the Heilberger Lake Association, including the effect on water quality and also
algae bloom. Darrel Benson expressed concerns regarding the effect on the water quality
of Heilberger Lake & the effect on the elevation of Heilberger Lake. Miranda Rich
expressed concerns regarding the water over the Township Road (270^'^ Ave.), stating that
the water quality in High Island Lake is fine. Gladys Kugler indicated that her driveway is
flooded-out, something needs to be done. Norman Long stated that there are 6 culverts
going into Heilberger Lake and 1 going out, Heilberger Lake can not handle anymore water.
Motion: A motion by Wilson, second by Maske to table (at the Applicant’s request) to June
8, 2011 to allow the Applicant to obtain an engineer’s study, the Commission Members

Conditional Use Permit - Future Generations LLC:
Motion by Johnson, second by Froemming, and unanimously carried to approve a Conditional Use
Permit for Future Generations LLC to reconfigure property to create a residential lot with the balance
of the property combined for a commercial storage structures operation. The CUP was approved as
presented. The property is described as Part of Lot 20 & all of Lots 21 - 25 BIk 1 Palms of Lida First
Addition, Section 9 of Lida Township; Lake Lida (56-747), GD.
Conditionai Use Permit - Jane Gilieland:
Motion by Froemming, second by Huebsch, and unanimously carried to deny, as recommended by
the Planning Commission, an After-the-Fact Conditional Use Permit to construct an additional 3 ft.
retaining wall to relieve pressure on the existing retaining wall and reduce the slope into the lake. The
work involved significant earthmoving within the shore impact zone. The Applicant must work with the
Land & Resource office regarding restoration. The property is located on Shirley Beach Lot 1, Section

Dear Honorable Commissioner,
The City Council of the City of Ottertail wishes to express its concern over the proposed
Conditional Use Permit by applicant Jason Stowers at 33159 Ottertail River Road. This
property is very close to Hwy 1 therefore creating a potential eyesore with non-working
vehicles accumulating, in reality a “junk yard.” This use could also potentially create a
pollution hazard with the property being in close proximity to water.
At the very least a fence should be required to isolate the area from view.
The County of Otter Tail should ensure to the public that it is doing its best to protect our
waters as well as continually maintain the visible beauty of the lakes area.

I am writing concerning the hearing for the properties of Jason Showers, located at 33159 Ottertail River
Road and 42969 County Road 1, Ottertail County. The hearing will occur on May 11, 2011. The main
problem with this business is having the property he makes repairs too, scattered over the premises,
therefore detracting from the local area, which is a lake tourist area. Orderly display and housing the
items would help and also keeping the lots free of other debris would go a long way toward making the
business acceptable. Some people have complained about the loud motorcycles being reeved up in the
area of the lot sites. I guess no one wants a junk yard close to their residence, decreasing their property
value.

Dear Bert and Commissioners:
I am opposed to the permit requested for Jason Stowers. This property has been used as a lot
for storing, at the very least, various vehicles including those mentioned in permit request and
boats for some time. It attracts drive by traffic, even though his intent is to operate mostly on
line, and is a traffic hazard as well as a substandard appearance. As hard as he may try, there
just isn't any way of getting around the unsightly appearance of old vehicles, boats etc. At this
time there is a large older in board boat which has been there for what seems like a long time.
There is also noise which comes from running those vehicles up and down the ditches as
prospective customers try them.
I surely wouldn't buy property in the proximity if I was looking for property to purchase, and it
can't help but devalue our property as well as detract from the beauty of the area.

THIS CONTRACT FOR DEED is made on the above date by Michael R. Sanders and
Karl D. Sanders, husband and wife, Seller (whether one or more), and Jason Stowers,
Purchaser.
Seller and Purchaser agree to the following terms:
PROPERTY DESCRIPTION. Seller hereby sells, and Purchaser hereby buys,
real property in Otter Tail County, Minnesota, described as follows:
1.
Lots One (1), Two (2), and Three (3), Empire Second Addition to the Village of
Ottertail, according to the certified plat thereof on file and of record in the office of
the County Recorder in and for Otter Tail County, Minnesota; together with a
contiguous tract of land more particularly described as follows: Beginning at the
Easternmost corner of Lot 3, Empire Second Addition; thence Northeasterly on and
along an extension of the Southeastern boundary line of said Lot 3, a distance of
100 feet; thence Northwesterly on and along a line drawn parallel with the
Northeastern boundaries of said Lots 1,2, and 3 Empire Second Addition, to a point
of intersection with the Western boundary of Section 3 according to the original
Government Survey thereof; thence Southerly on and along said Western
boundary of Section 3 to the Northernmost corner of said Lot 1, Empire Second
Addition; thence Southeasterly on and along the Northeastern boundaries of said
Lots 1, 2, and 3 Empire Second Addition to the point of beginning. All lying and
being in Section 3, Township 134 North, Range 39 West,
AND that part of Government Lot 7, Section 4, Township 134, Range 39, West of
the Fifth Principal Meridian, described as follows: With the point of intersection of
the North line of State Aid No. 1 and the East line of said Lot 7, as the point of
beginning, thence North on the East line of said Lot 7,194.4 feet; thence North 57

feet to the North right-of-way line of said State Aid Road No. 1; thence East on this
iine 125 feet to the point of beginning.
together with all hereditaments and appurtenances belonging thereto (the Property).
2. TITLE. Seller warrants that title to the Property is, on the date of this
contract, subject only to the following exceptions:
(a) Covenants, conditions, restrictions, declarations and easements of
record, if any;
(b) Reservations of minerais or mineral rights by the State of Minnesota, if
any;
(c) Building, zoning and subdivision laws and regulations:
(d) The lien of real estate taxes and installments of special assessments
which are payable by Purchaser pursuant to paragraph 6 of this
contract: and
(e) The following liens or encumbrances: None.
3. DELIVERY OF DEED AND EVIDENCE OF TITLE. Upon Purchaser's
prompt and full performance of this contract. Seller shall: ,
(a) Execute, acknowledge and deliver to Purchaser a Warranty Deed, in
recordable form, conveying marketable title to the Property to
Purchaser, subject only to the following exceptions:
(i) Those exceptions referred to in paragraph 2(a), (b), (c) and (d)
of this contract;
(ii) Liens, encumbrances, adverse claims or other matters which
Purchaser has created, suffered or permitted to accrue after
the date of this contract: and
(iii) The following liens or encumbrances; None.
(b) Deliver to Purchaser the abstract of title to the Property or, if the title is
registered, the owner's duplicate certificate of title.
4. PURCHASE PRICE. Purchaser shall pay to Seller, at Seller’s last known
address, the sum of Sixty-six Thousand and No/100 Dollars ($66,000.00), as and for the
purchase price for the Property, payable as follows:
The sum of $10,000.00 in cash upon the execution and delivery of this instrument,
the receipt of which is hereby acknowledged: the balance of $56,000.00 shall be
paid as follows: The sum of $546.48 shall be due and payable on January 1, 2010,
with the further sum of $546.48 due and payable on the 1®' day of each and every
month thereafter until December 1,2012, at which time the entire balance, principal
and interst, shall be fully due and payable. Interest shall accrue on the unpaid
balance from and after December 1,2009, at the rate of six percent (6%) per
annum, and each monthiy payment shall be first applied to reduction of interest,
with the balance applied to reduction of principal.

PREPAYMENT. Unless otherwise provided in this contract, Purchaser shall
have the right to fully or partially prepay this contract at any time without penalty. Any
partiai prepayment shali be appiied first to payment of amounts then due under this
contract, inciuding unpaid accrued interest, and the balance shall be applied to the
principai instaiiments to be paid in the inverse order of their maturity. Partial prepayment
shall not postpone the due date of the installments to be paid pursuant to this contract or
change the amount of such installments.
REAL ESTATE TAXES AND ASSESSMENTS. Purchaser shall pay, before
penalty accrues, all real estate taxes and installments of special assessments assessed
against the Property which are due and payable in the year 2010 and in all subsequent
years. Real estate taxes and installments of special assessments which are due and
payable in the year in which this contract is dated shall be paid as follows: Paid by Seller.
Seller warrants that the real estate taxes and installments of special
assessments which were due and payable in the years preceding the year in which this
contract is dated are paid in full.

7. PROPERTY INSURANCE.
(a) INSURED RISKS AND AMOUNT. Purchaser shall keep all buildings,
improvements and fixtures now or later located on or a part of the Property insured against
loss by fire, extended coverage perils, vandalism, malicious mischief and, if applicable,
steam boiler,explosion for at least the amount of Full Insurable Value. If any of the
buildings, improvements or fixtures are located in a federally designated flood prone area,
and if flood irisurance is available for that area, Purchaser shall procure and maintain flood
insurance in amounts reasonably satisfactory to Seller,
(b) OTHER TERMS. The insurance policy shall contain a loss payable
clause in favor of Seller which provides that Seller's right to recover under the insurance
shall not be impaired by any acts or omissions of Purchaser or Seller, and that Seller shall
otherwise be afforded all rights and privileges customarily provided a mortgagee under the
so-called standard mortgage clause.
(c) NOTICE OF DAMAGE. In the event of damage to the Property by fire
or other casualty. Purchaser shall promptly give notice of such damage to Seller and the
insurance company.
8. DAMAGE TO THE PROPERTY.
(a) APPLICATION OF INSURANCE PROCEEDS, if the Property is
damaged by fire or other casualty, the insurance proceeds paid on account of such
damage shall be applied to payment of the amounts payable by Purchaser under this
contract, even if such amounts are not then due to be paid, unless Purchaser makes a
permitted election described in the next paragraph. Such amounts shall be first applied to
unpaid accrued interest and next to the installments to be paid as provided in this contract
in the inverse order of their maturity. Such payment shall not postpone the due date of the
installments to be paid pursuant to this contract or change the amount of such
installments. The balance of insurance proceeds, if any, shall be the property of
Purchaser.

PURCHASER'S EkECTION TO REBUILD. If Purchaser is not in
default under this contract, or after curing any such default, and if the mortgagees in any
prior mortgages and sellers in any prior contracts for deed do not require otherwise,
Purchaser may elect to have that portion of such insurance proceeds necessary to repair,
replace or restore the damaged Property (the repair work) deposited in escrow with a bank
or title insurance company qualified to do business in the State of Minnesota, or such other
party as may be mutually agreeable to Seller and Purchaser. The election may only be
made by written notice to Seller within sixty days after the damage occurs. Also, the
election will only be permitted if the plans and specifications and contracts for the repair
work are approved by Seller, which approval Seller shall not unreasonably withhold or
delay, if such a permitted election is made by Purchaser, Seller and Purchaser shall jointly
deposit, when paid, such insurance proceeds into such escrow. If such insurance
proceeds are insufficient for the,repair work, Purchaser shall, before the commencement of
the repair work, deposit into such escrow sufficient additional money to insure the full
payment for the repair work. Even if the insurance proceeds are unavailable or are
insufficient to pay the cost of the repair work, Purchaser shall at all times be responsible to
pay the full cost of the repair work. All escrowed funds shall be disbursed by the escrowee
in accordance with generally accepted sound construction disbursement procedures. The
costs incurred or to be incurred on account of such escrow shall be deposited by
Purchaser into such escrow before the commencement of the repair work. Purchaser shall
complete the repair work as soon as reasonably possible and in a good and workmanlike
manner, and in any event the repair work shall be completed by Purchaser within one year
after the damage occurs. If, following the completion of and payment for the repair work,
there remain any undisbursed escrow funds, such funds shall be applied to payment of the
amounts payable by Purchaser under this contract in accordance with paragraph 8(a)
above.
(b)
9. INJURY OR DAMAGE OCCURRING ON THE PROPERTY.
(a) LIABILITY. Seller shall be free from liability and claims for damages
by reason of injuries occurring on or after the date of this contract to any person or
persons or property while on or about the Property. Purchaser shall defend and indemnify
Seller from all liability, loss, costs and obligations, including reasonable attorneys' fees, on
account of or arising out of any such injuries. However, Purchaser shall have no liability or
obligation to Seller for such injuries which are caused by the negligence or intentional
wrongful acts or omissions of Seller.
(b) LIABILITY INSURANCE. Purchaser shall, at Purchaser’s own
expense, procure and maintain liability insurance against claims for bodily injury, death
and property damage occurring on or about the Property in amounts reasonably
satisfactory to Seller and naming Seller as an additional insured.
10. INSURANCE, GENERALLY. The insurance which Purchaser is required to
procure and maintain pursuant to paragraphs 7 and 9 of this contract shall be issued by an
insurance company or companies licensed to do business in the State of Minnesota and
acceptable to Seller. The insurance shall be maintained by Purchaser at all times while
any amount remains unpaid under this contract. The insurance policies shall provide for
not less than ten days written notice to Seller before cancellation, non-renewal, termination

or change in coverage, and Purchaser shall deliver to Seller a duplicate original or
certificate of such insurance policy or policies.
CONDEMNATION. If ail or any part of the Property is taken in condemnation
proceedings instituted under power of eminent domain or is conveyed in lieu thereof under
threat of condemnation, the money paid pursuant to such condemnation or conveyance in
lieu thereof shall be applied to payment of the amounts payable by Purchaser under this
contract, even if such amounts are not then due to be paid. Such amounts shall be
applied first to unpaid accrued interest and next to the installments to be paid as provided
in this contract and in the inverse order of their maturity. Such payment shall not postpone
the due date of the installments to be paid pursuant to this contract or change the amount
of such installments. The balance, if any, shall be the property of Purchaser.
11.
WASTE, REPAIR AND LIENS. Purchaser shall not remove or demolish
any buildings, improvements or fixtures now or later located on or a part of the Property,
nor shall Purchaser commit or allow waste of the Properly. Purchaser shall maintain the
Property in good condition and repair. Purchaser shall not create or permit to accrue liens
or adverse claims against the Property which constitute a lien or claim against Seller's
interest in the Property. Purchaser shall pay to Seller all amounts, costs and expenses,
including reasonable attorneys' fees, incurred by Seller to remove any such liens dr
adverse claims.
12.
13. DEED AND MORTGAGE REGISTRY TAXES. Seller shall, upon Purchaser’s
full performance of this contract, pay the deed tax due upon the recording or filing of the
deed to be delivered by Seller to Purchaser. The mortgage registry tax due upon the
recording or filing of this contract shall be paid by the party who records or files this
contract: however, this provision shall not impair the right of Seller to collect from
Purchaser the amount of such tax actually paid by Seller as provided in the applicable law
governing default and service of notice of termination of this contract.
14. NOTICE OF ASSIGNMENT. If either Seller or Purchaser assign their
interest in the Property, a copy of such assignment shall promptly be furnished to the non-
assigning party.
15. PROTECTION OF INTERESTS. If Purchaser fails to pay any sum of money
required under the terms of this contract or fail to perform any of their obligations as set
forth in this contract, Seller may, at Seller's option, pay the same or cause the same to be
performed, or both, and the amounts so paid by Seller and the cost of such performance
shall be payable at once, with interest at the rate stated in paragraph 4 of this contract, as
an additional amount due Seller under this contract. If there now exists, or if Seller
hereafter creates, suffers or permits to accrue, any mortgage, contract for deed, lien or
encumbrance against the Property which is not herein expressly assumed by Purchaser,
and provided Purchaser is not in default under this contract. Seller shall timely pay all
amounts due thereon, and if Seller fails to do so. Purchaser may, at Purchaser's option,
pay any such delinquent amounts and deduct the amounts paid from the installment(s)
next coming due under this contract.

16. DEFAULT. The time of performance by Purchaser of the terms of this
contract is an essentiai part of this contract. Should Purchaser fail to timely perform any of
the terms of this contract, Seller may, at Seller’s option, elect to declare this contract
canceled and terminated by notice to Purchaser in accordance with applicable law. All
right, title and interest acquired under this contract by Purchaser shall then cease and
terminate, and all improvements made upon the Property and all payments made by
Purchaser pursuant to this contract shall belong to Seller as liquidated damages for breach
of this contract. Neither the extension of the time for payment of any sum of money to be
paid hereunder nor any waiver by Seller of Seller's rights to declare this contract forfeited
by reason of any breach shalMn any manner affect Seller’s right to cancel this contract
because of defaults subsequently occurring, and no extension of time shall be valid unless
agreed to in writing. After service of notice of default and failure to cure such default within
the period allowed by law. Purchaser shall, upon demand, surrender possession of the
Property to Seller, but Purchaser shall be entitled to possession of the Property until the
expiration of such period.
17. BINDING EFFECT. The terms of this contract shall run with the land and
bind the parties hereto and their successors in interest.
18. HEADINGS. Headings of the paragraphs of this contract are for
convenience only and do not define, limit or construe the contents of such paragraphs.
ASSESSMENTS BY OWNERS’ ASSOCIATION. If the Properly is subject to
a recorded declaration providing for assessments to be levied against the Property by any
owners’ association, which assessments may become a lien against the Property if not
paid, then:
19.
(a) Purchaser shall promptly pay, when due, all assessments imposed by
the owners' association or other governing body as required by the provisions of the
declaration or other related documents; and
(b) So long as the owners’ association maintains a master or blanket
policy of insurance against fire, extended coverage perils and such other hazards and in
such amounts as are required by this contract, then:
(i)Purchaser’s obligation in this contract to maintain hazard
insurance coverage on the Property is satisfied; and
The provisions in paragraph 8 of this contract regarding
application of insurance proceeds shall be superseded by the
provisions of the declaration or other related documents; and
In the event of a distribution of insurance proceeds in lieu of
restoration or repair following an insured casualty loss to the
Property, any such proceeds payable to Purchaser are hereby
assigned and shall be paid to Seller for application to the sum
secured by this contract, with the excess, if any, paid to
Purchaser.

20. ADDITIONAL TERMS;
(a) Purchaser shall not, during the term of this contract, cause any material to be
delivered or labor to be performed upon any part of the property covered by this contract,
unless Purchaser first obtains the written consent of Seller. Purchaser further agrees to
indemnify and hold harmless Seller against all claims for labor and materials or services
made against the property covered by this Contract for Deed and for the costs of enforcing
this indemnification, including reasonable attorney’s fees.

Dear Honorable Commissioner,
The City Council of the City of Ottertail wishes to express its concern over the proposed
Conditional Use Permit by applicant Jason Stowers at 33159 Ottertail River Road. This
property is very close to Hwy 1 therefore creating a potential eyesore with non-working
vehicles accumulating, in reality a “junk yard.” This use could also potentially create a
pollution hazard with the property being in close proximity to water.
At the very least a fence should be required to isolate the area from view.
The County of Otter Tail should ensure to the public that it is doing its best to protect our
waters as well as continually maintain the visible beauty of the lakes area.
