January 12, 2005 - Motion: A motion by Estes, second by Schwartz, to table (at
the Applicant’s request) to April 13, 2005, due to the snow cover and the inability of
the Commission Members to view the property. The Applicant is to provide a plan
(to be received by Land & Resource Management, no later than March 25, 2005),
indicating what is proposed to be done to complete the project (including the
impervious surface).

April 13. 2005:
Motion: A motion by Zimmerman, second by Estes to deny, as the Application
indicated that the purpose was to minimize erosion and it appears that the request will
exacerbate erosion. Additional reasons for denial include the following: 1. The distance
to the property line of the neighbor (too close). 2. It is located in the shore impact zone.
3. The high level of impervious surface onsite. 4. We should not allow this After-the-
Fact request to continue. 5. If this had been requested prior to the work being done, it
would not have been approved.

Dear Mr. & Mrs. Jonson,
I am enclosing the promised application forms for After the Fact (ATF)
Variance and Conditional Use Permit (CUP). The timing of the hearings of
the respective boards complements each other (the Variance Board meets
before the Planning Commission).
You need a variance for your work over 3’ high in front of your house as
well as the work done in the shore impact area (within 37 14 feet of the lake).
And a Conditional Use permit to actually do the work since it is not
something that we would permit under a Grade & Fill Permit.
You need to meet the earliest submission deadlines in order to get this
situation resolved this year.
Your other choice is to just let this go to court. It’s your decision.
